BACKGROUND: The Jordan Lake Partnership was established in 2009 via a Memorandum of Understanding (MOU) signed by Orange County and other municipalities with a mutual interest in a regional approach to water use in general and use of the Jordan Lake Water Supply in particular. The JLP meets on a regular basis to discuss items of interest and over the last several years has been working together to develop a Regional Water Supply Plan. The original MOU was for a five year term and is set to expire on June 30, 2014. Attachment 1 is an addendum to the original MOU which adds five more years to the term of the agreement. Orange County has always been forward-thinking in terms of water conservation, resource protection and smart use of water resources. The County's position at the headwaters of many of the streams and rivers which cross it makes this mindset all the more pertinent. Recognizing Jordan Lake's prominent role in the future water supply of the municipalities which surround it, the JLP has been working to keep dialog open among all the water users of the region. When the State announced it would be taking new Jordan Lake allocation requests, the JLP began working to develop a set of regionally consistent allocation applications which cover the needs of the partners and the needs of the region. Orange County has submitted a Draft Jordan Lake Allocation Application to the State for review and comment. The JLP was invaluable in providing technical data and peer review for the application, which served to greatly strengthen the request for additional Jordan Lake allocation. Participation with the JLP will continue to be valuable as the Jordan Lake Allocation process moves forward over the next several years. As a final note, staff is working to schedule time at a work session after the summer break to update the BOCC on the Jordan Lake allocation application and processing timeline. 2 FINANCIAL IMPACT: The proposed 2014-2015 budget includes $58,801 to cover the cost of participation in the JLP and $49,901 for an Interconnection Study being performed by Cazen and Sawyer as consultants to the JLP. RECOMMENDATION(S): The Manager recommends the Board approve Addendum No. 1 to the Jordan Lake Partnership (JLP) Memorandum of Understanding, renewing the County's agreement to participate until June 30, 2019, and authorize the Manager to sign the Addendum on behalf of the County. Attachment 1 3 ADDENDUM No. 1 to the MEMORANDUM OF UNDERSTANDING SUPPORTING A REGIONAL PARTNERSHIP FOR WATER SUPPLY PLANNING AND POTENTIAL JOINT USE OF THE B.EVERETT JORDAN RESERVOIR The purpose of this Addendum is to extend the term of the Memorandum of Understanding from June 30, 2014 to June 30,2019. The addendum is authorized under the MOU pursuant to Section 7 regarding Duration,Amendment and Termination,which states that the term of the MOU can be extended upon mutual written agreement of the signatories. WHEREAS, the Jordan Lake Partnership has proved a successful collaborative effort to define Jordan Lake's role in a long-term sustainable and secure regional water supply for the Research Triangle Region; and, WHEREAS,the Partnership has accomplished a number of its objectives, including calculating peer-reviewed population and water demand projections, identifying future water supply needs, Phase I of the Interconnections Study,the Western Intake Study, drafted alternative supply plans and unanimously agreed on a preferred regional alternative, and completed Volumes I& II of the Triangle Regional Water Supply Plan; and, WHEREAS,the work of the Partnership is ongoing, including Phase II of the Interconnections Study, and submission of Partners' Jordan Lake allocation applications; and, WHEREAS,Partners intend to continue to support regional collaboration by participating in the Jordan Lake Partnership; BE IT RESOLVED,that the signatories of the Memorandum of Understanding Supporting a Regional Partnership for Water Supply Planning and Potential Joint Use of the B. Everett Jordan Reservoir would like to extend the term of the MOU; NOW, THEREFORE,the signatories have agreed to the following Addendum to the Memorandum of Understanding: C L On March 16, 2009, signatories entered in a Memorandum of Understanding (MOU) for the purpose of pledging to work together as part of a Jordan Lake Regional Water Supply Partnership, referred to as the Jordan Lake Partnership. IL The parties now mutually agree to amend the referenced MOU as follows. Delete the first sentence in Section 7 and replace it with the following: "The term of this Memorandum of Understanding shall begin upon the approval of the second signatory. This Memorandum of Understanding shall terminate on June 30, 2019." III. The parties have executed this addendum on the day and year written below.
