GENERAL INFORMATION This document was developed to provide a uniform format for handling contract changes that affect Contract Price or Contract Times. Changes that have been initiated by a Work. Change Directive must be incorporated into a subsequent Change Order if they affect Price or Times. Changes that affect Contract Price or Contract Times should be promptly covered by a Change Order. The practice of accumulating Change Orders to reduce the administrative burden may lead to unnecessary disputes. If Milestones have been listed in the Agreement, any effect of a Change Order thereon should be addressed. For supplemental instructions and minor changes not involving a change in the Contract Price or Contract Times, a Field Order should be used. B. COMPLETING THE CHANGE ORDER FORM Engineer normally initiates the form, including a description of the changes involved and attachments based upon documents and proposals submitted by Contractor, or requests from Owner, or both. Once Engineer has completed and signed the form, all copies should be sent to Owner or Contractor for approval, depending on whether the Change Order is a true order to the Contractor or the formalization of a negotiated agreement for a previously performed change. After approval by one contracting party, all copies should be sent to the other party for approval. Engineer should make distribution of executed copies after approval by both parties. If a change only applies to price or to times, cross out the part of the tabulation that does not apply. I have made these two assumptions to accomplish this:first,the existing soil conditions on Lines S-1 V S-3 will be the same for all work.They appear to be the same however the rock is buried therefore they seem to be very consistent. Secondly, the actual ratio of rock encountered during excavation of the recently constructed line and the future line work will be consistent.The topography of the two lines appear similar supporting this fact. The contractor has install sewer line from Sta 0+00 to MH#53 (approx.4600 Lin. Ft.)and "hit" 6350 Cu.Yds. of rock. Based on the above statements, 4500 Cu.Yds.of rock will be needed to complete Line S-3.Also the construction of Line S-1 will need approximately 6000 CU.Yds.of rock.This could result in amount totallingf 17,000 Cu.Yds.of rock for the entire project.The original Construction Bids included 6338 Cu.Yds. of rock @ $60.00 per Cu.Yd.Therefore,there is a possible change order amount of 10,662 Cu.Yds. of rock for the entire Project. BACKGROUND: This project has been underway since the Spring of this year. The overall project is more than 50% complete and consists of three distinct parts: 9,000 linear feet of 18" gravity sewer line, 14,000 linear feet of 16" water line, and 5,700 linear feet of 8" and 12" gravity sewer line. These water and sewer lines will serve the areas designated for economic development and growth near Mebane and along the Interstate corridor in the western portion of Orange County (see Attachment 1). The original estimated rock quantity for the 18" sewer line was 3,825 cubic yards. However, after constructing approximately 4,600 linear feet (51%) of this line,_ the Contractor has excavated 6,350 cubic yards of rock as of November 8, 2013. In Attachment 2, there are two photographs which give an indication of the jobsite conditions and rock quantities encountered so far. Because of the large quantity of rocky material, the Contractor has brought in a mobile rock crusher which can be seen in one of the photographs. The contractor has been crushing the excavated rock and returning it to the upper portion of the trench as fill. This avoids having to haul the rock out by the truckload for disposal and having to purchase and haul in select fill to replace the rock that was removed. The County's engineering s en ineerin consultant, Hobbs, Upchurch and Associates, is estimating that if conditions stay consistent with the first segment of this line, there could be an additional 4,500 cubic yards of rock left to be excavated to finish this line. If the consultant's estimate proves 2 true, the total rock excavated for this 18" sewer line would be 10,850 cubic yards. When compared to the original estimate of 3,825 cubic yards, the difference is 7,025 cubic yards. The rock excavation line item is paid at $60 per cubic yard of rock excavated, so adding an additional rock contingency of 7,025 cubic yards could potentially increase the construction costs by $421,500. However, the request is only to add rock contingency to the project budget. If the Contractor excavates less rock than estimated, this money will not be spent. The other parts of the project each have their own rock allowance included in the original project budget. The water line is approximately 75% complete and has used only a fraction of its rock contingency. Construction of the 8"-12" sewer line has not yet begun, but it has its own rock allowance, as mentioned above, and can use any remaining rock allowance not used on the construction of the 18" sewer line, if necessary. FINANCIAL IMPACT: This project currently has a construction budget of $4,016,546. Adding the rock allowance contingency as outlined above would increase the construction budget by $421,500. These extra funds would come from money generated by the Article 46 Sales Tax and earmarked for infrastructure development. As a result of the additional money that would be allocated towards this project, other Capital Investment Plan (CIP) projects which are to be funded in the future by the Article 46 Sales Tax Revenue will have to be delayed or have their scope, reduced. Staff will be making proposals Pn next year's CIP budget and will suggest specific project budget modification changes at that time. The majority of the original rock allowance had been used up before the line was even 50%complete. Based on the excavation remaining and using the same relative percentage of rock encountered so far, an estimated increase in the rock allowance for this section was proposed to the BOCC and approved on 12/2/2013. This was approved as a budget amendment for the project, so the money has been available since then to pay for the continued excavation. This change order will document this change in rock quantities relative to the original contract documents for the project. The cost of this change order has been summarized below, along with the summary for Change Order#1, #2 and#3. Going forward, new change orders can be added to this summary so that all the change order information will be available in one document for easy review. Based on the original schedule the allowed substantial completion date would have been 4/16/2014, or 365 days. C0#1 added an additional 57 days due to delays in obtaining easements and the time to complete the extra work. This extended the contractually allowed substantial completion date to 6/12/2014. CO#2 added an additional 8 days due to inclement weather, which pushed the allowed substantial completion date out to 6/20/2014. CO#3 requests an additional 76 days due to delays in easement acquisition on the Rohl property along line S-1 and delays associated with realignment of the beginning section of line S-1. Adding these 76 days would reset the allowed substantial completion date to 9/4/2014. CO#4 adds no additional time. Please call or email with any questions.
