RE: Buckhorn Mebane Phase 2 Utility Project Change Order#3
This change order is based on a request for a time extension submitted by the Contractor on
October 17, 2013. The request for time extension was due to two unrelated delays. One was a
delay in acquiring the finalized easement across a large portion of property near the western end
of line S-1. This easement had to be redone when the archaeological survey discovered a
potentially sensitive area along the originally designed path of the sewer line. The sewer line
route had to be redesigned and the easement redone. Several complications arose with this,most
prominently that the land had been redistributed amongst several out-of-state heirs after the
original easement was signed, which made contacting and acquiring signatures difficult.
The second delay was related to the original sewer line design around a pond at the eastern end
of sewer line S-1. Because of the topography,the sewer line was going to be in the toe of the
pond dam as designed, even though it was far enough away from the water's edge to satisfy State
buffer requirements. The Contractor raised the question and the decision was made to change
the route so the sewer line passed the pond on the opposite side to avoid the dam. While this
new design was being worked out,the Contractor submitted this request as an open ended time
request. Hobbs Upchurch has made a determination that this request ends on December 1, 2013,
which set the number of days requested as part of this request at 76. The contractor has since
been given permission to begin at Manhole#5 along line S-1, so as not to delay them any longer.
While this is not ideal, it does allow the Contractor to commit a crew to the job and not prolong
construction of line S-1.
The costs of the change orders have been summarized below, along with the summary for
Change Order#I and#2. Going forward,new change orders can be added to this summary so
that all the change order information will be available in one document for easy review.
Original Contract Price: $4,016,545.74
- Original rock contingency for water line: $ 67,500.00 (included)

SCHEDULE
The project start date was 4/16/2013. Based on the original schedule the allowed substantial
completion date would have been 4/16/2014, or 365 days. CO#1 added an additional 57 days
due to delays in obtaining easements and the time to complete the extra work. This extended the
contractually allowed substantial completion date to 6/12/2014.
CO#2 added an additional 8 days due to inclement weather, which pushed the allowed
substantial completion date out to 6/20/2014.
CO#3 requests an additional 76 days due to delays in easement acquisition on the Rohl property
along line S-1 and delays associated with realignment of the beginning section of line S-1.
Adding these 76 days would reset the allowed substantial completion date to 9/4/2014.

Change Order
Instructions
A. GENERAL INFORMATION
This document was developed to provide a uniform format for handling contract changes that affect
Contract Price or Contract Times. Changes that have been initiated by a Work Change Directive must be
incorporated into a subsequent Change Order if they affect Price or Times.
Changes that affect Contract Price or Contract Times should be promptly covered by a Change Order.
The practice of accumulating Change Orders to reduce the administrative burden may lead to
unnecessary disputes.
If Milestones have been listed in the Agreement, any effect of a Change Order thereon should be
addressed.
For supplemental instructions and minor changes not involving a change in the Contract Price or Contract
Times, a Field Order should be used.
B. COMPLETING THE CHANGE ORDER FORM
Engineer normally initiates the form, including a description of the changes involved and attachments
based upon documents and proposals submitted by Contractor, or requests from Owner, or both.
Once Engineer has completed and signed the form, all copies should be sent to Owner or Contractor for
approval, depending on whether the Change Order is a true order to the Contractor or the formalization of
a negotiated agreement for a previously performed change. After approval by one contracting party, all
copies should be sent to the other party for approval. Engineer should make distribution of executed
copies after approval by both parties.
If a change only applies to price or to times, cross out the part of the tabulation that does not apply.

Dear Mr. Lindley:
For Hobbs, Upchurch & Associates' (HUA)Change Order#3 (dated December 17, 2013),attached
is the J.F. Wilkerson Contracting Co. (JFW)Change Order Request#6(dated October 17, 2013), as
submitted to HUA by JFW. This Change Order/ Change Order Request were for the original cost
of the realignment of Line S1 and for the time involved in the delay. We all know the realignment
was shifted again. However, as per discussion with Mike Coates, he wanted to document the time
through December 1,2013.
Therefore, HUA Change Order #3 includes the time of 76 days from September 15, 2013 to
December 1, 2013. The cost total will be determined in the future.
