The Board of Commissioners for -the County of Orange, North Carolina, met in �
�i regular session at the County Courthouse in Hillsborough, North Carolina, at 10 �S
aj o'clock A.M., on Tuesday, July.5, 1966, Monday, July 4, 1966 having' been a legal g
holiday.
Present: Chairman Harvey D. Bennett, and Commissioners Henry S. Walker, Gordonli

The Board authorized the Clerk to dispense with the reading of the minutes of
} the June meetings as copies of said minutes had been mailed and received by all the if
Board members.
A. H. Graham, County Attorney, presented the two following certified copies of �
a resolution from the Board of Commissioners of the Town of Carrboro and from the 3.
!I Board of Alderman of the Town of Chapel Hill.

Carolina, was held in the Town Hall, the usual place of meeting, at 7:30 o'clock,

RESOLUTION RELATING TO THE CREATION1
OF A RECREATION DISTRICT

BE IT RESOLVED by the Board of Commissioners of the Town of Carrboro: !
6 Section 1. The Board of Commissioners has determined and does hereby find and i
f declare:
(a) That, pursuant to the provisions of Chapter 1107, Session Laws of 1965, a ;
' copy of a petition, addressed to the Board of Commissioners of Orange County, has
:! been received by this Board in the following form:
"PETITION
TO: THE BOARD OF COMMISSIONERS OF ORANGE COUNTY
WE, THE UNDERSIGNED resident freeholders all residing with the recreation
district herein petitioned for, do hereby request the Board of County Commissioners
of Orange County to exercise the authority granted to it by the 1965 General
!' Assembly (Chapter 1107, 1965 Session Laws) with the following action:
(1) The creation of a recreation district coterminous with the present j
boundaries of the Chapel Hill School District, which district is more
i particularly described in Attachment A hereto, the object proposed to be
accomplished by the creation of such district being the providing of
public recreation facilities in order to preserve and promote the public
ii good and general welfare, and
(2) The calling of a special election within said district for the purpose of j
voting upon: i
(a) the issuance of Recreation Facilities Bonds in the amount of
j $400,000.00 for the purpose of providing funds, with any other
available funds, for acquiring, improving and equipping lands and
buildings for parks, playgrounds, recreation centers and other
recreational facilities, and a tax for the payment of the principal !<
of and the interest on such bonds, and ?,
(b) the levy of an annual tax of not less than three cents nor more than
1? ten cents on each $100.00 of assessed valuation of the taxable
!! property within such district for the provision, establishment,

maintenance and operation of the recreational facilities, the amount 4

The boundaries of the proposed recreation district are as follows:
�i BEGINNING in the center line of State Road #1112, where the Chapel Hill (�
ii and Bingham Township line crosses said road; thence in a Southeasterly
direction along the center of said road 250 feet to a point where the
center line of State Road #1113 intersects with State Road #1112; thence `
in a Northeasterly direction along State Road #1113, 1,525 feet to a
concrete marker in the center of said road; thence South 71° 20' East
4,390 feet to a concrete marker in the East side of State Road #1179;
ii thence South 82° 30, East 5,480 feet to a concrete marker in the East
side of old N. C. Highway 86; thence South 81° 09' East 8,780 feet to a i
point 50 feet East of the center line of State University Railroad; then

(d) That the Town of Carrboro is located within the boundaries of such
proposed recreation district.
Section 2. Said petition is hereby approved in all respects and the
Board of Commissioners of the Town of Carrboro hereby requests the Board of
Commissioners for the County of Orange to exercise the authority granted to it by

said Chapter 1107 by taking the action requested in said petition.
Section 3. A copy of this resolution shall immediately be certified to
the Board of Commissioners for the County of Orange.

Section 4. This resolution shall take effect upon its passage.
Thereupon Commissioner Harold Dark moved the passage of the foregoing

and Commissioner A. B. Poole seconded the motion, and the resolution was passed by
the following vote:

Board of Commissioners for the County of Orange.
Section 4. This resolution shall become effective upon its passage.

Section 1. That the Board of Commissioners has determined and does hereby
find and declare:
(a) That on July 5, 1966, a petition in the following form was received by
the Board of Commissioners for the County of Orange:
(b) That the territory described in said petition is located in Orange Count;
and that the Towns of Carrboro and Chapel Hill are the only municipal corporationsil
I' included in said territory. II
(c) That said petition was duly signed by 896 freeholders residing within th
proposed recreation district, that there are 8,053 freeholders residing within sai�
proposed recreation district, and that the number of resident freeholders who
signed said petition is not less than 10% of the resident freeholders residing ]
within said proposed recreation district.
(d) That said petition requests the Board of Commissioners for the County of
Orange to take all necessary action required by Chapter 1107, Session Laws of 1965��
for the creation of a recreation district comprising the territory described there-��
in and sets forth the boundaries of the proposed recreation district and the objec t
proposed to be accomplished by the creation of such district.

(e) That said petition has been approved by resolutions adopted by the Boards
of Commissioners of the Town of Carrboro on June 28, 1966, and by the Board of
Aldermen of the Town of Chapel Hill on June 27, 1966, respectively, certified y�
copies of said resolutions having been received by the Board of Commissioners on
July 5, 1966, and have been recorded in Volume 6 of the minutes of said Board,
beginning at page 457 and ending at page 460.
Section 2. That pursuant to the provisions of Chapter 1107, Session Laws of
1965, a public hearing shall be held at 3 P.M., Eastern Standard Time, at the I
County Courthouse in Hillsborough, North Carolina, upon the question of creating
said recreation district.

George Spransy, resident of Dogwood Acres, appeared before the Board to make
1f-inquiry about the following items:
( First: Mr. Spransy's first question pertained to whether or not Orange County
had a anti-noise ordinance.
Second: Mr. Spransy also requested that Dogwood Acres Extension be considered
�j by the Board or State Highway Commission for improvement and/or
paving. He stated that numerous petitions had been submitted by the
property owners of the area, but that no improvements had been made.

Third: Mr. Spransy raised questions pertaining to the lack of fire protection I
for the residents of Dogwood Acres.
Chairman Bennett advised Mr. Spransy that no anti-noise ordinance existed and l`
;that any disturb ance in the area should be reported to the Sheriff's department.
'!That the count board had no authority over the policies of the State Highway
!Commission concerning road improvement and that the inquiry pertaining to fire
�fprotection should be pursued by contacting the Carrboro Town Board.
Upon motion of Commissioner Walker, seconded by Commissioner Ray the

a Chairman Bennett read a letter from Harry J. Palmer, Senior Regional Planner,

`i Dr. O. David Garvin, District Health Officer, presented Dr. Bill Hollister and
Dr. Morgan to the Board to explain a Mental Health project which was being
sponsored by The University of North Carolina and State Health Department, and
which they hoped to locate in one of the Piedmont counties. Discussion ensued
concerning Orange County's attitude towards such a project.
IUpon motion of Commissioner Ray, seconded by Commissioner Cleveland, and
unanimously adopted, it was agreed that if Orange County is selected as the target
county for the Mental Health Project that the county does indorse the Mental
Health project as presented by Dr. Hollister and will cooperate in the development
1 of such project plans.

Discussion ensued concerning the proposed 1966-1967 budget.
There being no further business to come before the Board said meeting was
j adjourned to meet again on July 7, 1966 at 8:00 P.M. in the Commissioners room
at the Courthouse in Hillsborough, North Carolina.
