l STS � a ORANGE COUNTY ARTS COMMISSION z J k A N G E C u u�a r r A R T s FALL, 2013 GRANT AGREEMENT ° U n THIS AGREEMENT, entered into this 12th day of December, 2013, by and between Orange County ("County"), by and through the Orange County Arts Commission ("Arts Commission") and Friends of the Carrboro Branch Library("Grant Recipient"). WHEREAS, the Arts Commission is a countywide arts agency that ensures the growth of local arts experiences by providing funding and support for diverse high quality programs and projects. WHEREAS, the Arts Commission administers the Spring and Fall Arts Grants Program to provide economic opportunities to Orange County artists and non-profit organizations coordinating arts projects benefiting the citizens of Orange County. WHEREAS, the Spring Arts Grants Program is supported by Arts Commission with funds from the Grassroots Program of the North Carolina Arts Council, an agency of the Department of Cultural Resources and the National Endowment for the Arts. WHEREAS, the Grant Recipient was selected by the Arts Commission to receive the Spring Arts Grant through the procedures duly adopted by the Arts Commission; and WHEREAS, both parties wish to promote and maintain the integrity and clarity of the Grant Recipient's ideas and statements and delineate the Grant Recipient's obligations to the County; NOW, THEREFORE, the County and the Grant Recipient, for the consideration and under the conditions hereinafter set forth, agree as follows: 1. Approved Grant Project. Grant funds are provided under this Agreement for the project ("Project") described in the Grant Recipient's Grant Application, attached hereto and incorporated herein as Exhibit A. 2. Grant Award. Grant funds in an amount not to exceed one thousand five hundred dollars ($1,500) have been awarded by the Arts Commission to the Grant Recipient for the approved Project. These funds must be matched at least dollar-for-dollar with cash from the Grant Recipient's funds not derived from either Orange County appropriations or the North Carolina Arts Council. 3. Contingency. This grant is contingent on North Carolina Arts Council Grassroots Program funding to the Arts Commission. Final decisions on Grassroots Program funds to the North Carolina Arts Council are subject to approval by the North Carolina General Assembly. 4. Responsibilities of the Grant Recipient 1 Revised May 2012 A. Implementation. The Project implementation shall take place between January 1, 2014 and December 31, 2014. The Project shall be implemented in the manner described in Exhibit A. Time is of the essence in the implementation of the Project. B. Modifications to project. Grant Recipient shall present major changes to the original proposal, including but not limited to changes in design, implementation schedule and increase in Project budget by more than 10%, in writing to the Arts Commission for approval. Arts Commission shall approve or disapprove Grant Recipient's request for modifications within seven (7) days of receipt thereof. Consent to project modifications shall not be unreasonably withheld. Arts Commission's decisions shall be in writing. In the event the Arts Commission fails to approve or disapprove the requested modifications within the time stated herein,the modifications shall be deemed approved. C. Non—assignment. The grant cannot be assigned or transferred to a different project or artist without prior written approval of the Arts Commission. D. Records. Grant Recipient must maintain records and other evidence pertaining to costs incurred and revenues acquired during the Project implementation. Grant Recipient shall maintain financial records pertaining to the Project for three (3) years from the date of this Agreement, in case of audit. E. Use of Funds. Grant Recipient shall not use the grant funds to repay outstanding taxes or other debts of any nature. The grants shall be utilized solely for the purpose of implementing the Project and Project related expenses. F. Final Report. Grant Recipient shall submit to the Arts Commission a Final Report on January 16, 2015 . The Final Report shall be in the format required by the North Carolina Arts Council. Failure to submit the Final Report or late submission of the Final Report, for any reason, shall be grounds for denial and/or cancellation of grant funds for the Project and future grant proposals. 5. Responsibilities of the Arts Commission A. Pam. The Arts Commission shall release the grant funds in the amount of $1,500 to the Grant Recipient. 6. Publicity A. Acknowledgement. Credit must be given to the Orange County Arts Commission using the Arts Commission logo and if State funds are received to the North Carolina Grassroots Program in brochures, news releases, programs, and all other printed and online publications. Copies of such printed materials must accompany the evaluation report. When no printed information is used, verbal credit shall be given. In addition, all print and promotional material must include the following credit line (check all that apply): 2 Revised May 2012 i. x County Funds Only. "This program is supported by the Orange County Arts Commission. " ii. North Carolina Arts Council Funding. "This program is supported by the Orange County Arts Commission with funds from the Grassroots Program of the North Carolina Arts Council, a state agency. " B. The Grant Recipient must enter all events, exhibits and performances open to the public and related to this grant award on the ExploreChape1HillARTS.com website and display ExploreChape1Hi11ARTS.com publicity materials (postcards, brochures, etc.) prominently and consistently at their venue or performance space. In addition, the Grant Recipient must add a link to the ExploreChape1HillARTS.com (ExploreChape1HillARTS.com logo preferred) to their main webpage. The Grant Recipient shall contact the Orange County Arts Commission for replacement ExploreChape1HillARTS.com publicity materials. 7. Indemnity. The Grant Recipient agrees to indemnify and hold harmless the County, the Arts Commission and the North Carolina Arts Council and their officers and employees from any and all claims or actual injury, damage or loss to a person, or real or personal property that results from or is in any way connected to the use of the grant funds. 8. Independent Contractor. The Grant Recipient is an independent contractor and not an employee, agent or other representative of the County and/or the Arts Commission. Nothing contained in this Agreement shall be construed to create the relationship of principal and agent, or employer and employee, between Grant Recipient and Arts Commission or Orange County Government. Grant Recipient understands and agrees that he/she is not authorized to incur any expenses or any liability whatsoever on behalf of the County or the Arts Commission and has no authority, expressed or implied, to obligate or make representations on behalf of the County or the Arts Commission. In addition, Grant Recipient agrees to maintain his or her own worker's compensation insurance for himself/herself and his or her employees for the duration of the art work's installation. 9. Termination A. In the event of any of the circumstances set forth below(hereinafter referred to as "default"),the Arts Commission may immediately terminate this Agreement: (i) Any fraudulent representation in any verification required to obtain payment under this Agreement or other dishonesty on a material matter relating to the performance of services under this Agreement. (ii) Nonperformance, incomplete service or performance, or failure to satisfactorily perform any part of the Project or to comply with any provision of this Agreement, as determined by the Arts Commission in its sole discretion. 3 Revised May 2012 (iii) Failure to adhere to the terms of applicable county, state or federal laws, regulations, or stated public policy. B. In the event of default by the Grant Recipient, the Arts Commission has the discretion to elect to terminate this Agreement, in whole or in part and/or require the Grant Recipient to repay the grant funds within seven (7) from written notice of default or allow the grant recipient the opportunity to cure the default. This clause shall not be interpreted to limit the County's or the Arts Commission's remedies in law or in equity. 10. Miscellaneous. A. Entire Agreement. This Agreement and the attachments contain the final and entire understanding of the parties with respect to the subject matter of this Agreement. All modifications and amendments to this Agreement shall be in writing. This Agreement shall be binding upon the parties, their heirs, successors and assigns. B. Governing Law. This Agreement shall be interpreted in accordance with the laws of the State of North Carolina and the Orange County. Delivery address: 501 West Franklin Street, Chapel Hill, NC 27516 FRIENDS OF THE CARRBORO BRANCH LIBRARY: LIBRARY ARTS PROGRAM CONTINUED EXPANSION OF THE LIBRARY"S INTEGRATED CULTURAL ARTS PROGRAM in 2014 A.ORGANIZATIONAL DESCRIPTION The Friends of the Carrboro Branch Library,a voluntary non-profit organization that enjoys the support of over 200 people from Carrboro, South Orange and Chapel Hill,has been an active community group for more than twenty six years. The Friends were instrumental in bringing the need for a branch library in Carrboro and southern Orange to the attention of the Board of Orange County Commissioners and in guiding its establishment. Currently,the Friends are actively involved in the development and expansion of the County's Library system and particularly with the building of the Southern Branch of the Orange County Library.It is anticipated that it will be at least three years before that project is completed. The Carrboro Branch Library opened in the Mc Dougle Schools Media Center,Carrboro on May 1 1995 under the auspices of the Chapel Hill-Carrboro School System and Orange County.The Media Center now serves both the McDougle Elementary and Middle Schools and the Carrboro Branch Library. Until June 1996,when the Orange County Public Library took over the running of the branch library,the Friends filled a part-time position with volunteers,five days a week. (It must be added here that even though we are located in a school setting we have a distinct identity as the Carrboro Branch Library during operating hours). The Friends current tasks include planning and hosting community arts and cultural activities, community outreach activities at Town events such as Carrboro Day and the Fourth of July,and the running of the annual book sale(in November).These activities are in addition to our commitment to ongoing library support services and serving on County and regional boards such as the 2000,2004 and 2007 Orange County Library Task Force. (The Friends of the Carrboro Branch Library's role in the development of an overall library plan for Orange County has been acknowledged at several Board of Orange County Commissioners meetings.)More recently,in July 2008,the Friends were instrumental in getting"cut hours"reinstated in all of Orange County's Libraries while in October 2008 a Friends' representative was involved in the selection process for a new Orange County Library Director.In the spring of 2009 the Friends of the Carrboro Branch Library were instrumental in leading the fight against the complete closure of the Carrboro Branch Library and were successful not only in preventing the closure but also in getting the Board of County Commissioners to increase funding for libraries in general. In 2001,The Friends of the Carrboro Branch Library received two awards for their dedication to supporting the Library. The Friends of Libraries USA honored our group with the place of First Runner Up(i.e. second in the nation)for their submission to the Baker and Taylor Small Libraries Award.The submission featured the Library's Arts Program for 2001, including four large exhibitions and related workshops. The second award was the Frances B.Reid Award given to the Friends of the Carrboro Branch Library by the The Friends of North Carolina Public Libraries for the group's outstanding library support and community involvement.This award was given in large part to the Carrboro Friends because of their Library Arts Program.Meanwhile,Friends of fb CA 4 Libraries USA has included the Carrboro Branch Library's Arts Program in a book on successful library programs. The Friends received another Frances B Reid Award in 2011 for the role as library advocates and for their Library Arts Program. B.CURRENT PROGRAMS AND SERVICES The Friends of the Carrboro Branch Library are an important part of that Library given the facility's small staff and sparse funds. Our group runs outreach community book sales and is a major force behind the Library's involvement with the Community Dinner celebrating Orange County's cultural diversity,held annually in the Mc Dougle Schools Cafetorium. The artist-run Friends Art Committee is entirely responsible for the Library's Arts Program and every year it plans and stages four large exhibitions in the 7,500 square foot Library with related workshops and cultural programs. The Committee has enjoyed exceptional support from both the Friends and the Orange County Arts Commission since the Library opened in May 1995.In 2007, the Orange County Arts Commission rejected our application for funding support for our 2008 program but granted us$1500 in 2008 for 2009 for which we are grateful The OCAC denied the Library Arts Program funding for 2010 but we enjoyed OCAC support for our program in both 2011,2012 and partial funding 2013.We are hoping for continuing OCAC support for our 2014 Library Arts Program. Since starting its arts programming in 1996,the Library has shown the work of over 1600(mostly local)visual artists. Since 1996 all exhibits have involved the community and local artists, agencies and institutions.Even though we hope to be moving into a free standing library facility in a few years time where there will be a designated art gallery space,the minds of the Friends are currently on the need to find funds to supplement the Library's current operating budget and programs--- including the popular Library Arts Program. Currently showing at the Library is the juried exhibition"Drawing in the Ackland"-part four of four community based exhibitions featuring artist run projects on that theme in 2013. C.GRANT PROPOSAL FOR 2014-PROPOSED USE OF GRANT FUNDS. The aim of the Carrboro Library Arts Program is to encourage local artists and culturally diverse groups to display their work on the walls of the Carrboro Branch Library/Mc Dougle Schools Media Center in conjunction with Library programs and public events. The location of the Library in the McDougle Schools gives the Friends,Library and Arts Commission an unprecedented opportunity to introduce over 1400 children per year to the full spectrum of cultural arts,as well as to all members of the Library that frequent the facility. We would like to stress that each year oigr cultural programs have been different,and since May 1996, we have shown the work of over 1600 culturally diverse artists and cultural groups. Our proposed exhibitions for the coming year have their usual emphases on multiculturalism and community and Library support for locally prodgpQd arts,crafts and culture. We must also stress the continued need for a professional tp Work with our volunteers in the hanging of exhibitions, given the large spaces and heights involved. We hope that the Commission will decide to support the following new endeavors in 2014. In 2014 the Library Arts Program has decided to take as its theme"Passion and Possibility: Understanding our community through the eyes of our youth". During the year we intend to stage four exhibitions of youth art along with that of some of their mentors. The first exhibit from mid January through mid March 2014 is entitled"Life is a beautiful thing-a tribute to Sophie Steiner and her peers". Sophie Steiner, a sophomore at East Chapel Hill High School was a gifted young photographer who,at the age 14, died of cancer on August 30`''this year.The exhibition will showcase Sophie's work and a number of photographic collages by her peers-a group of multiracial/multicultural young people at the United Church of Christ,Chapel Hill,of which she was a member. Sophie was bi-cultural and learned to juggle her two cultures, Swiss and American,(as she did her terminal illness with living her life)with both interest and grace.The exhibition is curated by Library Art Committee member David Otto and United Church's Youth Coordinator Jenny Schultz. Our second exhibit from late March through mid June 2014 will feature the work of young Karen refugee artists.This project is a joint venture between the Friends of the Carrboro Branch Library, the Orange County Partnership for Young Children's Karen farm project--Transplanting Traditions,FRANK Gallery and Chapel Hill High School.All groups will be involved in:- 1. Working along side young Karen refugees doing plein air painting and photographic art work on the Karen farm and wherever else the young people chose to document, 2.Participating in studio classes in painting,drawing and photography at the FRANK Gallery taught by FRANK artists,Barbara Tyroler,Mary Lamb,Nerys Levy,Library Art Committee members Nerys Levy and David Taylor and at Chapel Hill High School by clay teacher Hollie Taylor Novak. This multi group project will begin in November 2013 with the purpose of producing art work to exhibit at the Carrboro Branch Library in late March 2014. Our third exhibit from mid June to mid October 2014"We are Chapel Hill High"will feature work by young artists from the Chapel Hill High School along with a few pieces by their mentor art teacher Hollie Taylor Novak. Over 50%of Ms. Taylor Novak's pupils are children of color and some of her students are Karen's two of whom will be participating in the Library's earlier show We are seeking funding for hanging, assembling and publicizing this exhibition.Exhibition related information,resumes, images etc are in the relevant envelope attached to this application. Our fourth exhibition from late October 2014 through early January 2015 will showcase the work of art students from A&T University in Greensboro.Entitled"Place:Real and imagined"this exhibition by predominantly minority students is a continuation of Professor of Art History Janet Seiz's enthusiasm for her students to think out of their cultural boxes while underscoring their own identities as they do so, Professor Seiz's students have worked with Venetian Paintings at the Biltmore estate and have shown great enthusiasm for working and showing in places other than f� A&T University and Greensboro.A lecture/workshop is planned to accompany this exhibition. Professor Seiz's resume and student works are attached in the relevant envelope. We are seeking funding to assist with the hanging and marketing of this exhibition and with the proposed workshop. This slate of exhibitions at the Carrboro Branch Library in 2014 aims to educate the general public about the importance of listening to and engaging with young people in our community through the arts. LEVY 161, Swansea Lane, Chapel Hill,N.C. 27516 Phone-Cell: 919-417-3081 Home: 919-932-1533 Email: rilev finds.a r orn Website: wwjjj ner ,evy.coin ARTIST'S STATEMENT Working on site using mixed water-based media on paper, I try to portray the forms and forces of nature: Polar landscapes and wildlife, Chinese urban and riverine landscapes, Alamance,Orange and Chatham county locations,North Carolina's forests,Alpine masses and glaciers,cloud formations, animals(especially dogs), European gardens and old architectural forms altered by time. I often do a series of works of the same subject in shifting light, seasons and weather. When painting animals, I usually document their movements in a series of works done on site and in their home environments. I visited the Antarctic Peninsula in December 2007 and in July 2009 worked in the Norwegian Arctic, As a result of these Polar experiences,I produced a large body of work on Polar animals and landscapes for the multimedia exhibition"Ice Counterpoint"at UNC's Fed Ex Global Education Center from January 7 through May 312010 and"Artico,Asolo Antartico"at the Asolo Civic Museum,Veneto, Italy in November 2010. Some of these Polar works are currently on exhibit at the Whateomb Museum, Bellingham, WA, in their exhibit"Vanishing Ice" and at Panzanella, Carrboro,N.C,These exhibitions are intended to put a face on the earth's endangered Polar regions and to examine the implications of the changes there for the rest of our planet. PROFESSIONAL BIOGRAPHICAL SKETCH_ Born in Wales and a twenty one year resident of Carrboro North Carolina Nerys Levy is deeply rooted in her native country's culture which has influenced her paintin Levy had a first career in race relations community work and education working in India the Caribbean, South Africa and London. She has a PhD in Modern South Asian History from the University of London. Although she tainted throughout much of her childhood Levy began serious studies in 1980 in La Jolla, California working with various members of the Visual Arts Department of the University of California at San Diego She also studied at the Pacific Art League in Palo Alto, California. A few words about my approach to photography may be helpful before visiting the gallery.I am passionate about wildflowers and critters that inhabit the woodlands, particularly as seen through macro lens. There is beauty at every turn in the trail, creek or road we are following through life if we simply stop to took. However there is incredible beauty in nature that cannot be seen with the naked eye, but which can be seen readily through a macro lens. Moreover, nature is full of amazing patterns and brilliant colors. I am continually searching for unusual patterns and colors in the woodlands, at the beach or on crowded city streets. I am drawn to abstract patterns. For instance, the creek provides a marvelous mirror of nature. If the surface of the water is calm, one sees a precise reflection of the trees and sky. However, if the surface is disturbed by wind or flowing currents, the reflections become more and more abstract. I am fascinated with abstract patterns such as the reflections of autumn leaves in the creek,the continually changing kaleidoscope of water cascading over rocks, petals in the blossoms of wildflowers, or the ebb and flow of surf on the beach at sunset. After years of photographing wildflowers, it dawned on me that pictures of people, particularly children, enjoying the creek corridor would be far more persuasive arguments to convince decision makers about the need for preservation.
