HomeMy WebLinkAboutMinutes - 19810519 00'i i • a MINUTES MAY 19, 1981 The Orange County Board of Commissioners met in regular session on Tuesday, May 19, 1981, at 7:30 P.M. in the Commissioners ' Room, Orange County Courthouse, Hillsborough, North Carolina. Commissioners present: Commissioner Anne Barnes, Chair, and Com- missioners Norman Gustaveson, Norman Walker, and Richard Whitted. Commissioners Absent: Commissioner Don Willhoit. Agenda Item 1: Board modification of Agenda Commissioner Barnes announced the addition of three items: a re- Y quest for a joint meeting from the Town of Carrboro, A Proclamation for the Orange County Soil and Water Conservation District, and an executive session for the six months evaluation of the Clerk to the Board. Agenda Item 2: Audience Comments A. Matters on this agenda: Ms. Terrell wished to speak about her N°operty on Little River Drive; Commissioner Barnes told her she could speak during the Public Hearing on that subject. B. Matters not on this agenda: There were no comments from the audience about matters not on the agenda. ' Commissioner Barnes welcomed those members of both school systems to the meeting. Agenda Item 3: Public Hearing on Preliminary Assessment Roll for SR # 1593 Little River Drive & SR # 1878 New Hope Drive . s t The Board Chair announced this was the time and place of the Public rearing on the Preliminary Assessment Roll for the paving of SR # 1593 i and SR # 1878. Ms. Marilyn Terrell of Little River Drive said she was i unhappy with the work done; she clarified that part of a drainage ditch had been filled on her property when the paving was done and consequently j there was not proper drainage. The County Attorney clarified for Ms. Terrell that the County only puts up the money for the paving; the State does the work. The Board instructed Mr. Rees to try to work out a sat isfactory arrangement between Ms. Terrell and Mr. Watkins of the Department cf Transportation. Commissioners Barnes and Whitted explained the partici- - f OOE patory paving program to Ms. Terrell . There were no oth r e . persons to be heard at this Public Hearing. The Clerk told the Board of one correction to the Assessment Roll for SR # 1878 (also known as New Hope Drive) ; that is, Block & Lot 8A-B-10, listed on the Roll distributed to the Board as belonging to Dr. Mauzee and Rose Davis, actually belonged to Frank C. & Delores Pearson, Box 872, Hillsborough, North Carolina. Those persons had been notified of the assessment for that parcel . Commissioner Whitted moved to approve, at 7:52 P.M. , the Assessment Rolls for SR # 1593 and SR # 1878 with the adjustment noted in the above paragraph; Commissioner Walker seconded the motion. Vote: Ayes, 4; noes, 0. The Clerk was instructed to deliver the confirmed assessment rolls to the Tax Collector for Orange County. Agenda Item 5: Certificate of Mailing The Clerk to the Board filed a Certificate of Mailing for SR # 1593 and SR # 1878 (for a copy of this Certificate, see page/A4-P/of this book). Agenda Item 6: Presentation of the Orange County o Schools' Budget Request Mr. Oscar Compton told the Board he would defer to Dr. Simmons ar,d Mr. Rickman for the presentation of the Orange County School Board's budget. Dr. Mike Simmons gave the Board an overview of the budget ! saying the increase overall was about 13% with 176% of that increase being in the Capital request for Stanback School . Dr. Simmons, with the aid of Dr. Lunsford, noted the Federal and State cuts would severely impact : food service, special education and remedial programs. Mr. Rickman then took the Board on an line item by line item review of the budget request., -indicating changes. The Board uestioned what kinds of q pans were being made for the bud- ! geting of items affected by the State? Using the example of the salFry increase, Mr. Rickman noted what other schools were doing and said for Orange County they felt the 5% increment with the 5% retirement would cover them which ever way the State went on that question in October. The Board thanked the Orange County Schools ofl'.icials for their presentation. The Board then recessed for a short break. The Board reconvened with Commissioner Whitted presiding in the tem- porary absence of Commissioner Parnes. i 00S Agenda Item 7: CRT & Printer Commissioner Gustaveson moved approval of the Manager's recommendation to purchase 8 CRTs and one printer as detailed in a memo from the Data Processing Steering Committee (see page/a3-/a5of this book) ; Com- missioner Walker seconded the motion. Vote: Ayes, 4; noes, Agenda Item 8: Manager Recommends Relief of Hiring Freeze For: A. Temporary Clerk--Register of Deeds office: Commissioner Gustaveson moved approval of the Manager's recommendation to thaw this position; Com- missioner Walker seconded the motion. Vote: Ayes, 4; noes, 0. B. Temporary Clerk--Finance Office: Commissioner Walker moved approval of the Manager's recommendation to hire a temporary clerk in the Finance Office; Commissioner Gustaveson seconded the motion. Vote: Ayes, 4; noes, a 0. Commissioner Barnes resumed Chairing the Board. C. Intake Specialist--CETA: Commissioner Barnes moved to thaw all 100% CETA money; Commissioner Whitted seconded the motion. Vote: Ayes, 4; noes, 0. Agenda Item 9: Road Sign Grant-Notification Funds are not Available. The Planning Director told the Board that the grant previously a- t warded to the County for the erection of road signs would at best be de- layed for several months and might be cancelled altogether. Mr. Polatty listed several alternatives for the Board to consider in regard to this proble!i. Commissioner Gustaveson moved to approve Alternative tt 1 (that is to fill the current order, and use CETA crews to erect the road signs at all 630 intersections, retain the standards required by the State and hope the NCDOT will reimburse the grant funds) and to appropriate $10,110 from-Contingency; Commissioner Walker seconded the motion. Vote: Ayes, 4; noes, 0. Agenda Item 10: Sedgefield Subdivision Contract Mr. Goforth was present for this discussion. The Board asked that - "and the County" be removed from the Contract wherever it appears. Com- missioner Gustaveson moved approval of the contract as the Board requested it changed (for a copy of the approved contract, •see pagei3d485of this book) ; i fi U 1C� Commissioner Whitted seconded the motion. Vote: Ayes, 4; noes, 0. Agenda Item 11: Budget Amendments Commissioner Gustaveson moved approval of those amendments which the Board had already considered and approved in other action (this in- cludes those Departments already approved in action on Agenda Item 8; see page of this book for these budget amendments). Commissioner Whitted seconded the motion. Vote: Ayes, 4; noes, 0. Commissioner Gustaveson moved approval , seconded by Commissioner Gustaveson, of the transfer from County Commissioner--Personnel to County Commissioners--Operations. Vote: Ayes, 4; noes, 0. Commissioner Gustaveson moved approval , seconded by Commissioner Whitted of the Social Services budget amendments. Vote: Ayes , 4; noes, 0. Commissioner Whitted moved approval , seconded by Commissioner Gustaveson, of the Health/Animal Control budget amendment. Vote: Ayes, 4; noes, 0. Commissioner Whitted moved approval , seconded by Commissioner Gustaveson, of the Health/Maternal-Child budget amendments. Vote: Ayes, 4; noes, 0. Commissioner Whitted moved approval , seconded by Commissioner Barnes, of the Sheriff's Department budget amendments . Vote: Ayes, 4; noes, 0. 1 Co2,Ynissioner Whitted moved approval of the budget amendment for Emergency Management; Commissioner Gustaveson seconded the motion. Vote: Ayes, 4; noes, 0. Agenda Item 12: Request for the County to Mow Ballfields For the Hillsborough Youth Athletic League Mr. Keith Brooks, President of the Hillsborough Youth athletic League, f spoke in favor of this request. Mr. Wayne Weston, Recreation Director, said the County Recreation Department did provide some services for other communities, such as adult ball games, but those requesting the service paid a user's fee. Mr. Ron Phillips , Public Works Director, said he could probably provide the manpower to mow one field this close to the Public Works garage; his concern was that other areas might request and expect the same service and he is unable to provide that manpower. i � Oil Commissioner Walker moved to grant this request and to consider other requests on an individual basis; Commissioner Gustaveson seconded the motion. Staff expressed some concern about setting a precedent for this service, noting the location of the fields in other parts of the County and saying they did not have the manpower available to maintain other fields. Vote: Ayes, 2 (Commissioners Walker and Gustaveson) ; noes, 2 (Commissioners Barnes and Whitted) . Motion failed. Agenda Item 13: Joint Meeting Request with Town of Carrboro The Board, noting a very heavy meeting schedule between this date and the end of June, felt°:that perhaps it would not be able to schedule such a meeting until after the budget sessions. Commissioner Barnes moved, seconded by Commissioner Walker, to instruct the Clerk to contact the Town Clerk and convey the information that the Board of Commissioners feels that the subject of joint planning should be allocated more time that it is able to permit until after the budget sessions and to suggest a time in August or September for a joint meeting. Vote: Ayes, 4; noes, 0. t Agenda Item 14: Proclamation Commissioner Gustaveson moved, seconded by Commissioner Walker, to proclaim May 24-31, 1981, Soil Stewardship Week in Orange County. Vote: Ayes, 4; noes, 0. (A copy of this Proclamation is on page/3 1 of this book) . Agenda Item 15: Executive Session Commissioner Whitted moved to convene in executive session to con- sider personnel matters; Commissioner Barnes seconded the motion. Vote: A Ayes , 4; noes, 0. The Board then convened in executive session. Anne Barnes, Chair 9 Paulette Pridgen-Pond, Clerk t S i Q1 The Board of Commissioners for the County of Orange, North Carolina, met in regular session in the Commissioners ', Room in the Orange County Court- house in Hillsborough, North Carolina, the regular place of meeting, at 7:30 P.M. on May 19, 1981. Present: Commissioner Barnes, Chair, and Commissioners Gustaveson, Walker and Whitted. Absent: Commissioner Willhoit. The Chair announced that this was the hour and day fixed by the Board of Commissioners for the Public Hearing on the Preliminary Assessment Rolls filed with the Clerk of the Board of Commissioners of Orange County pursuant to the direction of the Orange County Board of Commissioners and pursuant to the Board's decision to finance the local share of the cost of paving North Carolina State Road # 1593, also known as Little River Drive in Little River Township, Orange County, North Carolina; and North Carolina State Road # 1878, also known as New Hope Drive in Chapel Hill Township, Orange County, North Carolina. The Chair also--announced that the Board of Commissioners would immediately hear anyone who might wish to be heard on the Preliminary Assessment Rolls. Various persons appeared and were recognized and heard on the said Preliminary Assessment Rolls. Those recognized and the essence of their comments were recorded by the Clerk of the Board of Commissioners in the minutes of the Board. Thereupon, upon Motion of Commissioner Whitted, seconded by Commissioner Walker and carried, the Preliminary Assessment Rolls for the financing by Orange County of the local share of the cost of paving North Carolina State Road tt 1593, aleo known as Little River Drive in Little River Township, Orange County, North Carolina; and, North Carolina State Road # 1878, also known as, New Hope Drive in Chapel Hill Township, Orange County, North Carolina, was confirmed in toto, and the Clerk to the Board was directed to enter into the minutes of the Board the confinnation date, hour, and minutes, saving and except the following ad- justment: The ownership of Parcel 8A-B-10 on State Road # 1878, also known as New dope Drive, was changed to reflect the fact that it is owned by Frank C & Delores Pearson, Box 782, Hillsborough , North Carolina, and not to Dr. Mauzee and Rose Davis as shown on the lists furnished to the Board. 01 Thereupon, the Clerk of the Board entered the confirmation effect- tive 7:52 o'clock P.M. , the 19th day of May, 1981. Upon direction of the Board, the Clerk to the Board was directed to deliver a copy of the confirmed Assessment Roll to the Orange County Tax Collector. Upon direction of the Board the Orange County Tax Collector was directed to publish once, a Notice, no earlier than 20 days from the date of confirmation as herein set forth, that the Assessment Roll for the financing j by Orange County of the local share of the cost of paving North Carolina State t Road # 1593, also known as Little River Drive in Little River Township and North Carolina State Road # 1878, also known as New Hope Drive in Chapel Hill i Township, Orange County, North Carolina,' has been confirmed and that assess y ments may be paid without interest at any time before the expiration of 30 days from the date that the Notice is published and that if not paid within that time, all installments thereof shall bear interest in amount equal to the interest on past due ad valorem taxes in Orange County. The Chair directed 1 that said Notice shall be published in the News of Orange County, the Chapel q Hill- Newspaper and The Durham Morning Herald Said Notice shall be in sub- stantially the following form: fi NOTICE OF CONFIRMATION OF ASSESSMENT ROLL FOR THE FINANCING BY ORANGE COUNTY OF THE LOCAL SHARE OF THE COSTS OF PAVING NORTH CAROLINA STATE ROAD # 1593, ALSO KNOWN AS LITTLE RIVER DRIVE, LOCATED IN LITTLE RIVER TOWNSHIP, AND NORTH CAROLINA STATE ROAD # 1878, ALSO KNOWN AS. NEW HOPE DRIVE, LOCATED IN CHAPEL HILL TOWNSHIP, ORANGE COUNTY, NORTH CAROLINA. Notice is hereby given that pursuant to Article 9 of Chapter 153A of the General Statutes of North CArolina, the Commissioners for Orange County have confirmed the Assessment Roll for the financing by Orange County of the local share of the cost of paving North Carolina State Road # 1593,' also known as Little River Drive, located in Little River Township and North Carolina State Road # 1878, also known as New [lope Drive, located in Chapel Hill Township, Orange County, North Carolina, in toto, saving and excepting an adjustment made to land owned by Frank & Delores Pearson. The specifics of the adjustment made are in the minutes of the Orange County Board of Com- missioners for its meeting on May 19, 1981. The confirmed Assessment Roll reflects the adjustment. Pursuant thereto: 014 1. The Board of Commissioners of the County of Orange, North Carolina, met in regular session in the Courthouse in Hillsborough, North Carolina, at 7:30 P.M. on May 19, 1981. 2. The Chair announced that this was the hour and day fixed by the Board of Commissioners for the Public Hearing on the Preliminary Assess- ment Roll pursuant to the Board's decision to finance the local share of the cost of paving North Carolina State Road # 1593, also known as Little River Drive, located in Little River Township, and North Carolina State Road # 1878, also known as New Hope Drive, located in Chapel Hill Township, Orange County, North Carolina. 3. All persons attending and wishing to be heard were recognized by the Chair and were heard. 4. The Board confirmed the Assessment Roll and directed its delivery to the Orange County Tax Collector. 5. The Assessments confirmed by the Board may be paid without in- terest at any time before the expiration of 30 days from the date of the publication of this Notice. If not paid within this time, all installments thereof shall bear interest at the rate set for past due Orange County ad valorem taxes. John T.
