PURPOSE: To consider establishing a policy with respect to the Flexible Development regulations
that Concept Plan applications submitted by June 28, 1996 may be considered under the
application approval procedures in effect on that date.
BACKGROUND: The Flexible Development regulations adopted on May i included an effective date of
July 1, 1996. The Flexible Development guidelines require submittal of two concept
plans, and require that a public information meeting be held.
Completion of the Open Space Design Guidebook has been a high-priority work item
since adoption of the Flexible Development regulations, and will be included on the
June 26 Commissioners' agenda. The Planning Staff is preparing to hold training
sessions for potential applicants in early July. Completion of the Design Guidebook
must occur before the training sessions.
Concept Plans submitted on or before June 28 must be presented to the Planning Board
at its July meeting to meet timeline requirements. However, submittal requirements
change substantially on July 1. The magnitude of those changes would result in
applications being rejected on July 1 because they would not meet requirements of the
Flexible Development regulations.
It is the policy of the Board of Commissioners to allow major subdivisions which
have received Preliminary Plan approval to remain subject to the regulations in effect
at the time of approval, even if regulations change before the plat is recorded.
Because the Flexible Development requirements affect Concept Plan approval

procedures, this policy is near impossible to implement and creates a hardship with
respect to otherwise timely applications. It is recommended that the Board of
Commissioners endorse the policy that Concept Plans submitted by June 28, 1996 may
be considered under existing approval procedures. Concept Plans submitted after that
date would be subject to Flexible Development procedures. Thus the August
Planning Board meeting would be the first meeting at which flexible development
proposals would be considered.
RECOMMENDATION: The Administration recommends that the Board of Commissioners endorse the
policy that Concept Plans submitted by June 28, 1996 be subject to the
application approval procedures in effect on that date.
