BACKGROUND: A public hearing was held May 28 regarding a proposed amendment to consider an increase in the current schedule of impact fees. Specifically, Section 3, School Impact Fees Imposed on New Residential Structures, is proposed for amendment to increase the impact fee in the Chapel Hill-Carrboro School District from $1,500 to no more than$3,000. This was the recommendation of the Chapel Hill-Carrboro Board of Education. There was no recommendation for increase from the Orange County Board of Education, and therefore no change to the impact fee in the Orange County School District is proposed. 2 The proposed change is based on revisions to the Educational Facilities Impact Fee Technical Report. The revisions to the Technical Report include new student generation rates from an August 1995 study, the establishment of service standards for elementary and middle school construction, new cost data for elementary, middle and high schools, and updated needs assessments from the school districts. These revisions show justification for an impact fee of$11,593 for new housing units in the Chapel Hill-Carrboro school district. STAFF PRIORITY RECOMMENDATION:_2�_High Middle Low PUBLIC HEARING DATE: May 28, 1996 PURPOSE OF AMENDMENT: To amend the Educational Facilities Impact Fee Ordinance to consider increasing the current schedule of impact fees. IMPACTS/ISSUES: The proposed amendment is for the purpose of considering an increase in the current schedule of impact fees. Specifically, Section 3, School Impact Fees Imposed on New Residential Structures, is proposed for amendment to increase the impact fee in the Chapel Hill-Carrboro School District from $1,500 to no more than $3,000. The change is based on a recalculation of the fees in the Educational Facilities Impact Fee Technical Report and reflects new demographic data concerning students per household as well as the recommendations of the School Facilities Construction Standards Work Group. No increase in the impact fee in the Orange County School District is proposed. EXISTING/PROPOSED ORDINANCE/PLAN PROVISIONS: Applicable sections of the ordinance are shown below. SECTION 3-SCHOOL IMPACT FEES IMPOSED ON NEW RESIDENTL4L DWELLING UNITS In addition to all other charges prescribed by ordinance or resolution now or hereafter in effect, there shall be public school impact fees charged to new residential dwelling units located within Orange County, and within the municipalities and their extraterritorial planning jurisdictions located within Orange County. No person may occupy any new residential dwelling unit until all applicable public school impact fees contained in the following schedule have been paid in full. No certificate of occupancy or other type of occupancy permit shall be issued for any new residential dwelling unit until the public school impact fees hereby required have been paid in full. Payment of such fees shall not relieve the feepayer from the obligation to comply with applicable land development regulations of Orange County or the municipalities located within Orange County. 1 Schedule of Public School Impact Fees The amount of the public school impact fee will be$750 per residential dwelling unit in the Orange County School District.
