PURPOSE: Consideration of the Preliminary Plan for La Mesa Subdivision, Phase III.
BACKGROUND: The property is located in the northeast corner of the county south of Bacon Road (SR 153 1)
between NC Highway 57 and the Person County line. It is currently zoned Agricultural
Residential and Flat River Protected Watershed.In the Land Use Element of the Comprehensive
Plan it is designated as Agricultural Residential and Water Supply Watershed.
The property was part of a farm over twenty years ago. Former fields are now covered by typical
early successional growth. Slopes are gentle except along the intermittent stream which flows
generally southeast where limited slopes approach 33 percent.The soils are typical for Orange
County with moderate limitations for septic systems,dwellings, and road construction.
Phase I of La Mesa contained eight(8)lots approved in 1989. The original preliminary approval
expired in 1990.A new Concept Plan was approved in 1995.Phase II was approved by the Board
of Commissioners in August 1996 for 21 lots and new public roads on 45 acres.The total
acreage of Phase III is approximately 23 acres. Fourteen(14)new residential lots are proposed in
Phase III. Lot sizes are between 0.98 and 2.67 acres.Each lot will have an individual well and
septic system.
In 1994 the average daily traffic count for this part of Bacon Road was 70 trips per day.Access
to Bacon Road will be provided via La Mesa Lane, a new public cul de sac to be built to State

standards as-part of Phase II. Two public culs de sac will be extended from La Mesa Lane to
serve the new lots in Phase III. Lot 31 will have direct access to La Mesa Lane.
On November 6,the Planning Board recommended approval of La Mesa,Phase III,with a
unanimous vote.
RECOMMENDATION: The Administration recommends approval of the Preliminary Plan for La Mesa,Phase III,as per
the Planning Board recommendation.

OF THE
ORANGE COUNTY BOARD OF COUNTY COMMISSIONERS

The Board of County Commissioners hereby approves La Mesa Subdivision, Phase III,
Preliminary Plat, dated August 1996 and containing 14 lots, subject to the fulfillment of
requirements specified herein.
All roads shall be irrevocably dedicated to the general public and be constructed to standards
of the North Carolina Department of Transportation. The approval of this resolution
authorizes and directs the Orange County Manager to accept for Orange County and on behalf
of the public generally, the offer of dedication of Hacienda Way and Cortez Court. This
acceptance by Orange County of the dedication to the general public of Hacienda Way and
Cortez Court shall be without maintenance responsibility. These roads shall be maintained by
the owner/applicant until such time as they are accepted for maintenance by the North Carolina
Department of Transportation or some other governmental body. Before the Final Plat of La
Mesa, Phase III can be recorded:
A. Sewage Disposal
1. Each residential lot shall contain an adequate area for sewage disposal and
repair area, approved by the Orange County Division of Environmental Health.
2. Disclosure that the septic system location may restrict the size and location of
improvements shall be included in a document describing development
restrictions to be recorded concurrently with the Final Plat. The document shall
also disclose that information regarding the tentative location of septic systems
is available from the Orange County Health Department, Division of
Environmental Health.
B. Roads and Access
1. Hacienda Way and Cortez Court shall be constructed to standards of the North
Carolina Department of Transportation, within 60-foot rights-of-way, and the
construction shall be inspected and approved by NCDOT.

A letter of credit or escrow agreement shall be submitted to secure construction
of Hacienda Way and Cortez Court to the standards of the North Carolina
Department of Transportation. An estimate of the construction cost must be
prepared by a certified/licensed engineer or grading contractor and submitted to
the Planning and Inspections Department. The financial guarantee must reflect
110% of that estimate and be issued by an accredited financial institution
licensed to do business in North Carolina.
The document describing development restrictions to be recorded with the Final
Plat shall state that the financial guarantee will not be released until the road
construction has been inspected and approved by NCDOT.
2. An erosion control plan for construction of the roads shall be submitted by the
applicant for review and approval by the Orange County Erosion Control
Division.
3. 10' by 70' sight triangles shall be shown at each road intersection.
4. All lots shall access onto the new subdivision roads. This restriction shall be
stated in a document describing development restrictions and requirements to be
prepared by Planning Staff and recorded concurrently with the Final Plat.
5. Approved street name signs shall be erected at the intersection of streets as
required in Section IV-B-3-c-12 of the Orange County Subdivision Regulations.
Evidence shall be submitted by the applicant that the sign is in place or a copy
of the receipt for purchase of the sign shall be submitted to the Planning
Department.
C. Land Use Buffers and Landscaping
1. Provisions for protection of existing trees as shown on the approved landscape
plan shall be included in a document describing development restrictions and
requirements to be prepared by Planning Staff and recorded concurrently with
the Final Plat.
D. Drainage
1. A 30-foot drainage easement shall be provided as shown on lot 31. Locate
additional drainage easements as required following review and approval of the
Erosion Control Plan.
2. Impervious surface data, as pursuant to Article 6.23 of the Zoning Ordinance
shall be included in a document describing development restrictions and
requirements to be prepared by Planning Staff and recorded concurrently with
the Final Plat.
3. A stream buffer shall be provided as required by Article 6.23.7 of the Zoning
Ordinance along the creek located on lots 30, 31, 32, 34, 35, and 40. The

buffer shall be measured in an arc from the beginning of the stream on lots 30
and 31. The width of the buffer shall be stated on the face of the plat.
Development restrictions within the buffer shall be specified in a document
describing development restrictions and requirements to be prepared by
Planning Staff and recorded concurrently with the Final Plat.
E. Parkland
1. Cash in the amount of$5915 ($455 per lot) shall be paid to Orange County as
payment in lieu of parkland dedication.
F. Miscellaneous
1. The Final Plat shall contain a title block and vicinity map in accordance with
Section V-D-2 and V-D-3 of the Orange County Subdivision Regulations.
2. The following easements shall be shown on the plat:
a. 30-foot drainage easement on lot 31.
3. A setback of 40 feet shall be maintained as measured from the edge of
rights-of-way of La Mesa Lane, Hacienda Way, and Cortez Court. Side yards
shall be a minimum of 20 feet, and rear yards a minimum of 20 feet. These
setback requirements shall be stated on the plat, and in a document describing
development restrictions and requirements to be prepared by Planning Staff and
recorded concurrently with the Final Plat.
G. Certifications
1. A Certificate of Survey and Accuracy signed by a registered Land Surveyor
shall be notarized on the face of the Final Plat.
2. A Certificate of Declaration and Maintenance in the form provided in Section
V-D-6-b of the Orange County Subdivision Regulations signed by the
landowner and developer shall be on the face of the plat and included in a
document describing development restrictions to be recorded concurrently with
the Final Plat.
3. The Department of Environmental Health shall certify that all residential lots
contain sufficient area for sewage disposal and repair.
4. The North Carolina Department of Transportation shall certify that Hacienda
Way and Cortez Court have been constructed to State standards or that
construction plans have been approved.
5. A Certificate of Approval signed by the Orange County Planning and
Inspections Department.

2. One full size copy of an Orange County Tax map (with tax parcels,involved clearly marked in
pencil).
3. Where municipal or OWASA sewer is not available, a copy of the Preliminary Plat indicating
Health Department soils analysis approval/denial for each lot shown thereon.
4. Where a private road is proposed a written statement by the applicant or his/her authorized
representative which sets forth the justification for a private road (see Section IV-8-3-d-1 of the
Orange County Subdivision Regulations). ,
5. Auxiliary documents, in draft form, prepared in accordance with Section Vl of.this Ordinance
which assure completion and/or maintenance of improvements required by this Ordinance.
Such documents may include, but not be limited to, a private road maintenance egraanent, and
articles of incorporation and restrictive covenants pertaining to a homeowners association.
These documents may be required as necessary as evidence that the ordinance requirements
are being-met.

concerned with the amount of involvement of local government it would take to
address all of these concerns. She felt the buyer must take some responsibility.
Price noted that she felt there had to be more that the County could do to address
such concerns and the problem seemed to be with realtors and attorneys and the
burden should not be placed on the Planning Department to review all of these
issues.
Walters asked if the Board of Commissioners could require that the Register of
Deeds notify the Planning Department prior to recording any deeds. Willis
responded that she did not know the State laws regarding the Register of Deeds to
know whether such a restriction could be placed on the Register of Deeds office.
Brooks stated that she felt buyers and sellers have some responsibility,but,did not
feel it was the responsibility of County employees to assure that every transaction
was handled properly.
Willis noted that there had been issues regarding this property that were discussed at
least two years ago,so,the applicant has been aware of other problems. Willis
responded that she would be bringing a proposal to the next meeting regarding
training with the Institute of Government the issue of responsibility could be one that
the Planning Board would like to have included in that training.
b. Preliminary Plans
(� (1) La Mesa Phase III
L..� (Little River Township- 14 Lots)
Presentation by Emily Cameron.
The property is located in the northeast comer of the county south of Bacon Road
(SR 153 1)between NC Highway 57 and the Person County line. It is currently
zoned Agricultural Residential and Flat River Protected Watershed. In the Land Use
Element of the Comprehensive Plan it is designated as Agricultural Residential and
Water Supply Watershed.
The property was part of a farm over twenty years ago. Former fields are now
covered by typical early successional growth. Slopes are gentle except along the
intermittent stream which flows generally southeast where limited slopes approach
33 percent. The soils are typical for Orange County with moderate limitations for
septic systems,dwellings,and road construction.
Phase I of La Mesa contained eight(8)lots approved in 1989. The original
preliminary approval expired in 1990.A new Concept Plan was approved in 1995.
Phase 11 was approved by the Board of Commissioners in August 1996 for 21 lots
and new public roads on 45 acres. Fourteen(14)new residential lots are proposed in
Phase III. The total acreage of Phase III is approximately 23 acres. Proposed lot
sizes are between 0.98 and 2.67 acres. Each lot will have an individual well and
septic system.
In 1994 the average daily traffic count for this part of Bacon Road was 70 trips per
day. Access to Bacon Road will be provided via La Mesa Lane,a new public cul de
sac to be built to State standards as part of Phase II. Two public culs de sac will be

' extended from La Mesa Lane to serve the new lots in Phase III. Lot 31 will have
direct access to La Mesa Lane.
The Planning Staff recommends approval of the Preliminary Plan for La Mesa,
Phase III,with public roads built to State standards and subject to the conditions
contained in the Resolution of Approval(copy an attachment to these minutes on
pages ),
Katz asked for clarification regarding item 134 in the resolution that all lots shall
access onto the new subdivision roads noting that this is inconsistent with lot#31.
Cameron responded that La Mesa Lane is considered a subdivision road and the
intent is that there be no direct exterior access to roads outside the subdivision.
Katz continued,asking about the setback requirements under item F3. Cameron
responded that they are the standard setbacks in the Zoning Ordinance and are
required to be noted on the final plat. This makes it clear that for comer lots,the
front setback applies on both sides adjacent to road rights-of-way.
MOTION: Allison moved approval as recommended by the Planning Staff. Seconded by
Walters.
VOTE: Unanimous.

This item is to consider a citizen request to create a new use category called
"Temporary Events"which would be allowed by right in commercial zoning
districts,and with approval of a class B Special Use Permit in residential districts.
The proposed amendment creates a commercial/service use category called
"Temporary Events". Examples of this kind of use ate commercial craft shows,
carnivals,festivals,concerts,medical or veterinary clinics,and outdoor social events
hosted by a business such as a restaurant or caterer.
Temporary events such as those described would not be considered a principal use
when they take place at a site normally associated with the activity. For example,a
festival held at a park,a reception or picnic held on church grounds,or a veterinary
clinic conducted outside an animal hospital,would be considered accessory uses to
the principal use on the site and would not require approval of a Special Use Permit.
