To establish a date and time for a required public hearing on the planned Southern Village Elementary School. BACKGROUND: At the October 15 regular meeting,the Board of Commissioners approved the establishment of a November 19 public hearing on the financing of the planned new elementary school in the Southern Village development, which is slated for a Summer 1999 opening. As part of the proposed financing approach for this new school,the County must by law acquire title to the property on which the school will be sited. A public hearing on this property acquisition is also required under North Carolina statutes. The County Attorney recommends that the Board conduct a dual-purpose public hearing at 7:30pm on November 19 that will accomplish both purposes - namely,to consider whether the Board should approve 1) a proposed installment financing agreement and 2)the acquisition of the site of the elementary school project from the Chapel Hill-Carrboro Board of Education. RECOMMENDATION(S): The Manager recommends that the Board approve the actions outlined in the attached proceedings prepared by the County Attorney. 2 i A regular meeting of the Board of Commissioners for the County of Orange, North Carolina, was held in the Northern Orange County Recreation Center, in Cedar Grove, North Carolina at 7:30 P.M. on November 4, 1996. Present: Absent: On motion duly made, seconded and carried, the Board of Commissioners fixed 7:30 P.M. on November 19, 1996, at the OWASA Operations Center, 400 Jones Ferry Road, Carrboro, North Carolina, as the hour, day and place for a public hearing for the purpose of ( 1) considering whether the Board of Commissioners should approve a proposed installment payment agreement and certain related documents under which the County would obtain financing pursuant to G.S. S 160A-20, as amended, for the acquisition, construction and equipping of a project consisting of a new elementary school for the Chapel Hill-Carrboro City Schools, as described in the notice of such public hearing, a copy of which has been presented to the Board of Commissioners, and under which the County would secure the repayment by it of monies advanced pursuant to such installment payment agreement by granting a security interest in the elementary school project and certain related property, and (2) considering whether the County should acquire the site for the elementary school project from 3 the Chapel Hill-Carrboro City Schools to facilitate the financing. Thereupon the Board of Commissioners directed the Clerk to the Board of Commissioners to publish such notice as required by G.S. S 160A-20, as amended, once in The News of Orange County and The Chapel Hill Herald not later than the tenth day before the date of such public hearing. I, Beverly A. Clerk to the Board of Commissioners lsg-6 southvil.doc 4 NOTICE OF PUBLIC HEARING CONCERNING A PROPOSED INSTAL T.trM" PAYNENT AGREEISBNT OF THE COUNTY OF ORANGE, NORTH CAROLINA TO FINANCE THE CONSTRUCTION AND EQUIPPING OF AN ELElGNTARY SCHOOL LOCATED IN THE CHAPEL HILL- CARRBORO SCHOOL DISTRICT AND THE ACQUISITION OF PROPERTY FOR SUCH FINANCING. NOTICE IS HEREBY GIVEN of a public hearing to be held at 7:30 P.M. on November 19, 1996, at the OWASA Operations Center, 400 Jones Ferry Road, Carrboro, North Carolina, for the purpose of considering whether the Board of Commissioners for the County of Orange, North Carolina should approve a proposed installment payment agreement and certain related documents under which the County would obtain financing for the acquisition, construction and equipping of a new elementary school located in the Chapel Hill-Carrboro City School District, including parking area, sidewalks, and other appurtenant facilities, landscaping and other related site work. Under the proposed installment payment agreement and related documents the County would secure the repayment by it of monies advanced pursuant to such installment payment agreement by granting a security interest in the elementary school project and certain related property, including the site of the elementary school project. At the public hearing the Board of Commissioners will also consider whether the County should acquire the site of the elementary school project from the Chapel Hill-Carrboro City Schools to facilitate the financing.
