BACKGROUND: The property is located in the northeast corner of the county south of Bacon Road(SR 153 1) between NC Highway 57 and the Person County line. The total acreage of the tract is 72.65 acres. It is currently zoned Agricultural Residential and Flat River Protected Watershed. In the Land Use Element of the Comprehensive Plan it is designated as Agricultural Residential and Water Supply Watershed. The property was part of a farm over twenty years ago.Former fields are now covered by typical early successional growth. Slopes are gentle except along two intermittent streams(one is not shown in Phase III) which flow generally east and southeast where limited slopes approach twenty percent(20%). The soils are typical for Orange County with moderate limitations for _septic systems,dwellings, and road construction. A Preliminary Plan for La Mesa was approved by the Board of Commissioners in August 1989. The Final Plat for Phase I containing eight(8) lots was approved in December of that year. Approval of the Preliminary Plan expired one year later because susequent final plats were not submitted.. The applicant is now seeking approval of Phase II which contains 45.38 acres to be divided into twenty(20)new residential lots.Lot sizes are between 0.98 and 6.2 acres.Each lot will have an individual well and septic system.Lot 16 does not have a site approved by Environmental Health 1 2 s for a septic system;therefore,before the Final Plat is prepared,the lot must either be approved for on-site sewage disposal,combined with adjacent lots, or retained as open space and restricted for development. In 1994 the average daily traffic count for this part of Bacon Road was 70 trips per day. Access to Bacon Road will be provided via La Mesa Lane, a new public cul de sac to be built to State standards. Two other public rights-of-way are reserved to serve future development in Phase III. A stubout was required as a condition of approval in 1989 and 1995 between lots 14 and 15 extending to the western boundary.A road connection would be made in the event adjacent property is developed in the future. On August 7, 1996,the Planning Board voted unanimously to approve the Preliminary Plan for La Mesa,Phase II,with public roads built to State standards and the conditions contained in the attached Resolution of Approval. RECONIlVIENDATION: The Administration recommends approval of the Preliminary Plan for La Mesa, Phase II, as per the Planning Board recommendation. 3 RESOLUTION OF THE ORANGE COUNTY BOARD OF COUNTY COMMISSIONERS Date August 20, 1996 Name of Subdivision La Mesa Phase H Owner/Applicant Bob Pecaut The Board of County Commissioners hereby approves La Mesa Subdivision, Phase II, Preliminary Plat, dated June 1996 and containing 21 lots, subject to the fulfillment of requirements specified herein. All roads shall be irrevocably dedicated to the general public and be constructed to standards of the North Carolina Department of Transportation. The approval of this resolution authorizes and directs the Orange County Manager to accept for Orange County and on behalf of the public generally, the offer of dedication of La Mesa Lane and the rights-of-way for Hacienda Way, Cortez Court, and the unnamed stubout to the western boundary. This acceptance by Orange County of the dedication to the general public of La Mesa Lane and the rights-of-way for Hacienda Way, Cortez Court, and the unnamed stubout to the western boundary shall be without maintenance responsibility. These roads shall be maintained by the owner/applicant until such time as they are accepted for maintenance by the North Carolina Department of Transportation or some other governmental body. Before the Final Plat of La Mesa Phase H can be recorded: A. Sewage Disposal 1. Each residential lot shall contain an adequate area for sewage disposal and repair area, approved by the Orange County Division of Environmental Health. Lot 16 shall be combined with adjacent lots or retained as open space, unless a site for sewage disposal and repair is approved by OCHD. If no site is identified, the lot shall be labeled as having restricted development potential and so noted in the Declaration of Development Restrictions and Requirements - -prepared by-the Planning Staff and recorded concurrently with the Final Plat. 2. Disclosure that the septic system location may restrict the size and location of improvements shall be included in a document describing development restrictions to be recorded concurrently with the Final Plat. The document shall also disclose that information regarding the tentative location of septic systems is available from the Orange County Health Department, Division of Environmental Health. 4 Y B. Roads and Access 1. La Mesa Lane shall be constructed to standards of the North Carolina Department of Transportation, within a 60-foot right-of-way, and the construction shall be inspected and approved by NCDOT. OR A letter of credit, escrow agreement, or bond shall be submitted to secure construction of La Mesa Lane to the standards of the North Carolina Department of Transportation. An estimate of the construction cost must be prepared by a certified/licensed engineer or grading contractor and submitted to the Planning and Inspections Department. The financial guarantee must reflect 110% of that estimate and be issued by an accredited financial institution licensed to do business in North Carolina. The document describing development restrictions to be recorded with the Final Plat shall state that the financial guarantee will not be released until the road construction has been inspected and approved by NCDOT. 2. An erosion control plan for construction of the road shall be submitted by the applicant for review and approval by the Orange County Erosion Control Division. 3. 10' by 70' sight triangles shall be shown at each road intersection. 4. All lots shall access onto the new subdivision roads. This restriction shall be stated in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. 5. Approved street name signs shall be erected at the intersection of streets as required in Section IV-B-3-c-12 of the Orange County Subdivision Regulations. Evidence shall be submitted by the applicant that the sign is in place or a copy of the receipt for purchase of the sign shall be submitted to the Planning Department. 6. Provide a deed to Orange County for the right-of-way stubout to the western - boundary between lots 14 and C. Land Use Buffers and Landscaping 1. Provisions for protection of existing trees as shown on the approved landscape plan shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. 5 D. Drainage 1. Locate drainage easements as required following review and approval of the Erosion Control Plan. 2. Impervious surface data, as pursuant to Article 6.23 of the Zoning Ordinance shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. 3. A stream buffer shall be provided as required by Article 6.23.7 of the Zoning Ordinance along the creek located on lots 18 and 19. The width of the buffer shall be stated on the face of the plat. Development restrictions within the buffer shall be specified in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. E. Parkland 1. Cash in the amount of$9555 ($455 per lot) shall be paid to Orange County as payment in lieu of parkland dedication. F. Miscellaneous 1. The Final Plat shall contain a title block and vicinity map in accordance with Section V-D-2 and V-D-3 of the Orange County Subdivision Regulations. 2. The following easements shall be shown on the plat: a. existing drainage easement on lot 9. 3. A setback of 40 feet shall be maintained as measured from the edge of right-of-way of La Mesa Lane. Side yards shall be a minimum of 20 feet, and rear yards a minimum of 20 feet. These setback requirements shall be stated on the plat, and in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. G. Certifications 1. A Certificate of Survey and Accuracy signed by a registered Land Surveyor shall be notarized on the face of the Final Plat. 2. A Certificate of Declaration and Maintenance in the form provided in Section V-D-6-b of the Orange County Subdivision Regulations signed by the landowner and developer shall be on the face of the plat and included in a document describing development restrictions to be recorded concurrently with the Final Plat. r- 6 Y 3. The Department of Environmental Health shall certify that all residential lots contain sufficient area for sewage disposal and repair. 4. The North Carolina Department of Transportation shall certify that La Mesa Lane has been constructed to State standards or that construction plans have been approved. 5. The lots are accessed by La Mesa Lane (public) which extends from the south side of Bacon Road. Phase I, approved by the Board of Commissioners in 1989, contains eight lots which front on Bacon Road. The current zoning is AR-Agricultural Residential. The average lot size is approximately 2.2 acres. Lots will be served by individual wells and septic systems. Project build-out is estimated at three years. Housing units will be constructed, beginning in 1997, with completion of the project scheduled for 1999. Units will consist of detached single-family homes, and the applicant estimates the average sales price to be$90,000 including the lot. METHODOLOGY Fiscal impact analysis is a projection of the direct, current, public costs and revenues associated with residential and non residential growth in the jurisdiction in which the growth is taking place. Fiscal impact analysis considers only direct impact in that it projects only the primary costs that will be incurred and the immediate revenues that will be generated. It calculates the financial effect of a planned development or new subdivision by considering the current costs and revenues such a development would generate if it were completed and occupied today. Fiscal impact analysis does not consider the private costs of public action. It is concerned only with public(governmental)costs and revenues. The method used in preparing the fiscal impact analysis is the Service Standard Approach. While only gross expenditures by service category are derived from the Per Capita Method, the Service Standard method determines the total number of additional employees by service function that will be required as a result of growth This method employs average county government costs per person, average school costs per pupil, an employee to population ratio, and average operating expenses per employee for each service category and school district. The number of new employees are projected and multiplied times the average operating expenses (includes personnel, operating and capital costs) per employee. These average costs are then weighed against per capita and per pupil revenues to project the total net fiscal impact of the development. The property is located in the northeast comer of the county south of Bacon Road (SR 153 1)between NC Highway 57 and the Person County line. The total acreage of the tract is 72.65 acres. It is currently zoned Agricultural Residential and Flat River Protected Watershed. In the Land Use Element of the comprehensive Plan it is designated as Agricultural Residential and Water Supply Watershed. The property was part of a farm over twenty years ago.Former fields are now covered by typical early successional growth. Slopes are gentle except along two intermittent streams(one is not show in Phase III)which flow generally east and southeast where limited slopes approach twenty percent(20%).The soils are typical for Orange County with moderate limitations for septic systems,dwellings,and road construction. The Preliminary Plan for La Mesa was approved by the Board of Commissioners in August 1989. The Final Plat for Phase I containing eight(8)lots was approved in December of that year. Approval of the Preliminary Plan expired one year later because subsequent final plats were not submitted. To reactivate the subdivision,the applicants submitted a Concept Plan which was approved by the Planning Board on August 20, 1995. The Concept Plan was almost identical to the 1989 Preliminary Plan featuring public roads and 38 lots ranging in size from one to five acres. Phase II contains 45.38 acres which the applicant proposes to divide into twenty (20)new residential lots.Lot sizes are between 0.98 and 6.2 acres.Each lot will have an individual well and septic system. Lot 16 does not have a site approved by Environmental Health for a septic system;therefore,before the Final Plat is prepared,the lot must either be approved for on-site sewage disposal,combined with adjacent lots,or retained as open space and restricted for development. In 1994 the average daily traffic count for this part of Bacon Road was 70 trips per day. Access to Bacon Road will be provided via La Mesa Lane,a new public cul de sac to be built to State standards. Two other public rights-of-way are reserved to serve future development in Phase III. A stubout was required as a condition of approval in 1989 and 1995 between lots 14 and 15 extending to the western boundary. A road connection would be made in the event adjacent property is developed in the future. . The Planning Staff recommends approval of the Preliminary Plan for La Mesa, Phase H,with public roads built to State standards and the conditions contained in the Resolution of Approval(an attachment to these minutes on pages ). Hoecke asked for more information on lot 16. Cameron responded that it some clearing of dense vegetation must be done to obtain access for checking. Brooks asked if the Planning Board could decide the use of lot 16 if no perc site is found. Cameron responded a significant design change would require reconsideration.. 1 © U U LTL1 19 Price asked when phases III and IV would be submitted. Cameron responded that Phase III will be the 23 acres that has already been submitted as a concept plan which is about to expire. If it does expire, it will come in later under the new provisions. Price continued expressing concern with the road system. Cameron responded that on the concept plan there were two cul-de-sacs in Phase III. Once all of the soils work is completed,densities may change and the roads may not be built as shown on the concept plan. Price was concerned with the amount of traffic being dumped onto Bacon Road. VOTE: Unanimous. AGENDA ITEM#9: MATTERS HEARD AT PUBLIC HEARING 5/28/96 a. Zoning Ordinance Teat Amendments (1) Telecommunication Towers Presentation by Mary Willis. Concern with the increasing number of telecommunication towers has been raised locally and nationwide by citizens,advisory boards and governing boards in recent years. At the November 27, 1995 public hearing,the Orange County Board of Commissioners and Planning Board received citizen comments on a proposed amendment to Special Use Permit provisions relating to telecommunication towers. The speakers at the public hearing included five industry representatives and one Orange County resident. On January 18, 1996,the Ordinance Review Committee,as well as another interested Planning Board member and a member of the Board of Adjustment met with the telecommunication providers who spoke at the public hearing. The purpose of the meeting was for the Committee to gain an understanding of issues and technical concerns raised at the public hearing and to consider modifications to the proposal which would address those issues while maintaining the purpose and intent of the proposed amendment. One of the major issues raised at the public hearing concerned the potential health effects of electro-magnetic radiation. The telecommunications Act of 1996(Section 704(Bxiv)and the Federal Communications Commission New National Wireless Tower Siting Policies (Section 1.1307(b))prohibit denial of a cellular telephone facility on the basis of health effects if it meets applicable standards issued by the American National Standards Institute(ANSI). Studies conducted in 1994 and 1995 for a 360 tower located at 515 South Greensboro Street,are on file in the Planning Department.
