CKGROUND: The County has leased space for the Health clinic facility at Carr Mill Mall since 1979. rt of the clinic will be relocated to the Southern Human Services Center(SHS)upon the completion that facility. The action taken by the Board will extend the Carr Mill lease through June 30, 1998, a which time a new lease will be executed for space allocated for the Dental Clinic.As the Board may r all, budgetary constraints precluded the inclusion of the Dental Clinic in the SHS. Although the bids for SHS received in March significantly exceeded the budgeted amount, negotiations are ongoing with the low bidder to determine what options may be available to the County. It is anticipated that the SHS completion date will closely coincide with the expiration of this lease renewal. The lease rate reflects a 2.5%increase over the 1995 rate. The rate increase for 1997-98 will reflect a CPI adjustment. All other terms and conditions of the lease remain unchanged. RECOMMENDATION: The Manager recommends that the Board approve a lease renewal through June 30, 1998,for space to be used by the Health Department at Carr Mill Mall; and authorize the Chair to sign on behalf of the Board. } STATE OF NORTH CAROLINA COUNTY OF ORANGE LEASE AGREEMENT RENEWAL THIS LEASE AGREEMENT RENEWAL made on the day of 1996,by and between CARR MILL MALL LD IITED PARTNERSHIP,a North Carolina Limited Partnership, .200 N. Greensboro St.,Ste D-11, Carrboro,NC 27510 having its principal business in Orange County, North Carolina,hereinafter referred to as"Owner" and ORANGE COUNTY,a political subdivision of the State of North Carolina,Post Office Box 8181,Hillsborough,North Carolina,hereinafter referred to as County. WrMSSETH: WHEREAS,a lease agreement was made and entered into as of the 4th day of October, 1985(a copy of which is attached as Exhibit A)between J.W.and Patricia Ann French,d/b/a Carr Mill Mall and County; WHEREAS,County and Owner desire to renew the lease agreement and amend it; NOW THEREFORE, County and Owner mutually agree to the following; 1. The Exhibit A lease agreement is renewed for the period commencing on July 1, 1996 and continuing through June 30, 1998; 2. During this renewal period, Section 2(a)of Exhibit A is modified as follows: County shall pay to the Owner rent as follows: Base rent: Monthly Annually July 1, 1996---June 30, 1997 $6,893.96 $82,727.53 July 1, 1996---June 30, 1998 Rent will increase by the change in the Consumer Price Index(CPI) using as a basis for that calculation April 1996 and April 1997. Rent is due and payable on the first day of each month,in advance,during the term of this Lease. 3. During this renewal period, Sections 2(c)and 2(d)of Exhibit A are deleted_ 4. During this renewal period,all other terms and conditions of Exhibit A remain the same. This the day of 1996.
