PURPOSE: To consider authorizing the Town of Chapel Hill to enter into
negotiations on behalf of the Landfill Owners ' Group (LOG) to acquire a
13 . 8 acre property.
BACKGROUND: At their March 20, 1996 meeting, the LOG recommended to the
member governing boards that they approve the purchase of a parcel of
land of approximately 13 . 8 acres, referred to as the Johnson property.
It is located west of and adjoining the northern portion of the
existing Eubanks Road landfill . If approved by the boards, and pending
successful negotiations with the owners, the property would enhance
existing landfill buffers and would provide additional land for
mulching and recycling operations .
The proposed sale price is $7, 500 per acre. The approximate cost would
be $103 , 500, depending on the results of a survey to determine the
exact size of the property. Funds for this purchase are already
available in the Land Reserve account of the Landfill Fund. The
attached LOG staff memos provide additional details about the proposed
acquisition.
RECOMMENDATION: The Manager recommends that the Board authorize
the purchase of the Johnson Tract at $7,500 per acre, or an estimated
cost of $103 , 500 .

Subject: Johnson Property Acquisition
Date: March 20, 1996
The attached resolution would recommend that the Carrboro Board of
Aldermen, the Orange County Board of County Commissioners and the
Chapel Hill Town Council approve the purchase of the Johnson
property at a cost of $7, 500 per acre .
Background
The Johnson property consists of 13 . 80 acres, located west of and ,
adjoining the northern portion of the existing landfill on Eubanks
Road. On December 13 , 1995, a report (Attachment 1) was presented
to the Owners Group regarding our being contacted by Mrs . Shirley
B . Johnson, Administratrix of the Estates of Lisbon R. Johnson and
his deceased son Simon R. Johnson. Mrs . Johnson expressed her
interest in selling the property.
At that meeting the Owners Group authorized the Chapel Hill Town
Manager to conduct preliminary negotiations, indluding receiving a
signed Offer to Sell. Upon the conclusion of negotiations, we were
to report back to the Owners Group .
Discussion
The December 13 , 1995, report indicated our primary reasons for
acquiring the property: to increase the landfill ' s present 100
foot buffer, and to provide additional area to expand mulching and
recycling operations .
Funding for the purchase would be through the use Land Reserve
funds . After -the recent purchase of the Neville Tract, the Land
Reserve account has $750, 916 . If the final survey confirms 13 . 80
acres, the total price for the Johnson property would be $103 , 500 .

Recommendation: That the Landfill Owners Group adopt the attached
resolution recommending that the Carrboro Board of Alderman, the
Orange County Board of Commissioners, and the Chapel Hill Town
Council adopt resolutions approving the purchase of the Johnson
property at $7, 500 per acre or an estimated total cost of $103, 500 .

A RESOLUTION REQUESTING THE CARRBORO BOARD OF ALDERMEN, THE ORANGE
COUNTY BOARD OF COMMISSIONERS, AND THE CHAPEL HILL TOWN COUNCIL TO
AUTHORIZE THE CHAPEL HILL TOWN MANAGER TO UTILIZE THE LANDFILL
RESERVE FUND - LAND RESERVE, TO PURCHASE THE PROPERTY KNOWN AS THE
JOHNSON PROPERTY (CHAPEL HILL TOWNSHIP, TAX MAP 7, BLOCK 18 , LOT
27D) ADJACENT TO THE NORTH EUBANKS LANDFILL.
WHEREAS, the Landfill Owners _Group has been approached by the
owners of a 13 . 8 acre tract of property that adjoins the current
landfill on Eubanks Road, and
WHEREAS, Mrs . Shirley B . Johnson, Administratrix of the Estates of
Lisbon R. Johnson and his deceased son Simon R. Johnson has
expressed her interest in selling this property to the owners of
the Orange Regional.-Landfill, and
WHEREAS, the Landfill Owners Group would have an interest in
obtaining this property in order to expand the current minimal
buffer area and provide additional space for mulching and recycling
operations at the Orange Regional Landfill, and
WHEREAS, it is agreed that the purchase price will be $7, 500 per
acre, with the total to 'be determined by a survey prior to closing;
NOW, THEREFORE, BE IT RESOLVED by the Landfill Owners Group- that
the Landfill Owners Group recommends to the governing boards that
they approve resolutions authorizing the Town of Chapel Hill, as
administrator for the landfill, to use Land Reserve funds to
purchase the property known as the Johnson property.

Subject : Offer of property for sale - Johnson tract
Date: December 13 , 1995
The Landfill Owners Group has been contacted regarding their
interest in purchasing a tract of property adjacent to the current
facility. This memorandum requests guidance on responding to this
inquiry and suggests a possible course of action.
Background
In the summer of 1984, the staff was contacted by Mr. Simon R.
Johnson, owner of a 13 . 8 acre tract of land adjoining the North
Eubanks facility regarding his interest in selling this property to
the landfill . We told Mr. Johnson that the local governments were
involved in a landfill site search process and that one of the
candidate sites, OC-17, included his property. We indicated that
the; Owners Group would likely be unwilling to consider purchasing
his property due to the ongoing site search, but might consider
purchasing the land at some point in the future, -particularly if
site' OC-17 was selected as the next landfill site.
This past summer, Mr. Johnson passed away and his wife and her
attorney are again interested in making this property available to
the landfill .
Discussion
The Landfill Owners Group has been contacted by Mrs . Shirley B .
Johnson, Administratrix of 'the-Estates of Lisbon R. Johnson and his
deceased son Simon R. Johnson, with regard to a 13 . 8 acre tract of
land located on Eubanks Road (Tax Map Reference : 7 . 18 . .27D) . The
property is located directly adjacent to and west of the existing
North Eubanks Facility (Attachment A) . The property is zoned Rural
Buffer and is vacant land. The site has recently been timbered and
is largely denuded of all mature natural vegetation.
The staff wishes to receive Owners Group authorization to initiate
preliminary negotiations with Mrs . Johnson regarding the purchase
of this property. We wish to pursue acquisition of this property
for two primary reasons . First, we believe it would be
advantageous for the landfill to acquire the property in order to
increase its present 100• foot buffer and provide additional area to
expand mulching and recycling operations . We are presently
constrained by a lack of additional useable space at the Eubanks
Road facility. Secondly, the property would be necessary to
acquire if the governing boards proceed with the selection of site
OC-17 .
1 Recommendation: That the LOG authorize the Chapel Hill Town
Manager to enter into negotiations regarding the possible purchase
of the Johnson Tract, including obtaining a signed Offer to Sell
should negotiations be successful . The staff would then return to
the LOG with further recommendations .
