BACKGROUND: Local legislation for the 1996 Short Session may be developed and presented for consideration in accordance with the rules laid out in the attached memo. The General Assembly will convene on May 13 , 1996 . Local bills must be submitted to the Bill Drafting Section by May 22, and must be introduced in either the House or Senate by May 29 . Last year, the Board of Commissioners proposed local legislation that would have permitted Orange County and its neighboring counties of Caswell, Person, and Alamance to resolve the location of county boundary lines. The legislation was withdrawn when Alamance elected officials expressed concerns about the legislation. The Board of Commissioners may wish to decide whether or not to ask the Orange County legislative delegation to reintroduce that legislation for 1996 . The Board may also wish to consider other items for adoption as local legislation. If the Board does have items it wishes to be considered for 1996 local legislation, it could identify those items at the April 1 meeting, and direct the County Attorney to draft proposed legislation to be submitted to the Orange County legislative delegation in accordance with the General Assembly' s rules and timetables . SuRivari Director of Research RE: Bills Eligible for Consideration by the General Assembly During the 1996 Short Session of the 1995 General Assembly Section 1 of Resolution 15 (HJR 1069) of the 1995 General Assembly provides that the Senate and House of Representatives "shall . . . reconvene at noon on Monday, May 13, 1996" (Appendix A). As in the past, only certain measures may be considered in the short session -- primarily those relating to appropriations, finances, retirements and pensions, and localities; certain legislation from the 1995 Session; and legislation proposed by study commissions. Any measure, however, may be introduced and considered if authorized by a joint resolution passed by two-third's vote of each chamber's members present and voting. For the second time, an interim adjournment resolution has an automatic sine die adjournment date -- June 21, 1996 (Section 3 of Resolution 15 for the upcoming session). Only the following matters are specifically allowed to be considered during the 1996 Session: (a) Bills directly and primarily affecting the State budget for fiscal year 1996- 97. These measures must have been submitted to the Bill Drafting Division of the Le ''slative Services Office by 4:00 p.m. on Thursday, May 23, 1996 and filed for introduction in the Senate or introduced in the House of Representatives by 4:00 p.m. Thursday, May 30, 1996. (b) Bills introduced in 1995 and having passed third reading by May 11, 1995 in the house in which introduced, received in the other house by May 11, 1995 (or on which a message is received in the second house that the first house passed the bill by May 11) and not disposed of in the other house by: (i) tabling; (ii) unfavorable committee report; (iii) indefinite postponement; (iv) failure to pass any reading; and that do not violate the rules of either body. (c) Bills implementing the recommendations of study commissions authorized or directed to report to the 1996 Session; of the House Ethics Committee; and of the Legislative Ethics Committee or of its Advisory Subcomittee. Any such bills must have been submitted to the Bill Drafti mng Division by 4:00 p.m., Thursday, May 16, 1996; and must be filed for introduction in the Senate or introduced in the House of Representatives by 4:00 p.m. on Thursday, May 23, 1996. Attached are lists of study commissions and committees as well as agency studies authorized or directed to report to the 1996 Session (Appendix Q. (d) Any local bill submitted to the Bill Drafting Division by 4:00 p.m. on Wednesday, May 22, 1996, and filed for introduction in the Senate or introduced in the House of Representatives by 4:00 p.m. on Wednesday, May 29, 1996. The bill must be accompanied by a certificate signed by the principal sponsor stating that no public hearing will be required or asked for by a member on the bill, the bill is noncontroversial, and the bill is approved for introduction by ,each member of the House of Representatives and Senate whose district includes the area to which the bill applies. (e) Selection, appointment or confirmation of members of State boards and commissions as required by law, including the filling of vacancies of positions for which the appointees were elected by the General Assembly upon recommendation of the President of the Senate, President Pro Tempore of the Senate, or Speaker of the House of Representatives. (f) Any matter authorized by joint resolution passed during the 1996 Session by two-thirds majority of the House of Representatives present and voting and by two-thirds majority of the Senate present and voting. A bill or resolution filed in either chamber under the provisions of this subsection shall have a copy of the ratified enabling resolution attached to the jacket before filing for introduction in the Senate or introduction in the House of Representatives. (g) Any bills primarily affecting any State or local pension or retirement system, submitted to the Bill Drafting Division by 4:00 p.m. Wednesday, May 22, 1996; and introduced in the House of Representatives or filed for introduction in the Senate by 4:00 p.m. on Wednesday May 29, 1996. (h) Joint resolutions, House resolutions, and Senate resolutions pertaining to Section 5(10) of Article III of the Constitution of North Carolina, 4 MEMORANDUM age August 22, 1995 submitting administrative reorganization through executive orders.
