PURPOSE: To consider a contract between Orange County Speedway and Orange County,
Department of Emergency Management, to provide medical coverage for events and races
held at the Speedway.
BACKGROUND: In previous years, medical coverage has been provided to the Speedway
through an agreement with Orange County Rescue Squad. The level of coverage has always
been approved by the Emergency Management Department as part of the annual safety review
by the County, of the Speedway.
Orange County Rescue Squad is no longer able to provide this coverage due to a shortage in
adequately trained personnel. Last year, Orange County Rescue Squad drew on the
membership of South Orange Rescue Squad to maintain the appropriate coverage. The
personnel at Orange County Rescue Squad has continually declined to the point that
arrangements with South Orange Rescue Squad would not be feasible.
The Department of Emergency Management strongly reels that adequate and appropriate
medical coverage be provided for the citizens and visitors attending events at the Speedway.
Staff have met with racetrack officials to work out operational and fiscal issues concerning
the contract, and have reached a satisfactory agreement
RECOWVIENDATIONS: The Manager recommends that the Board approve the contract
and authorize the Chair to sign, subject to review by the County Attorney.

ORANGE COUNTY
This Contract dated March 11, 1996, between The Orange County Speedway,
(the "Speedway") and the County of Orange (the "County")for joint and cooperative
arrangements for the provision of emergency medical services at certain Speedway events.
WITNESSETH
WHEREAS,the County and the Speedway have cooperated and worked jointly
on matters of concern or interest; and
WHEREAS, certain events at the Speedway bring spectators to Orange County
a
to enjoy the events; and
WHEREAS, the provision of adequate emergency medical care at such events is
a matter of mutual concern and interest to the Speedway and the County; and
WHEREAS, detailed joint and cooperative arrangements with respect to such
events will mutually benefit the Speedway and the County; and
WHEREAS,the County and The Speedway desire to provide such cooperative
emergency medical care;
NOW THEREFORE,in consideration of the premises and the mutual covenants
and conditions set forth below, the County and the Speedway agree as follows:
1. The County agrees to provide emergency care providers certified at the
Emergency Medical Technician and/or Paramedic level for the eighteen 1996 Speedway
events as outlined in the Orange County Speedway 1996 Schedule.

2. The County agrees to provide a minimum of 5 personnel(3 Paramedics and 2
Emergency Medical Technicians (minimally)for each 1996 event and an additional 2
Emergency Medical Technicians for the "Hooter's Cup 200" event on September 21,
1996. The County will also provide one Ambulance and one Initial Response Vehicle
for each event and two Ambulances for one Initial Response Vehicle for the event on
September 21, 1996. Additional coverage will be negotiated between the County and
the Speedway at the time of need.
3. The County agrees to keep records of patients seen at the Speedway under this
contract and to provide such records to the Speedway when appropriate.
4. The Speedway shall compensate the County for emergency medical services
provided pursuant to this contract by paying to the County a total of$12,500.00, payable
in seven equal payments of$1,785.71 beginning April 8, 1996. Payment shall be made
to the order of the County and mailed to the County's Finance Officer, P. O. Box 8181,
Hillsborough, N. C. 27278.
5. The personnel providing the emergency services shall report to the Speedway at
the time agreed upon by the Speedway and the County.
6. The contract may be reviewed annually no later than March 1, and may be
renewed, modified, or amended at that time, or at any other time, upon the mutual
written agreement of the parties.
7. This contract may be terminated at any time by either party by giving 90 days
notice to the other party in writing.

8. If either party defaults in its obligations and does not cure such default within
ten(10)days of receipt of notice of such default, the non-defaulting party may immediately
terminate the contract.

and executed this contract as of this day of , 1996.
