BACKGROUND: Over the past several years there has been an increasing need to schedule employees to work prior to 8:00 a.m. or after 5:00 p.m. in order to best serve the needs of Orange County citizens,meet the operational needs of the department and provide for the most efficient use of the County's resources. For example: The Register of Deeds office has a need to convert records on the optical imaging system after business hours when the public is not trying to access these records. As the Social Services Department begins to implement welfare reform which is focused on moving people off of welfare and into work, employees in the this department will need more frequently to make appointments to see clients after the traditional work day. There is a need for work schedules flexible enough to accommodate the 2 r evening needs of clients or department operations. Moreover,the ability to schedule evening work reduces the need to pay overtime to accomplish this task. It should be noted updating this section of the Personnel Ordinance also provides for a change in the length of the meal period from the current required one hour meal period to a minimum of a 30 minute meal period. This enables departments to provide greater coverage during the traditional lunch hour which is often the peak time for citizens visiting the County office to conduct business. The draft Personnel Ordinance revision extends the department head's flexibility to set varying work schedules for employees to meet the work needs so long as these schedules meet the conditions set out in the draft Ordinance revision,which among other things maintains compliance with the Federal Fair Labor Standards Act. Among others,these conditions include: ► Maintaining the staffing needs for the department's full operation during the County business hours of 8:00 a.m. until 5:00 p.m., Monday through Friday. ► Providing for a regular schedule of 40 hours per week for each full time employee. ► Including at least a 30 minute meal period during which the employee is free from duty. ► Providing for adequate supervision and security of employees during all times employees are scheduled to work. The specific changes to Article III, Section 1.0 of the Personnel Ordinance are noted in bold on the attachment. RECOMMENDATION: The Manager recommends the Board adopt the proposed Personnel Ordinance revision to Article III, Section 1.0, The Work Week effective April 1, 1996. f\pers\ordinance\ABSTWKWE.WPD 3 Attachment 1 Draft Revised Personnel Ordinance Article III, Section 1.0, The Work Week CONDITIONS OF EMPLOYMENT 1.0 THE WORK WEEK 1.1 The standard work week shall be from 12:01 a.m. Monday until 12:00 midnight on Sunday, a time span of seven(7) consecutive twenty-four(24)hour periods. Exceptions may be granted by the County Manager in an effort to meet scheduling needs and be in compliance with the Fair Labor Standards Act. 1.2 The County's business hours are from 8:00 a.m. until 5:00 p.m., Monday through Friday. The department head sets a regular weekly work schedule for each employee to maintain the staffing needs for the department's full operation during the County business hours, and meet the operational needs of the department. Exception: Law Enforcement Officers and Emergency Management Services employees' work schedules are established by the respective department head and approved by the County Manager. The employee's work schedule is subject to the following conditions: ► A full time employee is regularly scheduled to work 40 hours each work week.* ► The regular work schedule must include at least a 30 consecutive minute meal period during which the employee is free from duty. ► The department head or supervisor is responsible for the department's effective operation and supervision and security of employees during all time employees are scheduled to work. ► No employee will be regularly scheduled to work between the hours of 12:00 a.m. and 5:00 a.m. with the exception of employees in the Sheriffs Department and Emergency Management Services. 1.3 Each department is responsible for having a department work scheduling plan. The County Manager may periodically request each department to submit its work scheduling plan for review. * Except as provided for the Soil and Water Conservation District 4 Attachments 2 From the Current Orange County Personnel Ordinance ARTICLE III CONDITIONS OF EMPLOYMENT 1.0 THE WORK WEER 1.1 The standard work week shall be from 12 : 01 a.m. Amended Monday until 12 : 00 midnight on Sunday, a time span of 1/19/89 seven (7) consecutive twenty-four (24) hour periods . Exceptions may be granted by the County Manager in an effort to meet scheduling needs and be in compliance with the Fair Labor Standards Act . 1.2 The standard work hours shall be from 8 : 00 a.m. until 5 : 00 p.m. with one hour for lunch. Exception: Law Enforcement Officers and Emergency Services employees ' work schedule shall be established by the respective department head and approved by the County Manager. 1.3 Full-time employees normally work five (5) eight (8) Amended hour days per week. Department Heads may elect to 3/5/89 establish for his/her employees a flexible work schedule to consist of a pre-determined schedule of nine consecutive hours between 7 :30am and 6 : OOpm, with one hour for lunch break each day, Monday through Friday. The first consideration in establishing a work schedule and in permitting any variation from it is providing adequate staffing to maintain County office hours of Sam to 5pm and the needs of the work unit . Consistent with that need, consideration should also be given to the needs and the preferences of the employee. With the approval of the Department Head a schedule will be established for each employee which provides for a 40 hour workweek.
