BACKGROUND: At their most recent meeting, the Landfill Owners ' Group voted 5-2 to approve a recommendation to the governing boards of Carrboro, Chapel Hill, Hillsborough, and Orange County that a modified Site OC-17 be approved as the next landfill site in Orange County. Specific conditions attached to the possible development of OC-17 as a landfill site are detailed in the attached LOG resolution. The Board of Commissioners is asked by the LOG to consider adopting a similar resolution that would signal Orange County' s approval of the selection of that site. The other governing boards are expected to consider similar resolutions at meetings later during the month of February. RECOMMENDATION: The Manager recommends that the Board adopt the resolution, considering any necessary modifications which the Board may identify. 2 0 . Adopted by the Landfill owners Group - A RESOLUTION REQUESTING THE CARRSORO BOARD OF ALDERMEN, THE CHAPEL HILL TOWN COUNCIL, THE HILLSBOROUGH TOWN BOARD, AND THE ORANGE COUNTY BOARD OF COMMISSIONERS TO APPROVE SITE OC-17 AS THE -SITE OF THE NEXT SANITARY LANDFILL FOR ORANGE COUNTY. WHEREAS, there is a need for a new solid waste sanitary landfill once the current facility reaches capacity and that the landfill be developed as part of an integrated solid waste management plan; and WHEREAS, a landfill site search was -. initiated in 1990, by the governing bodies of- Carrboro, Chapel Hill and Orange County; and WHEREAS, the process included establishment of.a citizens committee to conduct the county-wide search for potential sites; and WHEREAS; the local governments obtained the services of a engineering consulting firm to assist in -the technical aspects of the process; and - WHEREAS, the engineering consultant found that all four of the candidate sites were permitable 'as a landfill and recommended OC-17 as the most preferred site; and WHEREAS, a five year process concluded with the citizens Landfill Search Committee making their recommendation to the landfill Owners Group of OC-17 as being the most suitable site; and WHEREAS; it is the intention of the Landfill Owners- Group to negotiate purchase of all property at fair market value, but will recommend the use of the power of eminent •domain-if necessary to acquire land that is necessary for the public purpose of managing the disposal of- solid waste; and WHEREAS, the Landfill owners Group is committed to early adoption and implementation of an integrated solid waste management plan and a goal of a minimum 50.- reduction of solid waste requiring disposal; and WHEREAS, the Landfill Owners Group is committed to insuring surrounding neighbors receive fair and just compensation for any losses; and WHEREAS, the Landfill. Owners Group has concluded that a reduced acreage OC-17, taking advantage of the existing landfill, is the most suitable site for the next landfill for managing Orange County's waste because: • Recommended by engineering consultant • Recommended by Landfill Search Committee • Accessible to sewer service for leachate disposal • Accessible to water service to mitigate groundwater contamination if it occurs e. • Eliminates need to relocate waste processing facilities aft 3 er closure of current cells • Affords. potential for -reprocessing material buried in landfill at this site • Minimizes additional acreage •required by using a portion 'of the existing landfill pioperty.- NOW, TFMRFFORE, BE IT RESOLVED by the Landfill Owners Group that the- Landfill Owners•Group recommends to the governing boards that they approve a resolution, 1) authorizing acquisition of those strictly necessary properties within the area designated by Joyce Zzgineering as the site OC-17 for expansion of the current landfill operations; consistent with -the -reduced acreage commitment; 2} authorizing the creation of a negotiating team by the Chapel Bill Town Manager, in consultation with the Managers of Orange County, Carrboro, and Hillsborough, to initiate negotiations and to solicit Offers to Sell from property owners (including authorization to provide earnest money from the Land Reserve Fund) . This team will include a neutral professional facilitator approved by the Landfill owners Group; 3) requesting that the negotiating teats meet with the selected site' s property owners in facilitated "meetings to discuss process of acquisition, specific owner concerns, the local governments, intention of being as .flexible as possible* in, making site design and construction address the concerns of 1 andowners; and A) rasing the attached "Toward A Sustainable -Community - Landfill Operations" as a guideline in proceeding with site acquisition and development. , This. the 10th day of January, 1996. This, the 5th day of February, 1996 . 6 TOWARD A SUSTAINABLE COMMUNITY LANDFILL OPERATIONS The landfill site search process has resulted in identification of four sites that are considered to be technically suitable. None of the proposed sites is without social/political problems. An alternative to selection of a"new landfill"would be to expand the present landfill site and commit to waste prevention,materials recycling and recovery,and landfill management such that the present landfill location will last indefinitely. This scenario would present an excellent opportunity to practice sustainable community principles. STRATEGIES/PRINCIPLES FOR DEVELOPING NEXT LANDFILL SITE,OC-17 SCENARIO 1. Commit to early adoption and implementation of an integrated solid waste management plan to achieve at least a 50 percent reduction in solid waste through waste reduction,expanded recycling,and waste processing efforts,thereby extending the life of the current landfill. 2. Designate a portion of site OC-17,as outlined in the February 1995 Joyce Engineering document,as the area to meet Orange County's future solid waste management needs. • Recommended by engineering consultant • Recommended by Landfill Search Committee • Accessible to sewer service for leachate disposal • Accessible to water service to mitigate groundwater contamination,if it occurs • Eliminates need to relocate waste processing facilities after closure of current cells • Affords potential for reprocessing material buried in landfill at this site 3. Proceed with acquisition of property within the OC-17 area on a voluntary basis. 4. Negotiate with Duke and other property owners on conditions for future acquisition of land to meet solid waste management needs. Negotiations may include,but not limited to,the following items: • Phased acquisition,timed to accommodate research and historic interests • Life estates • Swap for other land,such as the Greene/Byrd Farm tract • Explore landfill mining of current landfill, in cooperation with Duke and UNC,as a means of pre-empting future environmental problems,provision of cover soil,and re-use of recovered land for lined disposal cells 5. Commit to reducing the amount of additional land to be acquired,giving consideration to: • Elimination of C&D landfill when regional recycling options are available(C&D landfill conflicts with Duke- DOE easement) • Promote and participate in regional waste management opportunities • Identification of beneficial uses for UNC flyash • Waste reduction through prevention,recycling,and processing programs • UtiIization of piggy-back technology to locate new cells next to closed landfill(this would enable avoidance of the Duke-DOE easement and the Alexander Hogan Plantation areas) 6. Request NW Small Area Planning Group to consider using Employment Campus(EC)zonino.'designation as a buffer between the landfill and all residential property. Through the Joint Planning process,consider expanding economic development activities in the area,with special attention to activities that would support waste reduction,processing, and expanding recycling markets. 7. Identify and acquire property to provide access to railroad for expanded market opportunities for recyclables and OOC options. S. Notwithstanding potential use of Greene/Byrd Farm tract in Duke negotiations,consider its use as part of a community compensation package. DGW\LF111695
