BACKGROUND: A proposal to expand an existing Twenty-Year Transition Area has been received from Charles W. Davis and James L. Davis for part of a parcel between NC 86 and Old NC 86, south of the Town of Hillsborough. The area proposed for re-designation is a 50-acre portion of a 108-acre parcel on the southeast side of Cates Creek in Hillsborough Township. The property is undeveloped and is adjacent to the I-40/Old 86 Economic Development District.The site is currently designated Rural Residential, while the remainder of the parcel is designated Twenty Year Transition. The applicants are requesting that the 50-acre portion also be designated as Twenty-Year Transition. The designation of Twenty-Year Transition is applied to land in transition from rural to urban uses which has or will have access to public water and sewer service.The proposed designation of Twenty-Year Transition would allow potential rezoning of the property to higher-density residential uses. The site is currently zoned R-1, with a minimum lot size of 0.92 arses. This item was presented for public hearing on November 27, 1995. One person asked about future buffering requirements and next steps in the development process. On December 18, 1995, the Planning Board unanimously recommended approval of the amendment. OPENING REMARKS FROM THE CHAIR 33 Chair Carey welcomed everyone to the meeting. He mentioned that everyone, including 34 staff, who wished to speak on the Special Use Permit (C.3.a) would be sworn in prior to giving 35 testimony-.- He-stated-that Bill Waddell, Chair of the Planning Board, would serve as the Chair 36 for all items on the agenda, with the exception of the request for a Special Use Permit for Reba 37 and Roses. 38 39 PUBLIC CHARGE 40 Chair Carey dispensed with the reading of the public charge. 41 42 C PUBLIC HEARING 43 1. Comprehensive Plan Amendments 4 e 1 (a) CP-2-95 Charles W. And James L. Davis (Rural Residential to 20-Year 2 Transition) 3 This item was presented by David Stancil to receive public comment on a proposed 4 amendment to the Land Use Element of the Comprehensive Plan. A proposal to expand an 5 existing Twenty-Year Transition Area has been received from Mr. Charles W. Davis and Mr. 6 James.L. Davis for part of a parcel in their ownership lying between NC 86 and Old Chapel Hill- 7 Hillsborough Road (Old 86), south of the Town of Hillsborough. The area proposed for re- 8 designation is a 50-acre portion of a 108-acre parcel on the southeast side of Cates Creek in 9 Hillsborough Township. The 50-acre portion is currently designated Rural Residential, while the 10 remainder of the parcel is already designated Twenty-Year Transition. The property is 11 undeveloped and is adjacent to the 1-40/Old 86 Economic Development District. The 12 designation of Twenty-Year Transition, if applied, would allow potential rezoning of the property 13 to higher-density residential uses in the future. 14 15 QUESTIONS AND/OR COMMENTS FROM THE BOARD OF COMMISSIONERS OR 16 PLANNING BOARD. 17 None. 18 19 QUESTIONS AND/OR COMMENTS FROM CITIZENS. 20 Martin Brown, a resident of Stagecoach Run, mentioned that a small section of 21 Stagecoach Run abuts the property in question. He requested that the Stagecoach Run portion 22 be maintained in the R-1 zoning to preserve the neighborhood. Also, the portion of their land 23 that abuts the Economic Development District has a 100 buffer. He requested that the portion 24 that abuts the area requesting the 20-Transition designation also be given a 100 foot buffer. He 25 asked what the highest density zoning was that could be anticipated and would there be an 26 additional opportunity to review proposed development in the future. 27 28 David Stancil stated that the highest density zoning district is R-13, however, it has 29 never been used. There are several small R-8 (8 units to the acre) designations and several 30 R-5 (5 acres per acre) designations. This Public Hearing is about an appropriate change in 31 designation only. An actual rezoning would require a subsequent public hearing. The issue of 32 the buffer would also be addressed at that time. 33 34 Jean Brooks asked for clarification about the boundaries of the area in question. David 35 Stancil clarified those boundaries. 36 37 Jay Zaragoza, the land planner for the Davis property, indicated that he was pleased with 38 the staffs recommendation and their support of this change. He stated that the Davis' are 39 considering the use of a cul-de-sac. The developed lots in Stagecoach Run would then not be 40 attached to this subdivision. This would eliminate through traffic as a consideration. 41 42 A motion was made by Commissioner Gordon, seconded by Commissioner Crowther, to 43 refer this matter to the Planning Board for a recommendation to be returned no sooner than 44 January 16, 1996. 45 VOTE: UNANIMOUS Draft Planning Board Minutes - 12/18/95 5 to 150 acres of open space. She continued that one of the presenters talked about what average citizens can do and the difference they can make. However, there must be political will and commitment. AGENDA ITEM #8: MATTERS BEARD AT PUBLIC HEARING-11/27/95 a. Comprehensive Plan Amendments ( 1) CP-2-95 Charles W. and James L. One person spoke, asking about future buffering requirements and next steps in the development process. The Planning Staff recommends approval of the proposed amendment as indicated in the November 27 staff analysis (an attachment to these minutes on pages ) . Jay Zaragoza, representing Mr. and Mrs. Davis, noted that they were pleased with the Planning 6 Staff recommendation and indicated he would answer questions the Planning Board might have regarding the proposed amendment. Brown asked if the owners had any particular plans for the property. Mr. Zaragoza responded that the intent is for residential subdivision. Brown asked if the owners are aware of any village type development if water and sewer is available. The response was that the Town of Hillsborough had discussed a water and sewer agreement with the Davises. He explained the extension that would be required by the Town of Hillsborough. He further noted that the owners would probably be interested in the maximum number of lots rather than a village concept. Howie asked the location of the entrance and exit if the property was subdivided. Mr. Zaragoza demonstrated on the map the probable location of an entrance. He noted the possibility of gaining entrance through the business park. Katz asked about access through Stagecoach Run Subdivision. Mr. Zaragoza responded that the road from Stagecoach Run is a private road and the probable density of the subdivision would be such that access should not be gained from the private road. He continued explaining the probable road system. Howie asked the density and the response was (for the portion adjacent to Stagecoach Run) one- acre lots which would be in harmony with area subdivisions. MOTION: Walters moved approval as recommended by the Planning Staff. Seconded by Reid. VOTE: Unanimous. (2 ) CP-3-95 Land Use Plan Amendment (Natural and Cultural Resources) Presentation by Don Belk. The current Section 2.2, Natural Environment, of the Land Use Element was initially adopted in September, 1981. Only two amendments have been made to that section since then. The first amendment occurred in August, 1989, following completion of a staff-generated Inventory of Sites of Cultural, Historical, Recreational, Biological, and Geological Significance in the
