PURPOSE: To respond to a proposal by the Town of Carrboro to adopt a development
moratorium in the Northern Study Area.
BACKGROUND: On November 11,the Carrboro Board of Aldermen will conduct a public hearing
to consider a development moratorium until April 30, 1998 in the Northern Study
Area. The moratorium would affect projects with five or more units or lots. The
Northern Study Area includes the Transition Areas, which are subject to provisions
of the Joint Planning Agreement.
Requirements of Joint Planning Agreement
Section 2.6c of the Joint Planning Agreement requires that proposed amendments
to the Carrboro Land Use Ordinance be delivered to Orange County within 30 days
of the public hearing. If approved by the Board of Aldermen, the amendment is
automatically adopted by reference by Orange County, unless a written objection is
filed by Orange County prior to the public hearing. An objection must be based on
inconsistency with the Joint Planning Area Land Use Plan.
Previous Request for Moratorium
In 1996, early in the development of the Northern Small Area Plan, Carrboro
proposed a development moratorium for the study area. The Board of
Commissioners authorized its Chair to sign a letter of objection. The letter, dated
February 13, 1996, stated that the amendment was inconsistent with the JPA Land

Use Plan on the basis that the Plan sets forth a range of densities in Transition j
Areas, but does not contemplate limitations on the ability to secure permits if
proposed projects are carried out in accordance with the Plan.
The letter further states that a moratorium adopted by Carrboro would have no
effect in the Transition Areas until the Joint Planning Agreement was amended to
"provide for moratoria, their duration, and the reasons justifying them".
Current Request for Moratorium
The moratorium proposed at this time is essentially the same as that proposed in
early 1996. The Carrboro Board of Aldermen have set a November 11, 1997
public hearing date.
There have been no changes to the Joint Planning Agreement to address
development moratoria, as suggested in the February 13, 1996 letter from the
Board of Commissioners. In response to the request for comment on the current
proposed moratorium,the Planning Staff sent the attached letter dated October 15,
1997 to the Carrboro Planning Director. That letter cites the prior action by the
Board of Commissioners objecting to a moratorium until the Joint Planning
Agreement is amended.
Options
Since the initial request for a moratorium, there has been considerable public input
into the development of the Plan. Two facilitated meetings, held in April and May
of 1997, involved almost 200 citizens, elected officials and community leaders.
One option would be for the Board of Commissioners reconsider its earlier
decision based on additional information concerning the extent of public input on
the development of the Northern Small Area Plan. If the Board takes no action to
object to the proposed moratorium prior to the November 11 hearing before the
Board of Aldermen,then it will be effective in the Transition Areas upon adoption,
and will automatically be incorporated by reference into the Orange County
Zoning Ordinance.
The other option would be to conduct a public hearing to amend the Joint
Planning Agreement as described in the February 26, 1996 letter from the Board
of Commissioners. The governing boards of Orange County, Chapel Hill, and
Carrboro will be present at an Assembly of Governments meeting on November
20, 1997. A JPA public hearing could be held prior to convening the regular
meeting. A proposed legal advertisement is attached for Board approval if it
wishes to schedule the hearing on November 20.
RECOMMENDATION: The County Manager recommends that the Board reconsider its earlier
position concerning the proposed Carrboro development moratorium based
on the extent of public input in the development of the Northern Small Area
Plan, and take no action objecting to the proposed moratorium.

AN ORDINANCE ESTABLISHING A
MORATORIUM ON THE PROCESSING OF
SPECIAL AND CONDITIONAL USE PERMIT
APPLICATIONS FOR DEVELOPMENTS ON PROPERTIES
WITH1 THE NORTHERN STUDY AREA
WHEREAS, in 1992 the Carrboro Board of Aldermen appointed a 31 member Small
Area Planning Work Group to develop a plan for the development of the Northern Study Area as
shown on the map attached hereto and incorporated herein; and
WHEREAS, in February of 1996 the Small Area Planning Work Group recommended to
the Board of Aldermen a plan developed by the Work Group for the Study Area; and
WHEREAS, as a result of concerns expressed about the proposed plan by residents of the
Study Area, the Board referred the proposed plan to a two day facilitated planning conference
sponsored by Carrboro, Chapel Hill and Orange County and attended by approximately 150
residents of the area,planners,and public officials; and
WHEREAS, following meetings on April 19 and May 31, 1997, the facilitated planning
conference reached consensus on a plan for the Northern Study Area(the`modified plan";and
WHEREAS, on August 19. 1997 the Board of Aldermen unanimously accepted the
modified plan and on September 16, 1997 established and appointed the members of an
ordioance drafting committee to draft changes in the Carrboro Land Use Ordinances that are
necessary to implement the recommendations of the modified plan;and
WHEREAS, the Board of Aldermen recognizes that, whenever major revisions to the
land use ordinance are contemplated, uncertainty may be created as to the effect of ordinance
amendments on development applications that are pending if and when such amendments are
adopted;and
WHEREAS, the Board desires to avoid such uncertainty, to avoid the potential of public
and private resources being wasted if ordinance amendments render obsolete development
applications that do not comply with such ordinance amendments, and to preserve the status quo
in terms of the development of major tracts within the Study Area. pending the drafting of`
ordinance amendments that are necessary to implement the recommendations of the modifies!
Plan;
NOW THREFORE, THE BOARD OF ALDERMEN OF THE TOWN OF CARRBORO
ORDAINS:
Section 1. From and after the effective date of this ordinance for a period of six
months, the Carrboro Planning Department shall not process applications for special use permits
or conditional use permits for developments within the Northern Study Area, as shown on the
map attached hereto and incorporated herein, unless such applications have been accepted and
the fees associated with such applications have been paid prior to the effective date of this
ordinance.
Section 2. For purposes of Section l of this ordinance, a development application
shall be accepted if the applicant has submitted substantially all of the information required under
Appendix A of the Land Use Ordinance as determined by the Zoning Administrator.
Section I For purposes of Section 1 of this ordinance, the required fees are those
established for the applicable permit application by the Miscellaneous Fees and Charges
Schedule. Such fees shall be paid by the applicant and accepted by the town only after the
application has been accepted in accordance with Section 2 of this ordinance.
Section 4. All provisions of any town ordinance in conflict with this ordinance are
repealed.
Section S. This ordinance shall become effective unless Orange County files an
objection pursuant to Section 2.6 of the Joint Planning Agreement. If the county objecm then
the ordinance shall not become effective unless and until the county adopts this ordinance as
provided in Section 2.6c of the Joint Planning Agreement.
The foregoing ordinance, having been submitted to a vote, received the following vote and was
duly adopted this_day of , 1997.

In accordance with Section 2.6, Subsection C, of the Joint Planning Agreement, please
find enclosed the full text of a proposed amendment to the Carrboro Land Use Ordinance along
with a preliminary agenda item for your review and comment. The proposed amendment would
establish a moratorium on processing special and conditional use permit applications for
development of properties located within the Northern Study Area.
The Joint Planning Agreement requires Carrboro to provide you with a copy of proposed
amendments no later than thirty (30) days prior to the public hearing. However, there is a
provision in the Agreement that allows this time period to be reduced to no less than ten (10)
days with your consent. Accordingly, it is hereby requested that Orange County approve the
reduction of the time period to ten(10)days.
On October 07, 1997, the Board of Aldermen will be requested to set a public hearing
date of November 11, 1997, to receive public comment regarding this proposed Land Use
Ordinance text amendment.
Please submit any objections to this proposed amendment in writing on or before the
public hearing date set for November 11, 1997.

PURPOSE:
The purpose of this item is for the Board to review and set a public hearing on an ordinance entitled "An
Ordinance Establishing a Moratorium on the Processing of Special and Conditional Use Permit
Applications for Developments on Properties Within the Northern Study Area".
SUMMARY
The Board of Aldermen on September 16, 1997, requested the Town Attorney to draft an ordinance to
institute a development moratorium in the Northern Small Area Planning Area to expire on April 30,
1998. The Board further stipulated that the moratorium will apply to projects requiring applications for
special use or conditional use permits only. Completed applications for special use or conditional use
permits accepted prior to the effective date of the moratorium will continue to be processed by the staff.
As a matter of information, special use permits are required for residential projects proposing from 5 to 12
dwelling units or lots, and conditional use permits are required for residential projects proposing more
than 12 units or lots. Zoning permits required for projects proposing between 1 and 4 units or lots will
be affected by the moratorium.
As required by the Joint Planning Agreement, a copy of this ordinance was sent on October 3, 1997 to
Orange County for their review and approval(see the attached transmittal letter).

RECOMMENDATION:
The administration recommends that the Board of Aldermen set a public hearing for November 11, 1997
to consider the attached ordinance entitled "An Ordinance Establishing a Moratorium on the Processing of
Special and Conditional Use Permit Applications for Developments on Properties Within the Northern
Study Area". The administration further requests that the ordinance be referred to the Carrboro Planning
Board for their recommendation.

This document provides a Small Area Plan for the future use of the land within
Carrboro's northern growth area, referred to as the Northern Study Area. This plan is unique
insofar as the process undertaken to produce a policy document in keeping with the needs and
desires of the Town of Carrboro, Citizens of Carrboro, and the Residents of the unincorporated
areas. The first draft of this plan was presented to the town in February of 1996 by the 31-
member "Small Area Planning Work Group" created by the Carrboro Board of Aldermen in
1992. As a result of concerns registered by some residents, particularly residents of the
unincorporated portions of the northern study area, the Carrboro Board of Aldermen referred the
plan to a two day facilitated planning conference. The two day meeting provided an open forum
to afford citizens, property owners, and residents the opportunity to participate in the planning
for future of the northern study area. This two day meeting was jointly sponsored by all three
I members to the 1987 Joint Planning Agreement, namely: Carrboro, Chapel Hill, and Orange
County. The Orange County Dispute Settlement Center facilitated the meeting and Randall
Arendt, a planner with the Natural Lands Trust, provided professional planning assistance.
The first of the two day meeting process was held on April 19, 1997 at the McDougle
Middle School in Carrboro. The first half of this meeting focused on providing participants with
an insight on current planning issues associated with the study area, a review of zoning concepts
and enabling legislation, projections on future growth and development, and background
information regarding the people and history of the study area. The second half of the meeting
was devoted to the identification of values, interests, and concerns about the future development
of the study area. The participants, numbering almost 150 people, divided into 13 small work
groups to articulate their values, interests, and concerns with the assistance of group facilitators.
After meeting for almost two hours the breakout groups reconvened as a full group to present
their lists of values, interests, and concerns. These reports were refined by the full group and
along with a visual preference survey were presented to Randall Arendt to draft a plan for the
study area which would be the focus of the second meeting.
The second meeting, held on May 31, 1997, was devoted to receiving the plan from
Randall Arendt and reaching consensus on a Small Area Plan for the Northern Study Area's
growth over the next 20 years. People attending this meeting, broke into small groups, reported
their conclusions to the full group, and produced a list of planning policies and principals on
which consensus by the full group was reached. This document incorporates the consensus of
the two-day facilitated conference into a revised small area plan for further consideration and
adoption by the Town of Carrboro, the Town of Chapel Hill, and Orange County under the terms
of the 1987 Joint Planning Agreement.

The Planning Staff has reviewed the proposed amendment to the Carrboro Land Use
Ordinance to establish a moratorium on processing special use and conditional use permit
applications for the development of properties located within the Northern Study Area.
In 1996, Orange County objected to a temporary moratorium in the Joint Planning Area
Transition Area. A letter dated February 13, 1996 from Moses Carey, Chair of the Board
of Commissioners, to Mayor Michael Nelson is attached. The letter states Orange
County's position that the moratorium is inconsistent with the Joint Planning Area Land
Use Plan. The Land Use Plan sets forth a range of densities in the Transition Areas. It
does not contemplate the inability to secure permits for projects which are consistent
with the Plan. The letter also includes an option for Carrboro t6 propose an amendment
to the Joint Planning Agreement to provide for moratoria, their duration, and their
justification.
Since there has been no amendment to the Joint Planning Agreement, Orange County's
1996 objection to application of the moratorium in the Transition Area of the Joint
Planning Area remains. The objection can only be removed by the Joint Planning
Agreement amendment suggested here and in 1996.

Dear Chairman Crowther& Fellow Commissioners:
The Carrboro Board of Aldermen recently received a copy of a letter from Orange County's
Current Planning Supervisor, Mary Willis, regarding the County's objection to a land use
ordinance amendment to establish a temporary moratorium on the processing of special use and
conditional use permits. As requested by the county in their 2/13/96 letter, the Town of Carrboro
has conducted a facilitated meeting resulting in a draft "Facilitated Small Area Plan for
Carrboro's Northern Study Area" being accepted by the Board of Aldermen on 8/19/97. The
Town of Carrboro intends to present the plan to a joint planning public hearing in April, 1998;
however, the Town would also like to present amendments to the land use ordinance necessary to

The Board of Aldermen recognizes that, whenever major revisions to the land use ordinance are
contemplated, uncertainty may be created as to the effect of ordinance amendments on
development applications that are pending if and when such amendments are adopted. In order
to avoid or at least minimize such uncertainty, the Town has drafted an ordinance establishing a
moratorium on the processing of special use and conditional use permit applications effective for
6 months. The duration of this moratorium will provide the time needed to conduct a joint public
hearing in April 1998 on the adoption of the "Facilitated Small Area Plan for Carrboro's
Northern Study Area" and associated land use ordinance amendments.
As the governing board in the Town of Carrboro and as a party to the Joint Planning Agreement,
we urge you as Commissioners for Orange County to approve the requested ordinance
establishing a moratorium on the processing of special use and conditional use permit

A public hearing will be held at the Orange Water and Sewer Authority Operations Center at 400 Jones
Ferry Road, Carrboro, NC on Thursday, November 20, 1997 at 7:00 p.m. for the purpose of giving all
interested citizens an opportunity to speak for or against the following item:
AMENDMENT TO JOINT PLANNING AGREEMENT
1. Amend Section 2.3 and 2.4 of the Joint Planning Agreement to allow for adoption of development
moratoria when needed to provide time to develop implementing ordinances for adopted plans.
The specific text amendments proposed as described in this notice are available for public inspection at the
Orange County, Carrboro and Chapel Hill Planning Departments.
All interested citizens are invited to attend this hearing and be heard. Public comment will be received
during the public hearing. Following the close of the public hearing, only evidence received in writing by
the date of the Planning Board meeting following the public hearing will be considered by the Board of
Commissioners for decision.
Changes may be made in the advertised proposals which reflect debate, objections and discussion at the
hearing.
