PURPOSE: To consider a proposed amendment to replace land use categories
referenced in various text and tables in the Design Manual to match those
found in the Permitted Use Table.
BACKGROUND: The Permitted Use Table in the EDD Design Manual categorizes permitted
land uses according to the Standard Industrial(:lassification Manual
(SIC)prepared by the Federal Office of Budges:and Management. Using
the SIC allows staff to more clearly determine-the land use category into
which a specific proposed use would fall to determine whether or not that
use is allowed.
The following SIC categories are used in the EDD Design Manual:
Residential
Agricultural,Forestry and Fishing
Construction
Manufacturing,Assembly and Processing
Transportation, Communication and Utilities

Finance,Insurance and Real Estate
Retail Trade
Services
Government
The Design Manual includes various tables and text which specify the
standards applicable to various land uses. However,the land uses listed in
some of the tables do not correspond with the land uses listed in the
Permitted Use Table. It can be difficult to determine the category into
which a proposed use falls for the purpose of determining whether or not it
is allowed in a specific EDD, and which standards should be applied.
The proposed amendment renames the land uses listed in the following
tables to correspond with the land uses listed in the Permitted Use Table:
a) Minimum Required Site Volume Ratios (page 2.3.10)
b) Off-Street Parking Requirements for Selected Land Uses(page
3.3.7)
C) Schedule of Land Use Buffers (page 3.2.8)
d) Maximum Permitted Sound Levels (page 2.4.3)
The proposed amendment was presented for public hearing on May 27,
1997. Commissioner Gordon requested that the Tables be revised to make
the proposed changes more clear. Revisions have been made in response
to those comments. There were no citizen comments.
The Planning Board considered the proposed amendment on July 2, 1997
and recommended approval. The vote was unanimous.
RECOMMENDATION: The Administration recommends that the Board of Commissioners
close the public hearing and approve the proposed amendment per
the Planning Board recommendation.

PURPOSE:
The proposed amendment replaces land use categories referenced in various text and tables in the
Design Manual to match those found in the Permitted Use Table.
IMPACTS AND ISSUES:
The Permitted Use Table in the EDD Design Manual categorizes permitted land uses according
to the Standard Industrial Classification Manual (SIC)prepared by the Federal Office of Budget
and Management. Using the SIC allows staff to more clearly determine the land use category
into which a specific proposed use would fall to determine whether or not that use is allowed.
The following SIC categories which are used in the EDD Design Manual:
Residential
Agricultural,Forestry and Fishing
Construction
Manufacturing,Assembly and Processing
Transportation, Communication and Utilities
Finance,Insurance and Real Estate
Retail Trade
Services
Government
There is also a category for"Other Uses"which includes Historic Buildings for Non-Residential
Use", a use unique to Orange County.
The Design Manual includes various tables and text which specify standards(such as site volume
ratios)applicable to various land uses. However,the terminology used to identify the land uses
differs in some cases from the categories specified in the Permitted Use Table, and it can be 4
difficult to determine the category into which a proposed use falls for the purpose of determining
the applicable standard.
An example of this inconsistency can be found in determining the site volume ratio for a bank.
The Table of Minimum Site Volume Ratios provides one ratio for"office/institutional use". and
another for"servicelretail use". In considering applicability to a use such as a bank,the question
arises as to whether the use is an"office"or a"service". The Permitted Use Table,based on the
SIC is of little help, since there is a separate category for Finance, Insurance and Real Estate.
When questions on this issue have arisen, Staff has interpreted a use to be an office if most of the
traffic is generated by employees, and a service if the traffic is generated predominately by
customers.
The Planning Staff for the Town of Hillsborough has also expressed concern with the use
categories,having encountered similar problems in reviewing development plans in its EDD.
The amendment includes revisions to the following tables:
a) Minimum Required Site Volume Ratios (page 2.3.10)
b) Off-Street Parking Requirements for Selected Land Uses (page 3.3.7)
C) Schedule of Land Use Buffers (page 3.2.8)
d) Maximum Permitted Sound Levels (page 2.4.3)

*"Manufacturing,Assembly and Processing" is ical y referred to as"industrial use".The intensity of impact
of such use depends on the nature of the specific activity.For example,electronics assembly would be
considered an industrial use,but would have little potential for pollution,high water use or other impacts which
are often perceived as being associated with industrial activity.
With the exception of residential uses,the site volume ratios were selected after an intensive
study of the design features and land use intensity ratios of eighteen selected sites in the
Research Triangle and Piedmont Triad regions.

Exceptions:
1. Impact noises or sounds that occur intermittently rather than continuously are permissible up
to a level of 10 dB(A) in excess of the figures listed above provided the source from which they
are generated does not operate more than one minute in any one hour. This exception shall not
apply from 7:00 p.m. to 7:00 a.m. when the adjacent lot is used or zoned for residential purposes.
2. Noise levels resulting from construction or other temporary activities which occur between
the hours of 7:00 a.m. and 7:00 p.m.,are exempt from the standards listed in the table.

2 The item was presented by Mary Wins in order to reserve citizen comment on a proposed amendment to update
3 information related to wallet supply and sewage disposal in the 1r40/Old NC 85 Economic Development District
4 (EDD). Article 2.4 of the EDO Design Manual(Environmental Factors)includes sections on water supply and
5 sewage disposal for each District Text pertaining to the 1-40/Old NC 86 District has not been amended since+t was
6 originally adopted. The text includes descriptions of planned water and sewer extensions, including scheduled
7 completion dates. The oompletion dates referenced in the Design Manual have passed. The proposed an,mendment
8 updates"status of these improvements.

The Planning Staff recommends approval of the proposed amendment,
including revisions to update information concerning the Hillsborough
water storage tank.
MOTION: Brooks moved approval as recommended by the Planning Staff.
Seconded by Andrews.
VOTE: Unanimous.

Presentation by Mary Willis.
This item is to consider a proposed amendment to replace land use
categories referenced in various text and tables in the Design Manual to
match those found in the Permitted Use Table.
The Permitted Use Table in the EDD Design Manual categorizes
permitted land uses according to the Standard Industrial Classification
Manual(SIC)prepared by the Federal Office of Budget and
Management. Using the SIC allows staff to more clearly determine the
land use category into which a specific proposed use would fall to
determine whether or not that use is allowed.
The SIC categories used in the EDD Design Manual are:
Residential
Agricultural,Forestry and Fishing
Construction
Manufacturing,Assembly and Processing
Transportation,Communication and Utilities
Finance,Insurance and Real Estate
Retail Trade
Services
Government
The Design Manual includes various tables and text which specify the
standards applicable to various land uses. However,the land uses
listed in some of the tables do not correspond with the land uses listed
in the Permitted Use Table. It can be difficult to determine the
category into which a proposed use falls for the purpose of determining
whether or not it is allowed in a specific EDD,and which standards
should be applied
The proposed amendment renames the Iand uses listed in the following
tables to correspond with the land uses listed in the Permitted Use
Table:
a)Minimum Required Site Volume Ratios(page 2.3.10)
b)Off-Street Packing Requirements for Selected Land Uses(page
3.3.7)

John Link noted that information about the Carrboro loan program was included in
the agenda packet. Commissioner Halkiotis asked that the person who administers the
Carrboro program be requested to attend their next meeting to give a verbal report and to
answer questions.
Commissioner Carey asked that the County Commissioners consider moving ahead
to approve this program. He feels that there are businesses which would like to use this
program when it is approved.
Commissioner Brown said that she feel the program needs more creativity. She
supports a loan program but needs more specifics. She has questions about several of the
definitions and asked if additional information could be brought back about the composition and
how people would find out about this program.
Commissioner Carey made a motion to approve the program with the changes as
mentioned by Commissioner Gordon and Commissioner Brown. This motion was seconded
by Chair Crowther.
VOTE: AYES, 2; NOS, 3 (Commissioners Brown, Gordon and Halkiotis)
It was decided that this item will be brought back as soon as possible with additional
information as requested by Commissioners Brown, Gordon and Halkiotis.
D. ZONING ORDINANCE TEXT AMENDMENT_EDD DESIGN MANUAL
PERMITTED USES
Mary Willis presented background information on this item. This proposed
amendment would replace land use categories referenced in various text and tables in the
Design Manual to match those found in the Permitted Use Table.
A motion was made by Commissioner Halkiotis, seconded by Chair Crowther to
close the public hearing and to approve the proposed amendment per the Planning Board
recommendation.
VOTE: UNANIMOUS
E. ZONING ORDINANCE TEXT AMENDMENT_ EDD DESIGN MANUAL_
PERIMETER BUFFER
Planner Mary Willis explained that this amendment would eliminate the 100-foot
buffer requirement along the perimeter of an Economic Development District which abuts an
EDD adopted by another planning jurisdiction.
A motion was made by Commissioner Carey, seconded by Commissioner Halkiotis
to close the public hearing and approve the proposed amendment per the Planning Board
recommendation.
VOTE: AYES, 3; NOS, 2 (Commissioners Brown and Gordon)
F. ADVERTISEMENT FOR PUBLIC HEARING_AUGUST 25, 1997
A motion was made by Commissioner Halkiotis, seconded by Commissioner Carey
to approve the notice as presented with the deletion of the first item - SUP(A)-4-97 Local
Government Employees Credit Union.
