PURPOSE: To approve the advertisement for the August 25, 1997 quarterly public hearing.
BACKGROUND: The next regular quarterly public hearing is scheduled for August 25, 1997. A
summary of each item proposed for public hearing is provided below. The
proposed legal advertisement, the text of proposed ordinance amendments, and
other background information are attached.
SPECIAL USE PERMITS
1. SUP(A)4-97 Local Government Employees Credit Union
Request for a Special Use Permit to construct a 4800 square-foot credit
union facility with drive-through window on 2.07 acres at the southwest
corner of Old NC 86 and Oakdale Drive (4.44.B.22,23) The property is
located in the Economic Development District. Development projects in the
Economic Development District (EDD) which do not meet all standards
specified in the EDD Design Manual may be approved by the Board of
Commissioners as a Special Use. The applicant is requesting Special Use
Permit approval because the proposed development project does not meet all
of the standards specified in the EDD Design Manual, including the
requirement for a 100--foot buffer around the perimeter of the Economic
Development District, and the requirement that parking areas be located to
the rear of the building.

ZONING ORDINANCE TEXT AMENDMENTS
1. Agricultural Service Zoning District
The proposed amendment will:
a) change the defnution of"Agricultural Services";
b) create a definition for"Riding Stable";
c) revise the list of uses permitted in the Agricultural Service(AS)
zoning district;and
d) allow agricultural service uses in the General Commercial zoning
district.
2. Golf Courses
Regulations and approval procedures for golf courses were adopted on
May 21, 1997. The proposed amendment will:
a) clarify the status of existing golf courses in relation to the new
regulations; and
b) establish criteria for evaluating changes to Special Use Permits
approved for golf courses.
HISTORIC LANDMARKS DESIGNATION PROGRAM
Request by the Orange County Historic Preservation Commission to adopt a
program for the designation of local historic landmarks. Local landmark
designation is fundamental to implement the goals and objectives of the
Historic Preservation Element of the Comprehensive Plan. The Planning
Department has prepared a report, Preserving the Orange Tradition: A
Landmarks Designation Program for Orange County, which describes the
proposed landmark designation program.
NATIONAL REGISTER NOMINATION
1. Cedar Grove National Register Nomination
Public hearing before the Orange County Board of Commissioners and
Orange County Historic Preservation Commission(HPC)to receive
citizen comment on the proposed nomination of the Cedar Grove
Crossroads area to the National Register of Historic Places. After
consideration of citizen comments and a recommendation by the HPC,
the Board of Commissioners may make a recommendation on the
proposed nomination to the NC Department of Cultural Resources.
RECOMMENDATION: The Administration recommends approval of the attached advertisement
for the August 25, 1997 quarterly public hearing.

NOTICE OF PUBLIC HEARING
ORANGE COUNTY BOARD OF COMMISSIONERS
A public hearing will be held in the Superior Courtroom of the New Orange County Courthouse,
106 E. Margaret Lane, Hillsborough, North Carolina, on Monday, August 25, 1997 at 7:30 p.m.
for the purpose of giving all interested citizens an opportunity to speak for or against the following
items:
CLASS A SPECIAL USE PERMIT
1. SUP(A)4-97 State Employees' Credit Union
The property is located on the southwest corner of Old Hillsborough-Chapel Hill Road and
Oakdale Drive, in Hillsborough Township. It contains 2.07 acres and is identified as Lots
22 and 23, Tax Map 44, Block B, in Hillsborough Township. The property is in the
Economic Development District zoning district. The applicant is requesting a Class A
Special Use Permit to construct a 4,900 square-foot credit union facility, including drive-
thru window. The proposal must receive approval of a Special Use Permit by the Board of
Commissioners because not all of the standards specified in the EDD Design Manual are
met, including, but not limited to, the requirement for a 100-foot buffer around the
perimeter of the Economic Development District, and the requirement that parking areas be
located to the rear of the building.
ORANGE COUNTY ZONING ORDINANCE E TEXT AMENDMENTS
1 Amend ARTICLE 4.3 PERMITTED USES to: include Extraction of Earth Products as a
Class A Special Use in the Agricultural Services zoning district; include Agricultural
Services as a permitted use in the GC4 General Commercial zoning district; include
Animal Hospitals and Veterinarians as permitted uses in the Agricultural Services zoning
district; and eliminate: Storage of Goods, Outdoor; Storage and Warehousing, Inside
Building; and Art Studio from the list of uses permitted in the Agricultural Services zoning
district.
2. Amend ARTICLE 8.8.7 GOLF COURSES to specify approval procedures applicable to
the modification to or expansion of existing golf courses.
3. Amend ARTICLE 22 DEFINITIONS to revise the definition of "Agricultural Services"
and add a definition of"Riding Stable".
HISTORIC LANDMARKS DESIGNATION PROG M
1 . Adopt a program to designate Historic Landmarks in Orange County. The Ordinance
Creating the Historic Preservation Commission (HPC) of Orange County, adopted in
April, 1991, authorizes the HPC to recommend to the County Commissioners individual

buildings, structures, and sites to be designated by ordinance as "historic landmarks".
Local landmark designation is fundamental to implementing the goals and objectives of
the Historic Preservation Element of the Comprehensive Plan. The Planning Department
has prepared a report, Preserving the Orange Tradition: A Landmarks Designation
Program for Orange County, which provides an in-depth discussion of the designation of
historic landmarks. Landmark designation is the formal recognition of a property's
importance to the history and cultural heritage of Orange County. Historic landmark
designation would occur by adoption of an ordinance by the Board of Commissioners.
Participation in the landmark designation program would be voluntary. The program is
voluntary and the HPC will invite owners of eligible properties to participate.
NATIONAL REGISTER NOMINATION
Pursuant to the requirements of the Certification Agreement for Local Governments between
Orange County and the State Historic Preservation Office of the NC Dept. of Cultural Resources,
a public hearing to receive citizen comment on the following nomination to the National Register
of Historic Places will be held before both the Orange County Board of Commissioners and the
Orange County Historic Preservation Commission.
The National Register of Historic Places is the United State's official list of buildings, structures,
sites, and districts that are deemed significant to the Nation's heritage. Listing on the National
Register of Historic Places is an honorary designation that places no obligation or restrictions on
private property owners.
1. HP-1-97 Cedar Grove Rural Crossroads National Register Historic District
The proposed Cedar Grove Rural Crossroads National Register Historic District is
located in the Cedar Grove Township at the intersection of Carr Store Road and Efland-
Cedar Grove Road. The district encompasses approximately 82 acres and contains 28
primary structures. The district is also described as being all or part of the following
properties as noted by tax map reference numbers: Map 32, Lots 14, 15, 17, 18, 19, 19A,
20, 20A, 22, 23, 23A, 23B, 24, 25, 26, 26A, 27, 27A, 27B, 27C, 29, 30, 39, 39A; Map
38, Lot 2; and Map 39, Lot 3.
The specific text amendments proposed as described in this notice are available for public
inspection at the Orange County Planning Department.
All interested citizens are invited to attend this hearing and be heard. Public comment will be
received during the public hearing. Following the close of the public hearing, only evidence
received in writing by the date of the Planning Board meeting following the public hearing will be
considered by the Board of Commissioners for decision.
Changes may be made in the advertised proposals which reflect debate, objections and discussion at
the hearing.

Purpose of Amendment: To revise the definition of agricultural services, provide a definition of riding
stable, amend the list of permitted uses allowed in the Agricultural Service zoning district, and allow
Agricultural Service Uses in the General Commercial zoning district.
Impacts/Issues: When the Zoning Ordinance was first adopted in 1981,the Agricultural Service(AS)
District was included in Article 4 with the following description of intent This language remains unchanged
in the Ordinance:
The purpose of the Agricultural Service(AS)District is to provide sites in the rural portion of the
County for rural non-farm,non-residential uses which support the horticultural, silvicultural,and
agricultural uses of the Agricultural Residential districts.
Agricultural service uses are also known as"agribusiness,"uses generally considered commercial,not
agricultural. Their function can be summarized as supportive in the production of agricultural products or in
the processing of those products to make them marketable. In the Zoning Ordinance, "agricultural services"
are described as"commercial services such as soil preparation,crop,veterinary,animal and farm
management, landscaping and horticultural services, specialized commercial horticulture,and specialized
animal husbandry."
Land uses allowed in the AS District currently include:

Accessory Uses Feed, Seed Storage and Processing
Botanical Gardens and Arboretums Greenhouses
Bus Passenger Shelter Commercial Feeder Operation
Church Class I Kennels
Governmental Protective Services Sawmills

Some of the uses listed above such as governmental services,churches,and bus passenger shelters are not
directly supportive of agriculture,but are uses permitted in almost all zoning districts.
Because of its specific, support service-oriented nature,Agricultural Service is the only non-residential
zoning district allowed in the Agricultural-Residential Land Use Plan category outside of designated
commercial activity nodes. In much of the County's jurisdiction(at least 63 0/6),land may be rezoned to AS
without a Comprehensive Plan amendment. Consequently, it is important to adhere to the intent of the
district when reviewing permitted uses, so that inappropriate,non-rural uses generating negative impacts to
farming operations are not located throughout the county.
This policy is articulated in the Land Use Element of the Comprehensive Plan with the following objective
under Goal Seven:
Encourage agricultural-related commercial and industrial uses consistent with the zoning district
Agricultural Service(AS)to locate at activity nodes,but allow their occurrence anywhere in the
Agricultural-Residential plan areas.
The existing definition of agricultural services in the Zoning Ordinance only lists examples of that type of
use. The proposed amendment is to revise the definition by adding language to define the category of land
use and list additional appropriate uses as examples. Since"agricultural service uses"is a listing on the
Permitted Use Table in Article 4,the examples listed under the definitions will be incorporated by reference
as permitted uses.
As part of the proposed amendment,the Permitted Use Table will be revised to allow AS uses in the General
Commercial zoning district. Three uses that are not consistent with the intent of the AS district will be
deleted from the list of permitted uses in that district. Other changes are listed below.
A definition of riding stable is proposed to make clear the intent of the ordinance to regulate stables as a
commercial use,not to require a special use permit for stables as accessory uses to a private resience or farm.

Purpose of Amendment: To a) provide consistency in the ordinance regarding expansion and
modification of existing golf courses and b) to establish appropriate criteria for evaluating changes
to Special Use Permits issued for golf courses.
Background: During preparation and review of the recently adopted standards and approval
procedures for golf courses,the Golf Course Amendment Review Task Force(Golf CART)and the
County Attorney recommended review of other sections of the Zoning Ordinance. The two sections
noted are 1)Article 8.7.1 which affects changes to a golf course approved with a special use permit
under the new regulations in Article 8.8.7 and 2) Article 11, Non-conformities, as it applies to
existing golf courses.
Article 8.7 of the Zoning Ordinance contains provisions for changing a Special Use Permit after the
original approval. Minor changes may be approved by the Zoning Officer, while modifications
defined by the ten criteria in Section 8.7.1 are subject to review at a public hearing before the Board
which approved the original application. The Golf CART was concerned that some of the criteria
used to distinguish a Special Use Permit modification requiring Board approval from a minor
change would not be appropriate when applied to a project with the size and complexity of a golf
course.
For example,an increase in usable floor area or an increase in the size or number of approved signs
constitutes a modification requiring a public hearing. Given that 1) floor area is not an appropriate
measure of the intensity of a golf course as a land use, and 2) a golf course typically includes
numerous signs that are not visible from a public road, it is reasonable to re-evaluate the current
criteria listed in Article 8.7.1 in the context of a golf course so that changes which are small in
proportion to the use are considered minor and eligible for administrative review. The proposed
amendment is incorporated in the "Applicability" section of the new golf course regulations, rather
than include provisions for changes to a specific type of Class A Special Use Permit in Article 8.7,
which applies to all special use permits.

The second part of the amendment affects existing golf courses. There are two existing golf
courses in Orange County's planning jurisdiction. The Golf CART was very careful in crafting
the new regulations to insure that existing golf course owners could make some changes or
improvements to their facilities without meeting all of the special use permit requirements
applied to new courses. Article 11.6 in the"Non-conformities" section of the Zoning Ordinance
makes an existing use that would require a special use permit conforming at the time new
regulations are adopted with the condition that any enlargement, replacement or modification of
the use requires a special use permit.
The"Applicability" section of the recently adopted Article 8.8.7 Golf Courses states that the new
standards shall be applied to existing courses only"when fifty percent or more of the total
playable acreage of golf holes is concurrently reconstructed or altered, or if an equivalent amount
of playable acreage is added to an existing course."Playable acreage is defined as tees, greens,
fairways, and roughs.
The proposed amendment to Article 8.8.7.1 will a)establish the effective date of the ordinance,
5/21/97, as the point at which existing playable acreage is measured and b)make the intent clear
that the threshold established by Article 8.8.7.1 takes precedence over the provisions of Article
11.6 when applying zoning regulations to an existing golf course.

regulating the location, planning, design, construction, operation, and maintenance
of golf courses and associated uses.
Applicability
The standards contained herein shall apply to all new golf courses, whether
proposed as a principal use or as an accessory use which is part of a residential
subdivision,or included in a Planned Development District.
Notwithstanding the provisions of Article 11.6. £erg golf courses which
existed prior to MU 21. 1997. shall comply with the requirements of this article `
when fifty percent or more of the total playable acreage of golf holes is

concurrently reconstructed or altered, or if fifty percent-an equivalent afaeunt of
playable acreage is added to an existing course. Playable acreage includes all
tees, greens, fairways, and roughs measured as of May 21, 1997.
�. Changes to Approved Spgcial Use Permits
In accordance with Article 8.7—the Zoning Officer is authorized to approve
minor changes in the approved plans of Sptcial Uses,provided the changes are
in harmony with the original approval. Before changes to an =roved Sp&cial
Use Permit may be considered, updaks of submittal materials such as the
environmental assessment, biological inventory, or resources management plan
may be required, In lieu of the criteria established in Article 8.7.1. the following
criteria shall be used to determine when proposed changes to a Special Use
Permit for -a golf course shall regie approval of the Board of County
Commissioners:
1)Any change in a condition of approval. including any reduction in a setback:
An increase in playable acreage of golf holes by more than ten(10)percent.
Playable acreage shall include all tees. greens- fairways, and roughs as
shown on the on the first site plan approved:
3) Any new use not included in the approved Special Use Permit or substantial
expansion of an approved use that does not involve floor area:
4) An increase by 25 percent or more in total floor area of all structures shown
on the first site plan approved.either in a new structure or as an addition(s, to
an approved structure(s):
5)An increase in parking by ten 10)percent or more of the parking shown on
the first site plan approved:
6)Substantial changes in pedestrian and/or vehicular access or circulation; and
7)A change in the location or extent of street and utility improvements or
rights-of--way. including water- sewer and storm drainage facilities.which
would provide a different level of service and that is not associated with a
less than ten percent increase in playable acreage.
