BACKGROUND: Pursuant to G.S. 14-413 and G.S. 14-414, which statutes outline the Board's responsibilities in issuing pyrotechnics permits, Abundant Life Church has requested that the County Commissioners approve a pyrotechnics permit for the fireworks display which is scheduled for July 4, 1997. Specifics of the event are as follows: • The event will be held at the Church in the parking lot area. • Nick Waters has investigated the area and indicates that there is sufficient area for the type of fireworks which are planned for use. • Waters has also been assured by the appropriate agencies that sufficient coverage will be provided to ensure that public safety issues are met. The Fire Marshal's office will follow up the day of the event to ensure these measures are in place. • Pyrotechnics to be used include: Ten (10) 3"shells; and 400 miscellaneous pieces of Class C fireworks. Class C fireworks are one step above fireworks which are sold in local stores and include such items as sparklers, streamers, etc. The Church and Jack Davis, Mopaco Pyroco, the pyrotechnic company, are working together to provide insurance coverage, however, an appropriate certificate of insurance has yet to be delivered to the Purchasing Director. Approval of the pyrotechnics permit is 2 r conditioned on the delivery of an acceptable certificate of insurance which appropriately covers Mopaco Pyroco and names the County as an additional insured. RECOMMENDATION: The Manager recommends that the Board approve the pyrotechnics permit for Abundant Life Church for their fireworks display to occur July 4, 1997, contingent upon receipt of appropriate proof of insurance; and authorize the staff to sign off on the permit form as indicated. 06/30/97 4:54 PM • 3 PYROTECHNICS PERMIT CHECKLIST North Carolina General Statue 14-413 empowers County Commissioners in the State to issue permits for the use of pyrotechnics in connection with shows of all descriptions after satisfactory evidence is produced to the effect that the pyrotechnics will be used for the aforementioned purposes and no others. The Orange County Commissioners have adopted a policy which cites the completion of the following criteria as prerequisite to the issuance of a pyrotechnics permit. Verification of the receipt of information will be evidenced by the signature of the appropriate official on this form. Only after all criteria listed below have been met will the permit be issued. It should be further noted that all signatures must be written on the face of the permit in order for the permit to be valid. Penalties for use of pyrotechnics without a permit are cited in the North Carolina Building Code,Administration and Enforcement,Volume 1A,Chapter 8.1. CRITERIA APPROVED BY DATE 1. Class C fireworks are one step above fireworks which are sold in local stores and include such items as sparklers, streamers, etc. PYROTECHNICS PERMIT ORIGINAL SIGNATURES; COPY 1 COUNTY OF ORANGE NORTH CAROLINA Pursuant to G.S. 14-413, Commissioners in North Carolina Counties are empowered to authorize and issue permits for the use of pyrotechnics in connection with "...shows of all descriptions...but only after satisfactory evidence is produced to the effect that said pyrotechnics will be used for the aforementioned purposes and none other". On June 30, 1997, Abundant Life Church, Inc., Hillsborough, NC was approved for a pyrotechnic permit to be used in association with a July 4th Celebration on July 4, 1997 upon the church grounds on Highway 70A, Hillsborough. The approval is granted based on the following assurances from the requestor: Public Safety personnel will be on site during the event to ensure public safety and to provide adequate traffic control; Proof of Liability insurance which includes the County as a named insured, has been submitted to the Orange County Director of Purchasing and Central Services. Limits of liability are no less than $1,000,000 per occurrence. Show setup will be approved by the Orange County Fire Marshal or his designee, prior to the beginning of show. Permitted explosives include those listed on attachment#1, as submitted by Jack Davis, Mopaco Pyroco, Hillborough, NC. Abundant Life Church has a current fire inspection and is in compliance with the Standard Fire • Prevention Code, 1988, with North Carolina amendments. Director of Purchasing signs after certification that checklist criteria has been met. 2. Orange County Manager signs. 3. Fire Official signs,upon approval of the site set up prior to the event. 4. Emergency Management Director signs after assurance from Fire Official that requirements of the Standard Fire Prevention Code as it respects the use of pyrotechnics has been met. . 5. Emergency Management Director provides one copy of permit to show sponsor and returns one copy to the Director of Purchasing for records maintenance.
