Background: Medical coverage for events held at the Speedway was directly provided last year(1996) by Orange County Emergency Management as Orange County Rescue Squad was unable to provide this coverage. Adequate and appropriate medical coverage must be provided for the citizens and visitors attending events at the Speedway. Staff have met with racetrack officials to work out operational and fiscal issues concerning the contract and have reached a satisfactory agreement. Recommendation: The Manager recommends that the Board approve the contract and authorize the Chair to sign. 2 t STATE OF NORTH CAROLINA ORANGE COUNTY This Contract dated March 17, 1997, between OCS Management, LLC, dba Orange County Speedway (the "Speedway") and the County of Orange (the "County") for joint and cooperative arrangements for the provision of emergency medical services at certain Speedway events. WITNESSETH WHEREAS, the County and the Speedway have cooperated and worked jointly on matters of concern or interest; and WHEREAS, certain events at the Speedway bring spectators to Orange County to en j oy the events; and WHEREAS,the provision of adequate emergency medical care at such events is a matter of mutual concern and interest to the Speedway and the County; and WHEREAS, detailed joint and cooperative arrangements with respect to such events will mutually benefit the Speedway and the County; and WHEREAS,the County and The Speedway desire to provide such cooperative emergency medical care; NOW THEREFORE, in consideration of the premises and the mutual covenants and conditions set forth below,the County and the Speedway agree as follows: 1. The County agrees to provide emergency care providers certified at the Emergency Medical Technician and/or Paramedic level for the twenty-one (21) 1997 Speedway events as outlined in the Orange County Speedway 1997 Schedule. (Exhibit A) 3 2 2. The County agrees to provide one (1) ambulance staffed with one (1) Paramedic and two (2) Emergency Medical Technicians (minimally) for four(4) 1997 events (3-29, 4-11, 8-2, and 8-30) and two ambulances staffed with one (1) Paramedic and two (2) Emergency Medical Technicians for seventeen(17) 1997 events (4-5, 4-12, 4-26, 5-10, 5-31, 6-14, 6-21, 7-3, 7-12, 7-26, 8-3, 8-9, 8-16, 8-24, 9-13, 9-20, and 10-4). Additional coverage will be negotiated between the County and the Speedway at the time of need. 3. The County agrees to keep records of patients seen at the Speedway while covering Speedway events under this contract and, with the consent of the patient, to provide such records to the Speedway, upon its request. Data available to the County from the records of patients seen at the Speedway which is clearly not patient identifying may be provided to the Speedway, upon request of the Speedway and when appropriate. 4. The Speedway shall compensate the County for emergency medical services provided pursuant to this contract by paying to the County a sum based on a rate of $42.75 per hour for each event covered. These hours will include preparation and travel time of two (2)hours for each event plus the coverage time per event. The county shall submit an invoice for these events on a monthly basis and payment by the Speedway shall be made to the order of the County and mailed to Orange County Emergency Management , P. O. Box 8181, Hillsborough,N. C. 27278. 5. The personnel providing the emergency services shall report to the Speedway at the time agreed upon by the Speedway and the County. 4 6. The contract may be reviewed annually no later than March 1, and may be renewed, modified, or amended at that time, or at any other time, upon the mutual written agreement of the parties. 7. This contract may be terminated at any time by either party by giving 90 days notice to the other party in writing. 8. If either party defaults in its obligations and does not cure such default within ten(10) days of receipt of notice of such default,the non-defaulting party may immediately terminate the contract.
