PURPOSE:
1) To approve the Environmental Assessment Checklist and authorize the Chair to sign the
document on behalf of the Board;
2) To authorize publication of a Combined Notice to the Public of No Significant Impact on the
Environment and Notice to the Public of Request for Release of Funds; and
3) To authorize the execution of the Request for Release of Funds for the Efland Estates CDBG
Program.
BACKGROUND:
In August 1996, the County was granted $145,750 in Community Development Block Grant
(CDBG) funds to provide the public water and sewer and street paving for a small, nine (9) single
family unit subdivision being developed by Habitat for Humanity of Orange County, Inc. in the
Efland community. As a condition of the County's CDBG award, the N.C. Department of
Commerce requires that an Environmental Review Checklist be completed by the grantee.
County staff has completed this checklist and determined that the proposed project will have no
significant impact on the present environment. The Environmental Review Checklist has been
completed to document the stafl's finding. This document must be approved by the Board of
County Commissioners and executed by the Chair prior to submission to the N.C. Department of
Commerce. Having completed the Environmental Checklist, the County can request the release of
funds for this activity utilizing the attached Request for Release of Funds form.
Further, the County is also required to publish a Notice of No Significant Impact on the Environment
and Notice to Public of Request for Release of Funds. The notice is attached in the format
prescribed by the State Community Development office. Upon approval, this notice will be
published on or about April 3, 1997 in the Durham Morning Herald. The public will have a 15 day
comment period.

RECOMMENDATION(S):
The Manager recommends the following action for the Efland Estates CDBG Program:
1) Approve the Environmental Assessment Checklist and authorize the Chair to sign the document
on behalf of the Board;
2) Authorize publication of a Combined Notice to the Public of No Significant Impact on the
Environment and Notice to the Public of Request for Release of Funds; and
3) Authorize the execution of the Request for Release of Funds.

side. Habitat plans to build three and four bedroom houses r ze from 1,050 to 1,200 square feet in size
and make these homes affordable to first-time homeb incomes of at least 50 percent of area median

SUBJECT: Rare Species, High Quality Natural Communities, and Significant Natural
Areas in the Proposed Efland Estate Subdivision, Orange County, North
Carolina
Dear Ms. Fikes:
The North Carolina Natural Heritage Program does not have records of known raze species, high
quality natural communities,or significant natural areas occurring at or within a 1-mile radius of the
Efland Estates subdivision project area. To our knowledge, this project area has not been
systematically inventoried and we cannot definitively state that raze species or significant natural
areas do not occur there.
Enclosed is a list of rare species that are known to occur in Orange County. If suitable habitat for
any of these species occurs in the project area,then those species may be present at the project site.
If it is necessary to be certain that this site does not contain rare species, a field survey would need
to be conducted.

The county species list from the NC Natural Heritage Program is a listing of the elements (rare species, natural communities,
geologic features, and special animal habitats) known to occur in a county. The information on this printout is compiled from a
variety of sources, including field surveys, museums and herbaria, literature, and personal communications. The Heritage
Program's Biological and Conservation Database (BCD) is dynamic, with new records being added and old records being revised
as new information is received. The BCD was developed and is being maintained using methodology developed by The Nature
Conservancy. The enclosed list cannot be considered a definitive record of natural heritage elements, and it should not be
considered a substitute for field surveys. When this information is used in any document, we request that the printout date be
given and that the NC Natural Heritage Program be credited.

FEDERAL PROTECTION
This status is designated by the US Fish and Wildlife Service. Federally listed Endangered and Threatened species are protected
under the provisions of the Endangered Species Act of 1973, as amended through the 100th Congress. Unless otherwise noted,
definitions are taken from the Federal Register, Vol. 56, No. 225, November 21, 1991 (50 CFR Part 17).

E Endangered A taxon "in danger of extinction throughout all of a significant portion of its range."
T Threatened A taxon "likely to become an endangered species within the foreseeable future throughout all of a
significant portion of its range."

C Candidate A taxon under consideration for which there is sufficient information to support listing. This category

FSC Federal Formerly defined as a taxon under consideration for which there is insufficient information to support
Species of listing,:formerly designated as a Candidate 2 (C2) species. Currently, the US Fish and Wildlife Service
Concern does not recognize this designation.
T(S/A) - In reference to the American alligator- this species is threatened due to similarity of appearance with
other rare crocodilians and is listed for trade purposes. The species is no longer biologically endangered
or threatened and is not subject to Section 7 consultation.
Please note that the US Fish and Wildlife Service no longer recognizes the following categories:
3A Candidate 3A A taxon formerly under consideration for listing, but for which there is "persuasive evidence of
extinction.'
3B Candidate 3B A taxon formerly under consideration for listing, but which current taxonomic understanding does not
support as a distinct entity meeting the Endangered Species Act's definition of "species."
3C Candidate 3C A taxon formerly under consideration for listing, but which has been "proven to more abundant or

The Hazardous Waste Section has reviewed the noted project and
offers the following comments:
There are numerous RCRA hazardous waste generating facilities
(small and large generators) in the Orange County area, but we do
not believe there are any located near the proposed Ef land Estates
subdivision project. I do not believe that this project will
conflict with any hazardous waste generator facility.

The Solid Waste Section has reviewed the attached project proposal and has seen no
adverse impact on the surrounding community and likewise knows of no situations in the
community which would affect the project. `
Orange County should make every feasible effort to minimize the generation of waste, to
recycle materials for which viable markets exist, and to use recycled products and materials in the
development of this project where suitable. Any inert debris generated by this project should be
beneficially reused, and any waste generated must be discarded at a properly permitted facility if it
cannot be recycled.

SUBJECT: Orange County Community Development Block Grant for Efland Estates
I have completed the review of the attached information on the subject project for the
proximity to CERCLIS or inactive hazardous waste sites. The subject block grant intends to provide
financial assistance to expand public water and sewer with street paving for a nine single family unit
subdivision,known as Efland Estates. The 4.67 acre subdivision is being developed by Habitat for
Humanity of Orange County. Two CERCLIS sites were located in the project vicinity within a four-
mile radius.
The White Furniture Company Site(NCD 003 220 969) is located four miles west of the
subject project in Mebane. A 10,000 square foot area where drums were stored has contaminated
surface soil consisting of metals and polycyclic aromatic hydrocarbons. Metals were also found on
site in subsurface soils, sediment samples, surface water and groundwater. Polycyclic aromatic
hydrocarbons were only found in surface soils and sediments. Since receptors are distant from this
contamination,this site has been removed from the CERCLIS list. The NC Inactive Hazardous Sites
Branch is reviewing the voluntary remediation initiated by White Furniture Company that is in
progress.
The General Electric Company/Mebane Operations Site (NCD 057 037 194) is located 2
miles southwest of the subject project. GE buried wastewater sludge from electroplating in unlined
trenches on the site. Barium and zinc were found in groundwater. Ditch sediments indicate
chromium and a=smic contamination. This site has received a federal status of No Further Remedial
Action Planned. The NC Inactive Hazardous Sites Branch and GE have negotiated an Interim
Removal Action to excavate these trenches which is now underway.
After reviewing the file information,I believe it is unlikely that the project will affect the site
or vice versa. If you have any questions,please call me at ext. 314.

I have reviewed the information provided in your letter dated
January 10, 1997. From the information that you provide it is
unclear if there are any environmental problems. However, please
consider the following issues :
As with any residence, it is necessary to have available
appropriate methods to manage the wastewater that is generated
( it is not clear how this is being accomplished from your
letter) . It was stated in your letter that sewer lines were
being constructed. These sewer lines must be constructed as
per approved engineering protocols and the wastewater
treatment plant receiving the waste must have the flow
capacity to treat the subject waste. Also in order to insure
compliance please call the Permits and Engineering Section,
with the Division of Water Quality at ( 919) 733-5083 and
request an application for construction authorization for the
sewer line (note: this must be accomplished prior to building
the sewer line) .
I also recommend that you contact the Orange County Erosion
Control Division at (919) 732-8181 to determine if this
project will need a Sediment and Erosion Control Plan.
In addition, you did not provide any information on whether
wetland impacts will occur. You should determine if wetland
issues are a concern and apply for the necessary permits with
both the Corp of Engineers (919) 876-8441 and with the
Division of Water Quality (919) 733-1786 .

Division of Community Assistance to release Federal funds under Title I of the Housing

Purpose of Noti ce
This Notice is intended to meet two separate procedural requirements of 24 CFR Part 58:
(1) To provide notice to the public that Orange County has determined that the request for
release of funds for the above named project will not have a significant impact on the
environment, (2) To provide notice to the public that Orange County is requesting the
release of funds for the above named project.
Finding of No Significant Impact
It has been determined that such request for release of funds will not constitute an action
significantly affecting the quality of the human environment and accordingly the above
named county has decided not to prepare an Environmental Impact Statement under the
National Environmental Policy Act of 1969 (PL 91-190). The reason for such decision
not to prepare such statement is as follows: The County has determined that the proposed
project will not significantly affect the quality of the human environment.
An Environmental Review Record respecting the above project has been made by the
above-named County which documents the environmental review of the project and more
fully sets forth the reasons why such Statement is not required. This Environmental

Review Record is on file at the above address and is available for public examination and
copying upon request at Room A-25 between the hours of 8 am and 5 PM.
No further environmental review of such project is proposed to be conducted prior to the
request for release of Federal funds.
Public Comments on Finding
All interested agencies, groups and persons disagreeing with this decision are invited to
submit written comments for consideration by the County to the Chair of the Orange
County Board of County Commissioners. Such written comments should be received at
200 S. Cameron St., Hillsborough, NC 27278 on or before April 18, 1997. All such
comments so received will be considered and the County will not request the release of
Federal funds or take any administrative action on the within project prior to the date
specified in the preceding sentence.
Release of Funds
Orange County will undertake the project described above with Block Grant funds from
the North Carolina Division of Community Assistance under Title I of the Housing and
Community Development Act of 1974. Orange County is certifying to DCA that Orange
County and William Crowther, in his official capacity as Chair of the Orange County
Board of County Commissioners consent to accept the jurisdiction of the Federal courts if
an action is brought to enforce the responsibilities in relation to environmental reviews,
decision making and action; and that these responsibilities have been satisfied. The legal
effect of the certification is that upon its approval Orange County may use the Block
Grant funds and DCA will have satisfied its responsibilities under the National
Environmental Policy Act of 1969.
OBJECTIONS TO STATE RELEASE OF FUNDS
DCA will accept an objection to its approval only if it is on one of the following bases:-(a)
that the certification was not in fact executed by the certifying official or other officer of
applicant approved by DCA; or (b) that applicant's environmental review record for the
project indicates omission of a required decision, finding or step applicable to the project
in the environmental review process. Objections must be prepared and submitted in
accordance with the required procedure (24 CFR Part 58) and may be addressed to DCA
at P.O. Box 12600,Raleigh,North Carolina 27605-2600.
Objections to the release of funds on bases other than those stated above will not be
considered by DCA. No objection received after May 4, 1997 will be considered by DCA.
Comments must specify whether they concern the finding of no significant impact or the
intent to request release of funds.
