BACKGROUND: The Inn at Bingham School is an existing historic site located in western Bingham Township and listed on the National Register of Historic Places. On September 30, 1985, the Board of County Commissioners approved a Class A Special Use Permit for the site to be operated as a bed and breakfast inn. Article 8.8.24.2 of the Zoning Ordinance establishes a six-year time limit on this type of Special Use Permit. The owners who purchased the property in 1994 are now requesting renewal of the permit. The property is located at the northeast corner of the intersection of NC Highway 54 West and Mebane Oaks Road(SR 1007). The current zoning is Agricultural Residential and.Cane Creek Protected Watershed. The parcel contains 9.98 acres and is referenced as lot 19 on Tax Map 17. The inn remains in compliance with the conditions of the original Special Use Permit. A draft of the renewed permit is in the attachments and includes language to allow the owners to host outdoor receptions for guests staying at the inn. It also would allow an existing smokehouse to be converted to U3� rest room facilities, pending approval of the Orange County Health Department, Division of Environmental Health, and the Inspections Division of the Planning Department. Findings of fact demonstrating compliance with Zoning Ordinance requirements are included in the attachments. The Orange County Sheriff and Emergency Management were notified of the request for renewal of the Special Use Permit. Each responded that service could continue to be provided without additional personnel or equipment. RECOMMENDATION: Article 8.4.3 of the Zoning Ordinance requires that the Zoning Officer's recommendation be presented to the Planning Board within 45 days of receipt of an application. The 45-day period may be extended up to 60 days with the written consent of the applicant. The public hearing is the time scheduled for presentation of the Zoning Officer's recommendation. Zoning Q62cer's Recommendation The Zoning Officer has not received information which would establish grounds for making a negative finding on the general standards. These standards include maintaining or promoting the public health, safety, and general welfare, maintaining or enhancing the value of contiguous property, and the use being in compliance with the general plan for the physical development of the County. The Zoning Officer has reviewed the application, the site plan and all supporting documentation and has found that the application does comply with the specific standards and required regulations concerning the Special Use Permit. Provided the Planning Board and the County Commissioners find in the affirmative on the general standards, the Zoning Officer recommends approval of the request. _ No decision on the application is made by either the Planning Board or the Board of Commissioners at the public hearing. Instead, the Planning Board has 60 days within which to prepare and submit a recommendation to the Board of Commissioners. Failure of the Planning Board to submit a recommendation within the required time shall be considered a favorable recommendation,without conditions. TERMS AND CONDITIONS The Board of Commissioners of Orange County approved granting a(Class A Special Use Permit) on May 5, 1997. The property subject to the Special Use Permit is owned by Francois X. and Christina H. Deprez and particularly described in a deed from Elaine C. Horner recorded in Deed Book 450 Page 562, of the Orange County Registry and in the plat recorded at Plat Book 27, Page 79 of the Orange County Registry. The terms herein contained are binding on the present owners,their successors in title and interest, until such time as the conditions herein are otherwise changed by government action. The property subject to the Special Use Permit shall be used in accordance with the Site Plan for the Bingham School Inn dated July 12, 1985, prepared by ENT Land Surveys, Inc., the narrative statement of the project and all other documents pertaining to the project, including all erosion control plans, utilities plans, and building plans, all of which are incorporated herein and made a part of this Special Use Permit. The Special Use Permit also allows the owners to host outdoor receptions for guests at the inn, provided all food for such events is catered, the kitchen and septic system are not used for the receptions, and the Orange County Division of Environmental Health approves the use of portable toilets for each event. The property subject to this Special Use Permit shall be maintained as required in the Orange County Zoning Ordinance and as prescribed in the special conditions listed below. This project is subject to the following special conditions: 1. Roads,parking areas, walkways, utilities,recreation facilities,and landscaping shall be maintained as installed and operated in a safe manner. 2. The smokehouse may be converted to permanent rest room facilities with approvals from the Orange County Division of Environmental Health and the Inspections Division of the Planning Department; and 3. The final site plan and narrative of the project, incorporating all changes, deletions and additions through the final approval of the project, are to be incorporated herein and made a part of this Planned Development Special Use Permit. Copies of the final site plan and narrative are to remain on file with the Orange County Planning Department. BACKGROUND: On October 17, 1989,the Board of County Commissioners issued a Class A Special Use Permit to Joseph and Avis Rice to operate a Bed and Breakfast in a historic log cabin. The Table of Permitted Uses identifies this use as"Historic Sites Non-Residential Mixed Use." Article 8.8.24.2 of the Zoning Ordinance limits this type of permit to a six-year period. The R.ices requested renewal of their permit in December 1996. The property is located in Cheeks Township, on the west side of Saddle Club Road. A log cabin is located on the property which is listed on the National Register of Historic Places as the Paisley-Rice Log House. The house is located on an 11.83 acre parcel. The facility provides food and lodging for up to four guests at any given time. Site conditions and operation of the bed and breakfast remain the same as when the Special Use Permit was approved in 1989. � h The property owner has rights to an easement along the southeastern comer of the property to Saddle Club Road. The easement currently provides access to the log house. The parcel has adequate frontage on Saddle Club Road, so that a separate driveway could be utilized if any problems with the existing access easement arise in the future. A permit to operate a Bed and Breakfast Home is required by the North Carolina Division of Health Services. The Orange County Division of Environmental Health acts serves as the authorized agent for the state in administering the regulations. Inspection of the facility by Environmental Health, and maintaining the permit for a Bed and Breakfast Home is included as a condition of approval. A copy of the new Special Use Permit is included in the attachments, as well as the findings of fact indicating compliance with Zoning Ordinance requiremments. RECOMMENDATION: Article 8.4.3 of the Zoning Ordinance requires that the Zoning Officer's recommendation be presented to the Planning Board within 45 days of receipt of an application. The 45-day period may be extended up to 60 days with the written consent of the applicant. The public hearing is the time scheduled for presentation of the Zoning Officer's recommendation. Zoning O{£tcer's Recommendation The Zoning Officer has not received information which would establish grounds for making a negative finding on the general standards. These standards include maintaining or promoting the public health, safety, and general welfare, maintaining or enhancing the value of contiguous property, and the use being in compliance with the general plan for the physical development of the County. The Zoning Officer has reviewed the application, the site plan and all supporting documentation and has found that the application does comply with the specific standards and required regulations concerning the modification. Provided the Planning Board and County Commissioners find in the affirmative on the general standards, the Zoning Officer recommends approval of the request to renew the Class A Special Use Permit for "The Old Place"to be operated as a bed and breakfast establishment. No decision on the application is made by either the Planning Board or the Board of Commissioners at the public hearing. Instead, the Planning Board has 60 days within which to prepare and submit a recommendation to the Board of Commissioners. The subject property (Tax Map Number 7.18..27D)contains 12.76 acres and is located immediately west of the existing landfill on the north side of Eubanks Road. It is zoned Rural Buffer and designated Rural Buffer on the Joint Planning Area Land Use Plan. The existing landfill is in the Chapel Hill Transition Area on the Joint Planning Area Land Use Plan. The applicants are requesting a Class A Special Use Permit under Article 8.8.2 of the Orange County Zoning Ordinance to construct a 4000 square foot vehicle maintenance building, to process yard waste and storm debris on an ongoing basis, and to process recyclable materials which will include white appliances, tires and scrap metal. Access to the site will be provided through the existing landfill. There will be no direct access to Eubanks Road. A 100-foot buffer will be provided around the perimeter of the site, except along the eastern border, next to the existing landfill. The Chapel Hill Planning Department indicated concern with landscaping on the property. The Orange County Planning Staff inspected the property and found all landscape standards are met. The wooded area along Eubanks Road has been shown on the site plan. Vegetation will not be disturbed as the building construction area will be approximately 90 feet away. A condition of approval has also been added to insure that all vegetation within the 100 foot buffer will remain undisturbed. In the 100 foot buffer along the western property line(referred to as internal buffer areas in the Chapel Hill letter)there are young mixed hardwoods approximately 6 feet in height that meet the landscaping buffer requirements. Land within the designated storage area for yard waste,mulch and recyclables will be seeded, repaired and maintained. The hours of operation of the site will be from 7:00 a.m. to 4:00 p.m. Monday through Friday, and 8:30 a.m. to 12:00 noon'on Saturday. RECOMMENDATION: Article 8.4.3 of the Zoning Ordinance requires that the Zoning Officer's recommendation be presented to the Planning Board within 45 days of receipt of an application. The 45-day period may be extended up to 60 days with the written consent of the applicant. The public hearing is the time scheduled for presentation of the Zoning Officer's recommendation. Zoning Off'icer's Recommendation The Zoning Officer has not received information which would establish grounds for making a negative finding on the general standards. These standards include maintaining or promoting the public health,safety, and general welfare, maintaining or enhancing the value of contiguous property, and the use being in compliance with the general plan for the physical development of the County. The Zoning Officer has reviewed the application, the site plan and all supporting documentation and has found that the application does comply with the specific standards and required regulations concerning the modification. Provided the Planning Board and County Commissioners find in the affirmative on the general standards, the Zoning Officer recommends approval of the request for a Special Use Permit for the Orange Regional Landfill subject to the following conditions: , R 1. The Application was found to be complete . The project is located on a 12 . 76-acre parcel known as the Johnson Tract (Tax Map MQ 7. 18 . . 27D) belonging to the Town of Chapel Hill, etal . and Orange County with an address of 306 N. We have some minor suggestions: • Most of the site has recently been harvested for timber and is mostly open. There are, however, several large hardwoods in the wooded strip along Eubanks Road that are likely in the designated buffer area and we would suggest that they be shown on the plans and adjustments be considered if necessary to preserve them. The County may wish to consider erecting tree protection fencing, depending upon how close these trees are to site construction. • It is difficult to determine the exact property lines in the field, but it appears that some of the internal buffer areas may recently have been cleared. The County may wish to consider recommending replanting this area. Additional planting of evergreen materials along Eubanks Road may also be a consideration to supplement the deciduous trees in this area. Please let me know if we may be of further assistance. The property is located in Chapel Hill Township on the north side of Eubanks Road (SR 1727) east of Rogers Road(SR 1729) adjacent to the existing landfill site. The applicant proposes to construct a 50' x 80' maintenance building on 12.76 acres. The proposed facility will also include a storage yard for yard waste,mulch, and recyclables. Access to the site will be through the current landfill site adjacent to the east side of the subject property. A 100-foot Type F land use buffer is required around the boundary of the zoning lot. A waiver is requested for the portion of the buffer adjacent to the existing landfill. Article 12.8 of the Zoning Ordinance allows the Planning Director or his designee to waive the requirements for additional landscaping in a required land use buffer when strict adherence to the ordinance would serve no useful purpose. Given the fact that the maintenance building and storage yard are considered accessory uses to the adjacent landfill,requiring screening between the lots is not necessary to promote public health, safety or general welfare. The building setback aspect of the land use buffer is met on the proposed site plan. In the event another use other than the landfill is proposed on the current landfill site at some point in the future, and that use is not compatible with the maintenance building and storage yard, it is likely that the Town of Chapel Hill would require a buffer as part of the site plan approval for a new use on the landfill site.
