N., on November 25, 1949• Present: Chairman Collier Cobb, Sr., and Commissioners H. G. Laws and Ben P. Wilson -- Absent: a The members of the Board of Commissioners for the County of Orange sat at the table at which the County Board of Elections was holding its meeting and said County Board of Elections and said Board of Commissioners, as two separate bodies, separately received from the registrars and judges of election in the various precincts of the County of Orange the returns of the special bond elec. tion held November 22, 1949• After said returns had been canvassed by said Board of Commissioners, beir simultaneously with the canvassing thereof by the County Board of Elections in the same place, Commissioner Wilson introduced the following resolution, which was read; RESOLUTION CANVASSING THE RETURNS OF THE SPECIAL BOND ELECTION HELD NOVEMER 22, 1949 AND DETERMINING THE RESULT THEREOF. BE IT RESOLVED by the Board of Commissioners for the County of Orange: Section 1. That the returns of the special bond election held Novem- ber 22, 1949 having been received from the proper election officers and the Board having canvassed the same, the following facts are hereby found and deter mined: (a) That each registrar and judge for the special bond election held in the County of Orange on November 22, 1949 vies duly qualified by law and had ',. taken the necessary oath. (b) That the election officers had incorporated in their returns not only the number of votes cast for and against each question submitted, but also the number of voters registered and qualified to vote in each precinct in the election. - - (c) That at said election there were submitted to the qualified vote: of said County the following questions: 1. Shall an order finally passed October 17, 1.949, authorizing not exceeding $1,000,000 School Building Bonds of Orange County for the purpose of providing funds, with other funds available for such purpose, for erecting additional school buildings, remodel- . ing and enlarging existing school buildings and acquiring any necessary land and equipment therefor, and a tax for said bonds, be approved? - 2. Shall an order finally passed October 17, 1949, authorizing not exceeding $250,000 Courthouse Bonds of Orange County for the purpose of providing funds for erecting and equipping a new courthouse upon the site now owned by said County near the pre- sent courthouse, and a tax for said bonds, be approved? Section 2. That no complaints have been made to this Board against the regularity of said election, and that this Board believes that said election was conducted in full compliance with law and with the orders of this Board, Section 4. That from the canvass so made by this Board it is deter- mined and declared: (a) That 11,278 voters were registered and qualified to vote. (b) That at said election 3,621 votes were cast for the order autho- rizing not exceeding $1,000,000 School Building Bonds of Orange County for the purpose of providing funds, with other funds available for such purpose, for erecting additional school buildings, remodeling and enlarging existing school buildings, and acquiring any necessary land and equipment therefor, and a tax for said bonds, and 1,159 votes were cast against said order, and that a majority of the auallfied voters of said County voting thereon at said election voted in favor of said order, and that said order was thereby approved and is in force and effect. (c) That at said election 3,293 votes were cast for the order autho- rizing not exceeding $250,000 Courthouse Bonds of Orange County for the purpose of providing funds for erecting and ecuipping a new courthouse upon the site no owned by said County near the' present courthouse, and a tax for said bonds, an 1322 votes were cast against said order, and that a majority of the qualified voters of said County voting thereon at said election voted in favor of said order, and that said order was thereby approved and is in force and effect. Upon motion of Commissioner Wilson, seconded by Commissioner Laws, the fore going resolution entitled: "REESOLUTION CANVASSING THE RETURNS OF THE SPECIAL BOND ELECTION HELD NOVEMBER 22, 1949 AND DETERMINING THE RESULT THEREOF" was passed by the following vote: Ayes: Commissioners Cob, Wilson and Laws Noes: 0. Thereupon Commissioner Wilson introduced the following resolution, which visa read: RESOLUTION PROVIDING FOR THE PUBLICATION OF THE STATEMENT OF THE RESULT OF THE SPECIAL BOND ELECTION HELD NOVEMBER 22, 1949- BE IT RESOLVED by the Board of Commissioners for the County of Orange: Section 1. That the Board of Commissioners has prepered and does adopt the following statement of the result of the special bond election held in the County of Orange on November 22, 1949: STATEMENT OF RESULT OF SPECIAL BOND ELECTION held in the COUNTY OF ORANGE, NORTH CAROLINA on NOVEMBER 22, 1949 At a special bond election held throughout Orange County, North Caro- line, on November 22, 1949, 11,278 voters were registered and qualified to vote. 3,621 votes were cast for the order authorizing not exceeding S1,000,000 School Building Bonds of Orange County for the purpose of providing funds, with other funds available for such purpose, for erecting additional school buildings, remodeling and enlarging existing school buildings and ac- quiring any necessary land and equipment therefor, and a tax for said bonds, and 1,159 votes were cast against said order, and that a majority of the qualified voters of said County voting thereon at said election voted in favor of said order, and that said order was thereby approved and is in force and effect. 3,293 votes were cast for the order authorizing not exceeding $250,000 Courthouse Bonds of Orange County for the purpose of providing funds for erect- ing and equipping a new courthouse upon the site now owned by said County near the present courthouse, and a tax for said bonds, and 1,322 votes were cast against said order, and that a majority of the qualified voters of said County voting thereon at said election voted in favor of said order, and that said orde was thereby approved and is in force and effect. That when the foregoing statement shall have been signed a majority of the members of this Board and delivered to the Clerk, the latte: 11 record it in the minutes of the Board, and such statement shall be filed the office of said Clerk and published by said Clerk once in The News of nge County, a newspaper published in Orange County. A notice substantially '.. the following form, with the printed signature of the Clerk appended thereto, 11 be published with the foregoing statement: ITO THE CITIZENS AND TAXPAYERS OF ORANGE COUNTY: No right of action or defense founded upon the invalidity of the elec- tion mentioned in the foregoing statement shall be asserted, nor shall the vali- dity of such election be open to question in any court upon any ground whatever, except in an action or proceeding commenced within thirty days after the publi- cation of the foregoing statement. Upon motion of Commissioner Wilson, seconded by Commissioner Laws, the !! foregoing resolution entitled: "RESOLUTION PROVIDING FOR THE PUBLICATION OF THE I ! Several bids were submitted on a standard electric range for the Jail. r checking these bids, it was found that Forrest & Forrest of Efland, N. C., the low bidder, offering a standard Crosley range for $148.50. 3>0 Now, Therefore, upon motion of Commissioner Laws, seconded by Commissioner Wilson, Ira A. Ward is hereby authorized to purchase this range from Forrest & Forrest, provided it carries a one year guarantee. There being no further business, upon motion, adjourned. J. E.
