Purpose To re-document the existing Chapel Hill Fire District and establish an official
record to be sent to the Department of Insurance so the fire insurance rating classification
can be completed.
Background Chapel Hill has provided fire protection to a district outside the Town
limits, known as The Greater Chapel Hill Fire District, for a period well over 20 years. It
was discovered that no official records of this district could be found at Chapel Hill or the
County. Chapel Hill Fire Department underwent an inspection for the purpose of
establishing the fire insurance rate for the Town limits and for the District. Part of the
inspection criteria is official documentation that the County recognizes a fire district
that's not within a municipality's town limits. The Greater Chapel Hill District has been
decreased in size, over the years by Town annexation and now consist of only two streets.
The County and the Town have been in agreement about fire protection in this area and
the Town actually receives revenue of approximately six hundred dollars ($600)annually
from a tax rate of 2.9 cent to provide that protection.
The resolution will re-establish the record of the boundary of the Greater Chapel Hill Fire
District and will satisfy the remaining requirements for the Department of Insurance's fire
insurance rate inspection.
The agreement is between the Town of Chapel Hill and the County for the provision of
fire service to the Greater Chapel Hill Fire District at a tax rate of 2.9 cent.
Recommendation The manager recommends the resolution be adopted,the agreement
approved and authorize the Chair to sign both.
A RESOLUTION AUTHORIZING FIRE PROTECTION DISTRICT
WHEREAS, The Greater Chapel Hill Fire District consists of all properties
on Winter Drive and Meadow Lane that are not in the Town
limits of Chapel Hill; and
WHEREAS, There is a need for fire protection to be provided in The Greater
Chapel Hill Fire District; and
WHEREAS, The Town of Chapel Hill, Chapel Hill Fire Department have
provided fire protection over the past twenty years and desire
to continue doing so; and
WHEREAS, The Board of County Commissioners must, for fire insurance
rating purposes,establish a fire district and authorize fire
protection to be provided; and
NOW,THEREFORE,BE IT RESOLVED that the Board of County Commissioners
hereby approve the boundary of The Greater Chapel Hill Fire District as beginning at a
point at the intersection of Winter Drive and U.S. 15-501 (Fordham Boulevard);thence
eastwardly along the Town limits of Chapel Hill and the bounds of The Greater Chapel
Hill Fire District, approximately 306' (three hundred six feet)to a point;thence southerly
along the Town limits of Chapel Hill and the bounds of The Greater Chapel Hill Fire
District,to a point in the center of Morgan Creek;thence in a northwesterly direction,up
Morgan Creek,to a point; thence northerly along the Town limits of Chapel Hill and the
bounds of The Greater Chapel Hill Fire District,to a point in U.S. 15-501;thence
eastwardly along U.S. 15-501 and the Town limits of Chapel Hill to a point at the
intersection of Winter Drive and U.S. 15-501 (Fordham.Boulevard,the point of
beginning. The description includes all the properties bordering Winter Drive and
Meadow Lane as identified in Chapel Hill Township,Tax Map 126,Block D,Lots I
through 7, and includes all the land within the described bounds, not in the corporate
limits of the Town of Chapel Hill.

' AGREEMENT TO PROVIDE COUNTY FIRE PROTECTION 3
NORTH CAROLINA
ORANGE COUNTY
This agreement, made and entered into the 4'h day of December, 1996, by and
between the Town of Chapel Hill, a municipal corporation, hereinafter called the Town,
and the County of Orange, hereinafter called the County;
WITNESSETH:
That for, and in consideration of the mutual covenants hereinafter contained, the
Tvwn and County, do hereby covenant and agree as follows:
t. The Town agrees to furnish and provide continuing fire protection service to
all property within the area described in Exhibit A attached hereto and
incorporated herein lying outside the boundaries of the Town, by dispatching
upon call of any resident or property owner within said fire protection service
azea, equipment consisting of one pumper of at least 750 gallon per minitte
capacity vr.d additional units carrying at least 1000 gallons of water and
adequate personnel to operate the same.
2. The Town will comply with budgeting procedures and other procedures
provided for by state law, and agrees to annually submit to the County budget
estimates and a supporting letter of request from the T own Manager.
3. The Colanty agrees to annuai!y levy, collect and make payments to the Town
in the amount generated by the annually approved tax rate for the area
described in Exhibit A, currently 2.9 cent.
4. This contract may be terminated by either party at the end of the fiscal year by
givi,rg 180 days written notice of its intent to terminate.
In witness whereof, the Town of Chapel Hill has caused these present to be signed
in its name by the Mayor and attested by its Clerk, and the County of Orange has caused
these present to be signed in its name

Boundary Description, Greater Chapel Hill Fire District
Beginning at a point at the intersection of Winter Drive and U.S.
15-501 (Fordham, Boulevard) ; thence eastwardly along the Town limits
of Chapel Hill and the bounds of the Greater Chapel Hill Fire
District, approximately 3061 (three hundred six feet) to a point;
thence southerly along the Town limits of Chapel Hill and the
bounds of the Greater Chapel Hill Fire District, to a point in the
center of Morgan Creek; thence in a northwesterly direction, up
Morgan Creek, to a point; thence northerly along the Town limits of
Chapel Hill ar.d the bounds of the- Greater Chapel Hill Fire
