HomeMy WebLinkAbout1998 S Contract with Chapel Hill Training-Outreach Project, Inc. for Family Coordination Services to the Early Head Start Program and Establishment of Two New Position RETURN THIS COPY TO THE CLERK'S OFFICE FOR THE PERMANENT AGENDA FILE' STATE OF NORTH CAROLINA COUNTY OF ORANGE AGREEMENT THIS AGREEMENT,made and entered into this first day of January 1999,by and between Chapel Hill Training-Outreach Project,Inc.,hereinafter referred to as"CHTOP,"for its Early Head Start Program,hereinafter referred to as"EHS"and the Orange County Health Department,hereinafter referred to as the"OCHD." WITNESSETH: WHEREAS,the EHS desires to provide family support services for families enrolled in the Early Head Start Program,and, WHEREAS,the OCHD provides family support services in its intensive home visiting and child service coordination programs. NOW,THEREFORE,in consideration of the premises and the following mutual covenants and conditions and any sums to be paid,the OCHD and CHTOP agree as follows: 1. The OCHD agrees to provide two(2)social worker positions for the provision of family support services to EHS participants. The social workers' duties will be to: a. Provide family service coordination to a caseload of 20-25 children and their families with complex medical and social needs. Provide indirect services to an additional 20-25 families receiving case management services from other community agencies in order to support the accomplishment of goals identified in preexisting family plans. b. Provide community outreach services in order to identify and recruit potentially eligible families for the Early Head Start Program. c. Facilitate the initial linkage of families to the Early Head Start Program and initiate and assist with the enrollment process. d. Assess each families strengths and needs at enrollment and on an ongoing basis. e. Assess parent/child interaction at periodic face to face family contacts. f. Develop with families a comprehensive service plan and family partnership agreement based on family priorities,interests,strengths,and needs. Reassess and revise plan on a regular basis. g. Develop a supportive,non-judgmental relationship with families,respecting individuality and cultural differences. h. Educate families regarding community resources and make appropriate referrals for needed services. i. Provide crisis intervention counseling and support to families in emergency situations. j. Provide transportation services to activities which are part of Early Head Start's mission and family goals when no other transportation resources are available. k. Coordinate services to families provided by a variety of resources and advocate on families behalf in a professional and positive manner in order to help family appropriately access needed services. 1. Make regular home visits to families to follow-up on service plan and to provide counseling and parent education. m. Assure that child receives regular health and developmental screenings. s 2 AGREEMENT Between the Chapel Hill Training-Outreach Project,Inc. and Orange County Health Department Page 2 of 4 n. Identify literacy needs of parents and refer for further assessment and literacy training. o. Assist in the development and facilitation of Early Head Start Parent Committees to promote and foster parent involvement in family and community partnership efforts. p. Promote independence and strengthen families' ability to advocate on its own behalf in order to prepare for transition from Early Head Start services. q. Utilize supervision on a regular basis. r. Attend necessary training and in--service activities and participate in interagency/interdisciplinary activities. s. Complete required OCHD and Early Head Start documentation. 2. The persons whose services are to be provided pursuant to this Agreement are,for all purposes,employees of the OCHD,and conditions of their recruitment and employment are governed by the Orange County Personnel Ordinance. 3. The OCHD will be responsible for the negligence of its employees and agents to the extent of the North Carolina Tort Claims Act. Further,the OCHD will provide adequate professional liability insurance for its employees who provide the services described in the agreement. The insurance limits will be stated in a Certificate of Insurance submitted at the time the contract is commenced. 4. CHTOP agrees to pay the OCHD in return for the above services actual expenses related to salary and fringe benefits up to a maximum of SEVEN THOUSAND FIVE HUNDRED DOLLARS($7,500)per month for the initial six month period,January 1 -June 30, 1998. Any amount in excess of this must be agreed to by both parties. In subsequent years,the maximum amount will be agreed to on an annual basis,subject to salary and fringe benefit increases mandated or allowed by the Orange County Pay and Employee Compensation Plan as determined by the Orange County Board of Commissioners. 5. The OCHD shall bill the CHTOP on a monthly basis with the first bill being dated January 1, 1999,and CHTOP shall pay OCHD within thirty(30)days of receipt of OCHD's bill. Any adjustments to the billing shall be taken into account in the next succeeding bill or as soon thereafter as reasonably practicable. 6. The expenditure of Medicaid revenue earned as a result of the services provided by the social workers in this Agreement shall be determined jointly by OCHD and CHTOP. 7. CHTOP agrees to provide office space, supplies,computer,phone,mileage reimbursement and training resources for the two social worker positions. w 3 AGREEMENT Between the Chapel Hill Training-Outreach Project,Inc. and Orange County Health Department Page 3 of 4 S. OCHD and CHTOP agree to establish a shared supervisory system which is consistent with requirements set forth in the Grange County Personnel Ordinance and Early Head Start Performance Standards. As Grange County Employees,they will be subject to all provisions of the Orange County Personnel Ordinance. 9. OCHD and CHTOP agree to work toward the following outcomes for EHS families: a. Improve parent-child interaction, b. Ensure adequate use of preventive health and family support services, c. Improve children's health and development,and d. Decrease child abuse and neglect. 10. In the event that the social workers become unwilling or unable to perform the duties required by this Agreement,the employees are subject to Orange County Personnel Ordinance procedures. OCHD and CHTOP shall attempt to mutually agree upon replacement of personnel. If such mutual agreement is not achieved,then this Agreement shall terminate and any payment due as of the date of termination shall be paid- 11. Renewal of this Agreement shall be on an annual basis, subject to program continuation based on a review of program outcomes,and subject to available funding and shall commence upon written notice executed by both parties. This Agreement shall run for a period of FOUR(4)years and FOUR(4)months,from the V day of January, 1999,to April 2003 as long as the Federal Early Head Start funds continue to be available. 12. This Agreement or its renewals may be terminated at any time without penalty by either party provided that written notice of such termination is furnished to the other party at least ninety(90)days prior to termination. In the event of such termination any payment due shall be prorated to the date of termination. 13. The CHTOP hereby agrees with OCHD,that in its educational and/or employment practices,the OCHD will comply with such nondiscrimination law as may be applicable to it in the performance of this Agreement. CHTOP hereby agrees to abide by pertinent rules and regulations of the OCHD,Orange County,and the North Carolina Department of Environment,Health and Natural Resources in the conduct of service. 14. No provision of this Agreement shall be construed or interpreted as creating a pledge of the faith and credit of Orange County or OCHD within the meaning of any constitutional debt limitation. No provision of this Agreement shall be construed or interpreted as creating a delegation of governmental powers nor as a donation V 4 AGREEMENT Between the Chapel Hill Training-Outreach Project,Inc. and Orange County Health Department Page 4 of 4 by or a lending of the credit of Orange County or OCHD within the meaning of the Constitution of the State of North Carolina. This Agreement shall and does not directly or indirectly or contingently obligate Orange County or OCHD to make any payments beyond those appropriate in the sole discretion of Orange County or OCHD for any fiscal year in which this Agreement shall be in effect. No deficiency judgment may be rendered against Orange County or OCHD in any action for breach of a contractual obligation under this Agreement and the taxing power of Orange County or OCHD is not and may not be pledged directly or indirectly or contingently to secure any moneys due under this Agreement. 15. This Agreement contains the entire understanding of the parties and shall not be altered,amended,or modified, except by an agreement in writing executed by the duly authorized officials of both parties.
