ORANGE COUNTY
AMENDMENT TO DEVELOPMENT AGREEMENT
THIS AMENDMENT, made and entered into this the 10 day of December, 2012 by
and between ORANGE COUNTY, a general local governmental unit of the State of North
Carolina, (hereinafter referred to as the "County") and INTER-CHURCH HOUSING
CORPORATION, a North Carolina non-profit housing organization (hereinafter referred to as
"Owner") (both collectively referred to as the "Parties").
WITNESSTH
WHEREAS, the County and Owner entered into a"Development Agreement" ("Original
Agreement"), dated July 22, 2011 in which the County on behalf of the Orange County HOME
Consortium designated FY 2010 HOME funds to Owner to assist in the rehabilitation of two (2)
low-income apartment complexes in Chapel Hill known as Chase Park and Elliott Woods; and
WHEREAS, the Orange County HOME Consortium has designated approximately
$37,000 in FY 2012 HOME funds to assist in the rehabilitation of two (2) low-income apartment
complexes in Chapel Hill known as Chase Park and Elliott Woods; and
WHEREAS, the County and Owner desire to amend the Original Agreement, while
keeping in effect all terms and conditions of the Original Agreement not inconsistent with the
terms and conditions set forth below.
NOW THEREFORE, for and in consideration of the mutual covenants and agreements
made herein, the Parties agree to amend the following sections of the Original Agreement as
follows:
1. In Section I1. Amo unt cfLTOME Funds/Form of Suhsidv amend as follows:
The County shall make available to the Owner up to One Hundred Thirty-Seven
Thousand Five Hundred Dollars ($137,500) pursuant to this Agreement. Said funds
shall be disbursed by the County to the Provider for performance of the services
described in Exhibit B
2. Delete Section III. Lien Position in its entirety.
3. Exhibit B: Scope of Services shall be amended to add the following:
Repair of:
1. Pooling water around buildings at Elliott Woods and Chase Park
1
2. Blocked drainage on both sites
3. Pooling water on sidewalks
4. Redirect drainage of downspouts on buildings
5. Erosion of soil on both sites
All work must be done in accordance with applicable local building codes.
4. Exhibit C: Project Budget shall be amended to change"Source of Funds" as follows:
Orange County HOME Funds $137,500
Except for the changes made in Section II, Section III, Exhibit B and Exhibit C herein, the
Original Agreement shall remain in full force and effect to the extent it is not inconsistent with
this Amendment. In the event that there is a conflict between the Original Agreement and this
Amendment, this Amendment shall control.
IN WITNESS WHEREOF, the parties hereto, intending to be legally bound, have set their hands
and seals on the day and year first above written.
