RESOLUTION OF THE ORANGE COUNTY
BOARD OF COMMISSIONERS OF INTENT
TO CLOSE A RIGHT-OF-WAY
IN HILLSBOROUGH TOWNSHIP
WHEREAS, petitioners A. H. Graham and Graham Family Investment L.P. have filed a petition before
the Board of County Commissioner to close a right-of-way identified on the map which is part of
Exhibit A to this Resolution (hereinafter "the abandoned right-of-way"); and
WHEREAS, it appears that no individual, firm or corporation owns property in the vicinity of said right-
of-way without a reasonable means of ingress and egress to his, her or its property; and
WHEREAS, the Class A Special Use Permit for a Planned Development Rezoning recorded in Book
1709 Page 101 in the Orange County Register of Deeds Office includes a condition that a cul-de-sac
be constructed at the southwestern end of Carolina Avenue during the development of Phase I and
that the entrance on St. Mary's Road (SR 1002) be closed by governmental action, which action shall
be initiated upon the effective date of the special use permit, and
WHEREAS, the Class A Special Use Permit became effective March 20, 1998;
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Orange County that it
intends to close the abandoned right-of-way and the Board of Commissioners of Orange County calls
upon and requests the Board of Transportation, pursuant to N.C. G. S. . § 136-63, to abandon 360
feet (approximately) of Carolina Loop (SR 1586) from its intersection with St. Mary's Road in
Hillsborough Township.

Commissioner Stephen H. Halkiotis moved the passage of the foregoing resolution, and
Commissioner Barry Jacobs seconded the motion, and the resolution was passed by the following
vote:
Ayes: Chair Moses Carey Jr. and Commissioners Margaret Brown, Alice M. Gordon. Stephen
H. Halkiotis and Barry Jacobs
