HomeMy WebLinkAbout2000 S Solid Waste - Quality Assurance Technical Assistance Contract for Landfill Cell #4 Liner STATE OF NORTH CAROLINA AGREEMENT FOR COUNTY OF ORANGE CONSTRUCTION QUALITY ASSURANCE SERVICES This Agreement made and entered into by and between the County of Orange herein "County", acting in its capacity as administrator of the Orange Regional Landfill, and Draper Aden Associates, herein"Consultant" for services as hereinafter described for the County of Orange County. WITNESSETH That for and in consideration of the mutual promises and conditions set forth below, the Consultant and County agree: 1. Duties of Consultant: Consultant agrees to provide services as described in Exhibit A attached hereto and incorporated herein by reference. 2. Duties of the County: The County shall pay for Consultant's services as set forth in Exhibit A and incorporated herein by reference. 3. Billing and Payment: Consultant shall submit regular invoices for work performed and shall be paid.for completion of the work performed during that period under the terms of this Agreement. Consultant shall bill and County shall pay at the rate and frequency set forth herein Exhibit A. Payment shall be made by the County within thirty(30) days of receipt of an accurate invoice. The value of this contract is not to exceed $56,652, except as agreed by the parties. 4. Amendment : This agreement may be amended or cancelled by mutual agreement of the County and the Consultant. Either the County or the Consultant may terminate this Agreement at any time with or without cause upon giving the other party 21 calendar days prior written notice. The County shall within sixty calendar days of termination pay the Consultant for all services rendered and all costs incurred up to the date of termination, in accordance with the compensation provisions of this contract. Any amendments to the contract are not valid unless signed by the Chairman of the Board of County Commissioners. 5. Insurance Provisions a. Worker's Compensation: Coverage to apply for all employees for statutory limits in compliance with the state and federal laws. The policy must include employer's liability with a limit of$100,000 each accident, $100,000 bodily injury by disease each employee and$500,000 bodily injury by disease policy limit. b. Comprehensive General Liability: Shall have minimum limits of$1,000,000 per occurrence combined single limit for bodily injury, liability and property damage liability. This shall include premises and/or operations, independent contractors, products, and/or completed operations,broad form property damage and explosion, collapse and underground damage coverage and a contractual liability endorsement. c. Professional Errors and Omissions Liability: Coverage shall have minimum limits of$1,000,000 per claim and $1,000,000 aggregate. d. Additional Insured: The County of Orange is to be included as an additional insured on the Comprehensive, General Liability. This requirement is to be stated on the Certificate of Insurance. e. Insurance Policies: Current, valid insurance policies meeting the requirements herein identified shall be maintained during the duration of the named project. Renewal certificates shall be sent to the Town thirty(30) days prior to any expiration dates. There shall also be a 30 day notification to the Town in the event of a cancellation or modification of any stipulated insurance coverage. Certificate of insurance meeting the required insurance provisions shall be forwarded to the County of Orange. Wording on the certificate which states that no liability shall be imposed upon the company for failure to provide such notice is not acceptable and should be deleted. Original policies or certified copies of policies may be required by the County at any time. f. Certificates of Insurance for all the insurance coverages described herein shall be submitted to the County upon execution of a contract by Consultant. g. All insurance required under this agreement shall be written with a company licensed to do business in North Carolina. Certified copies insurance policies may be requested by the County. 6. Hold Harmless: Consultant agrees,to indemnify and hold the County harmless from any damage, liability or cost(including reasonable attorneys'fees and costs of defense)to the extent caused by the Consultant's negligent acts, errors or omissions in the performance of professional services under this Agreement and those of his or her subconsultants or anyone for whom the Consultant is legally liable. The Consultant is not obligated to indemnify the County in any manner whatsoever for the County's own negligence. 7. Claims_The parties agree to attempt to resolve any dispute without resort to litigation. However, in the event a claim is made that results in litigation, and the claimant fails to prevail,then the claimanLshall pay all costs incurred in defending the claim, including reasonable attorney's fees. The claimant will be considered to ` have prevailed if the judgement obtained and retained through any applicable appeal is at least ten percent greater than the sum offered to resolve the matter prior to the commencement of trial. Any litigation between the County and Consultant under this agreement shall be filed and tried only in a court of competent jurisdiction within Orange County,North Carolina. 8. Term: This Agreement, unless amended as provided herein, shall be in effect from June 6, 2000 through November 30, 2000. CRATE, P.G. Draper Aden Associates QA Team will be led by Mr. Jeffrey T. Crate, P.G. Jeff is Vice President of Solid Waste Management Services and will serve as the Principal-in-Charge for this project. Jeff has served in the capacity of Project Engineer, Chief Hydrogeologist and Project Manager for more than 200 solid waste management, hazardous waste and environmental projects over the past 25 years. His work experience encompasses the eastern United States and abroad. He is currently responsible for the coordination and oversight of solid waste management planning and design, groundwater monitoring, site characterizations and remediation projects. He plays a significant role in corporate strategic planning, staffing and project resource allocation as it relates to these fields. Mr. Crate will ensure that all necessary resources of the firm are allocated to the Town of Chapel Hill for the duration of this project. KENNETH M. PIAZZA, JR., The Senior Project Engineer (QAE) for this project is Mr. Kenneth P.E. M. Piazza, Jr., P.E. Ken is an Associate in the firm and is the Director of Geotechnical/Construction Administration as well as the Geoteclmical Team Leader. Ken is responsible for managing geotechnical and environmental aspects of projects and for preparing technical reports. He provides construction management, inspection and QA/QC review services for a wide variety of landfill building and infrastructure construction projects. Ken serves as the director of Draper Aden Associates' in-house soils laboratory, whim provides soil testing services to evaluate soil strength and other physical properties. GREG DAUPHIN Draper Aden Associates' Project Manager for this project is Mr. Greg Dauphin. Greg is responsible for technical performance of both construction management and geotechnical engineering services. He is responsible for performance of subsurface explorations, field and laboratory test programs, data reduction and analysis and design recommendations. In addition to project management responsibilities. Greg also prepares and present technical presentations. The following page contains an organization chart for'this project.. Detailed resumes of all team members are found in Section H. Section IV.2 Communications a CA Draper Aden Associates anticipates that there will be frequent communication and interaction between Draper Aden Associates' project personnel and the owner. The goal will be to listen, and then listen some more, to completely understand the needs and the desires of the Town of Chapel Hill as they relate to the design,operation,and economic issues of the project. The CQA services which Draper Aden Associates will provide include the performance of QA Engmeeting, Construction Management and QC soils testing in accordance with the project plans and specifications. In order to improve communication, and provide potential savings to the Town of Chapel Hill. Draper Aden Associates can provide a highly qualified QA Officer (QAO) on site full time to provide both general CM Services and QC soils testing services for the contractor during.the placing of the soil component of the liner system. Draper Aden Associates' QA Engineer will perform weekly site visits with routine attendance at job site meetings to update progress, provide testing clarification and monitor the performance of the contractor. As part of this scope of work, Draper Aden Associates construction administration services will include items such as coordinating job site meetings, processing of submittals, maintaining submittal review files, updating construction schedules, interpreting construction documentation, processing change orders and reviewing contractor pay requests. The QA Officer (QAO) will provide on-site monitoring of the construction operations and perform soils and aggregate quality control sampling, monitor synthetic conformance testing, and additional testing and reporting mandated by the specifications. He will maintain daily logs, test records and certificates in a well- organized, tabulated mazmer. The QAO will notify the contractor immediately of non-complying test results and will be available to verify remediation and retesting of non-complying work. He will maintain an awareness of the project in order to detect conditions, which may directty or indirectly jeopardize the integrity of the project. Upon completion of the project,the QAE, CM, and QAO will work in direct communication with Chapel Hill personnel to prepare the Section IV.2 Communications Page 2 Final CQA Permit documentation. These are the Certificate Documents that must be submitted to the DEQ. The final documentation will be organized and indexed to enable easy access and retrieval of original inspection, testing data sheets, material certifications,reports and the record drawings. i r Section IV.3 The QA Role for This Project PART I GENERAL The Quality Assurance (QA) program shall be maintained for all REQUIREMENTS Soil Liner (SL) construction activities. A Quality Assurance Officer (QAO) shall be responsible for the implementation of the quality control program. The QA program shall consist of all construction and administrative activities related to the SL to control the overall quality of the SL. The program shall be implemented by Draper Aden Associates. See Section II of this proposal personnel resumes. Quality shall be defined as the level of effort, materials, means or methods used which meet the minimum requirements as specified in the Project Documents. Administrative items included in the QC program include project QC submittals, field logs, and record drawings. All soils testing shall be performed in-house by our qualified testing laboratory. The soils testing laboratory has participated in an inspection program conducted by the National Institute for Science and Technology or the U.S. Army Corps of Engineers within the past 2 years. A soils testing laboratory representative shall be present on site during all construction operations which require quality control testing or observation as per the project specifications. Time schedules for Quality Control testing will closely follow the Contractor's proposed schedule, and will be adjusted during construction as per the Contractor's schedule. Time schedules for Quality Control testing will closely follow the Contractor's proposed schedule and will be adjusted during construction as per the Contractor's schedule. All soils testing will be performed in-house by our qualified testing laboratory. Inspection of the structural fill, low permeability soil, GCL, drainage layer, diversion berms, slope drains, rip-rap ditches, access roadways and seeding and mulching will be performed on a full time schedule, as required Inspection of erosion control will be performed throughout the project to ensure compliance with the approved Erosion and Sediment Control Plan.. If applicable, material for the borrow study will be sampled from the borrow site or taken from stockpiles. The borrow source will be documented and approved by the Engineer prior to use. Prior to the low permeability soil and GCL placement, the base will be prepared--smooth,free of surface defects and proof rolled The Contractor will construct a test pad to determine if the required permeability can be obtained using the specified compaction equipment and lift thickness. The test pad will be used to check if the methods used to reduce clods in the soil (if applicable), interconnect lifts and compact the soil liner are sufficient to remold the soil and achieve the required Permeability. At the completion of phases of the project, Quality Control Reports and testing will be compiled and certified by the Quality Control Engineer.
