O o � ORANGE COUNTY ARTS COMMISSION Z rz AN G n u n r r , T$ FALL,2012 GRANT AGREEMENT c \ THIS AGREEMENT, entered into this 14th day of December, 2012, by and between Orange County ("County"), by and through the Orange County Arts Commission ("Arts Commission") and Friends of the Carrboro Branch Library("Grant Recipient"). WHEREAS, the Arts Commission is a countywide arts agency that ensures the growth of local arts experiences by providing funding and support for diverse high quality programs and projects. WHEREAS, the Arts Commission administers the Spring and Fall Arts Grants Program to provide economic opportunities to Orange County artists and non-profit organizations coordinating arts projects benefiting the citizens of Orange County. WHEREAS, the Spring Arts Grants Program is supported by Arts Commission with funds from the Grassroots Program of the North Carolina Arts Council, an agency of the Department of Cultural Resources and the National Endowment for the Arts. WHEREAS, the Grant Recipient was selected by the Arts Commission to receive the Spring Arts Grant through the procedures duly adopted by the Arts Commission; and WHEREAS, both parties wish to promote and maintain the integrity and clarity of the Grant Recipient's ideas and statements and delineate the Grant Recipient's obligations to the County; NOW, THEREFORE, the County and the Grant Recipient, for the consideration and under the conditions hereinafter set forth, agree as follows: 1. Approved Grant Project. Grant funds are provided under this Agreement for the project ("Project") described in the Grant Recipient's Grant Application, attached hereto and incorporated herein as Exhibit A. 2. Grant Award. Grant funds in an amount not to exceed six hundred seventy-nine dollars ($679) have been awarded by the Arts Commission to the Grant Recipient for the approved Project. These funds must be matched at least dollar-for-dollar with cash from the Grant Recipient's funds not derived from either Orange County appropriations or the North Carolina Arts Council. 3. Contingency. This grant is contingent on North Carolina Arts Council Grassroots Program funding to the Arts Commission. Final decisions on Grassroots Program funds to the North Carolina Arts Council are subject to approval by the North Carolina General Assembly. 4. Responsibilities of the Grant Recipient 1 Revised May 2012 A. Implementation. The Project implementation shall take place between January 1, 2013 and December 31, 2013. The Project shall be implemented in the manner described in Exhibit A. Time is of the essence in the implementation of the Project. B. Modifications to project. Grant Recipient shall present major changes to the original proposal, including but not limited to changes in design, implementation schedule and increase in Project budget by more than 10%, in writing to the Arts Commission for approval. Arts Commission shall approve or disapprove Grant Recipient's request for modifications within seven (7) days of receipt thereof. Consent to project modifications shall not be unreasonably withheld. Arts Commission's decisions shall be in writing. In the event the Arts Commission fails to approve or disapprove the requested modifications within the time stated herein,the modifications shall be deemed approved. C. Non—assignment. The grant cannot be assigned or transferred to a different project or artist without prior written approval of the Arts Commission. D. Records. Grant Recipient must maintain records and other evidence pertaining to costs incurred and revenues acquired during the Project implementation. Grant Recipient shall maintain financial records pertaining to the Project for three (3) years from the date of this Agreement, in case of audit. E. Use of Funds. Grant Recipient shall not use the grant funds to repay outstanding taxes or other debts of any nature. The grants shall be utilized solely for the purpose of implementing the Project and Project related expenses. F. Final Report. Grant Recipient shall submit to the Arts Commission a Final Report on January 14 , 2014 . The Final Report shall be in the format required by the North Carolina Arts Council. Failure to submit the Final Report or late submission of the Final Report, for any reason, shall be grounds for denial and/or cancellation of grant funds for the Project and future grant proposals. 5. Responsibilities of the Arts Commission A. Payment. The Arts Commission shall release the grant funds in the amount of $679 to the Grant Recipient. 6. Publicity A. Acknowled eg_ment. Credit must be given to the Orange County Arts Commission using the Arts Commission logo and if State funds are received to the North Carolina Grassroots Program in brochures, news releases, programs, and all other printed and online publications. Copies of such printed materials must accompany the evaluation report. When no printed information is used, verbal credit shall be given. In addition, all print and promotional material must include the following credit line(check all that apply): 2 Revised May 2012 L x County Ftmds y. The Grant Recipient must enter all events, exhibits and performances open to the public and related to this grant award on the ExploreChape1Hi11ARTS.com website and display ExploreChapelHiIIARTS.com publicity materials (postcards, brochures, etc.) prominently and consistently at their venue or performance space. In addition, the Grant Recipient must add a link to the ExploreChapelHillARTS.com (ExploreChapelHillARTS.com logo preferred) to their main webpage. The Grant Recipient shall contact the Orange County Arts Commission for replacement ExploreChapelHillARTS.com publicity materials. 7. Indemnity. The Grant Recipient agrees to indemnify and hold harmless the County, the Arts Commission and the North Carolina Arts Council and their officers and employees from any and all claims or actual injury, damage or loss to a person, or real or personal property that results from or is in any way connected to the use of the grant funds. 8. Independent Contractor. The Grant Recipient is an independent contractor and not an employee, agent or other representative of the County and/or the Arts Commission. Nothing contained in this Agreement shall be construed to create the relationship of principal and agent, or employer and employee, between Grant Recipient and Arts Commission or Orange County Government. Grant Recipient understands and agrees that he/she is not authorized to incur any expenses or any liability whatsoever on behalf of the County or the Arts Commission and has no authority, expressed or implied, to obligate or make representations on behalf of the County or the Arts Commission. In addition, Grant Recipient agrees to maintain his or her own worker's compensation insurance for himself/herself and his or her employees for the duration of the art work's installation. 9. Termination A. In the event of any of the circumstances set forth below(hereinafter referred to as "default"),the Arts Commission may immediately terminate this Agreement: (i) Any fraudulent representation in any verification required to obtain payment under this Agreement or other dishonesty on a material matter relating to the performance of services under this Agreement. (ii) Nonperformance, incomplete service or performance, or failure to satisfactorily perform any part of the Project or to comply with any provision of this Agreement, as determined by the Arts Commission in its sole discretion. 3 Revised May 2012 (iii) Failure to adhere to the terms of applicable county, state or federal laws, regulations, or stated public policy. B. In the event of default by the Grant Recipient, the Arts Commission has the discretion to elect to terminate this Agreement, in whole or in part and/or require the Grant Recipient to repay the grant funds within seven (7) from written notice of default or allow the grant recipient the opportunity to cure the default. This clause shall not be interpreted to limit the County's or the Arts Commission's remedies in law or in equity. 10. Miscellaneous. A. Entire Agreement. This Agreement and the attachments contain the final and entire understanding of the parties with respect to the subject matter of this Agreement. All modifications and amendments to this Agreement shall be in writing. This Agreement shall be binding upon the parties, their heirs, successors and assigns. B. Governing Law. This Agreement shall be interpreted in accordance with the laws of the State of North Carolina and the Orange County. ORGANIZATIONAL DESCRIPTION The Friends of the Carrboro Branch Library, a voluntary non-profit organization that enjoys the support of over 200 people from Carrboro, South Orange and Chapel Hill, has been an active community group for more than twenty five`years. The Friends were instrumental in bringing the need for a branch library in Carrboro and southern Orange to the attention of the Board of Orange County Commissioners and in guiding its establishment. Currently, the Friends are actively involved in the development and expansion of the County's Library system and particularly with the building of the southern branch of the Orange County Library. It is anticipated that it will be at least four years before that project is completed. The Carrboro Branch Library opened in the Mc Dougle Schools Media Center, Carrboro on May 1 1995 under the auspices of the Chapel Hill- Carrboro School System and Orange County. The Media Center now serves both the McDougle Elementary and Middle Schools and the Carrboro Branch Library. Until June 1996, when the Orange County Public Library took over the running of the branch library, the Friends filled a part-time position with volunteers, five days a week. (It must be added here that even though we are located in a school setting we have a distinct identity as the Carrboro Branch Library during operating hours). The Friends current tasks include planning and hosting community arts and cultural activities, community outreach activities at Town events such as Carrboro Day and the Fourth of July, and the running of the annual book sale (in November). These activities are in addition to our commitment to ongoing library support services and serving on County and regional boards such as the 2000, 2004 and 2007 Orange County Library Task Force. (The Friends of the Carrboro Branch Library's role in the development of an overall library plan for Orange County was acknowledged at a 2007 Board of Orange County Commissioners meeting.) More recently, in July 2008, the Friends were instrumental in getting "cut hours" reinstated in all of Orange County's Libraries while in October 2008 a Friends' representative was involved in the selection process for a new Orange County Library Director. Z In the spring of 2009 the Friends of the Carrboro Branch Library were instrumental in leading the fight against the complete closure of the Carrboro Branch Library and were successful not only in preventing the closure but also in getting the Board of County Commissioners to increase funding for libraries in general. In 2001, The Friends of the Carrboro Branch Library received two awards for their dedication to supporting the Library. The Friends of Libraries USA honored our group with the place of First Runner Up (i.e. second in the nation) for their submission to the Baker and Taylor Small Libraries Award. The submission featured the Library's Arts Program for 2001, including four large exhibitions and related workshops. The second award was the Frances B. Reid Award given to the Friends of the Carrboro Branch Library by the The Friends of North Carolina Public Libraries for the group's outstanding library support and community involvement. This award was given in large part to the Carrboro Friends because of their Library Arts Program. Meanwhile, Friends of Libraries USA has included the Carrboro Branch Library's Arts Program in a book on successful library programs. The Friends received another Frances B Reid Award in 2011 for the role as library advocates. B.CURRENT PROGRAMS AND SERVICES The Friends of the Carrboro Branch Library are an important part of that Library given the facility's small staff and sparse funds. Our group runs outreach community book sales and is a major force behind the Library's involvement with the Community Dinner celebrating Orange County's cultural diversity, held annually in the Mc Dougle Schools Cafetorium. The artist-run Friends Art Committee is entirely responsible for the Library's Arts Program and every year it plans and stages four large exhibitions in the 7,500 square foot Library with related workshops and cultural programs. The Committee has enjoyed exceptional support from both the Friends and the Orange County Arts Commission since the Library opened in May 1995. In 2007, the Orange County Arts Commission rejected our application for funding support for our 2008 program but granted us $1500 in 2008 for 2009 for which we are grateful The OCAC denied the Library Arts Program funding for 2010 but we enjoyed OCAC support for our program in both 2011 and 2012. We are hoping for OCAC support for our 2013 Library Arts Program. Since starting its arts programming in 1996, the Library has shown the work of over 1500 (mostly local) visual artists. Since 1996 all exhibits have involved the community and local artists, agencies and institutions. Even though we hope to be moving into a free standing library facility in a few years time where there will be a designated art gallery space, the minds of the Friends are currently on the need to find funds to supplement the Library's current operating budget and programs--- including the popular Library Arts Program. Currently showing at the Library is the juried exhibition "Spiritual Spaces"- part four of four community based exhibitions on that theme in 2012. C.GRANT PROPOSAL FOR 2013 - PROPOSED USE OF GRANT FUNDS. The aim of the Carrboro Library Arts Program is to encourage local artists and culturally diverse groups to display their work on the walls of the Carrboro Branch Library/1\4c Dougle Schools Media Center in conjunction with Library programs and public events. The location of the Library in the McDougle Schools gives the Friends, Library and Arts Commission an unprecedented opportunity to introduce over 1400 children per year to the full spectrum of cultural arts, as well as to all members of the Library that frequent the facility. We would like to stress that each year our cultural programs have been different, and since May 1996, we have shown the work of over 1500 culturally diverse artists and cultural groups. Our proposed exhibitions for the coming year have their usual emphases on multiculturalism and community and Library support for locally produced arts, crafts and culture. We must also stress the continued need for a professional to work with our volunteers in the hanging of exhibitions, given the large spaces and heights involved. We hope that the Commission will decide to support the following new endeavors in 2013. In 2013 the Library Arts Program has decided to take as its theme "Artist run community art programs." Over the years artist run initiatives have become increasingly important in our area and the Library Arts Program plans to focus on four of them. The first exhibit from mid January through mid March will feature the Saxapahaw Art Gallery, its artists and its work. "The Saxapahaw Artists" is a volunteer organization founded on simple goals-to bring arts and arts related activity to the community and the highlighting of Saxapahaw as a positive, growing and creative cultural community. In their quest to create a greater community awareness of the arts, Saxapahaw Artists provide a series of community outreach programs which include artists talks, free festivals and art related events. Many Orange County artists belong to Saxapahaw Gallery and their exhibition at the Carrboro branch Library will include the work of some of those artists. The Saxapahaw Gallery is run by volunteer artists. Recently, when the gallery moved into another building, renovation was achieved using local volunteer labor and recycled materials. Our second exhibit from late March through mid June will feature artists from FRANK Gallery (Franklin Street Artists Collective) in Chapel Hill. FRANK gallery is run by 22 member artists and shows the work of over one hundred local and regional artists. It is also a non profit organization and is heavily engaged in community outreach activities. In 2010, repurposed sculptures from the Carrboro Branch Library's Polar exhibit (partially financed by OCAC) were shown at FRANK and the revenue from their sale was ploughed back into the McDougle Middle School and Library Community thus enabling a new art project to take place. During the period of FRANK's show at the Library we are planning a joint art activity between FRANK artists and the Mc Double Middle School technology department. Information on FRANK Gallery, FRANK artists and others involved in this exhibition can be found in the relevant attached envelope Our third exhibit from mid June from mid October 2013 will feature artists from the Hillsborough Art Gallery Hillsborough Art Gallery, a collective of twenty two artists working across many different media, is owned and operated by local artists. It exhibits many different media including painting, sculpture, ceramics, photography, fiber art,jewelry, glass, metal, mosaics, encaustics, enamels, watercolors and wood. At the Library they will show mostly two dimensional pieces and if possible a few three dimensional wall mounted pieces. The Library is discussing a possible workshop Jed by HAG artists—date to be arranged. Please see the attached relevant envelope for artist information and work examples Our fourth exhibition from late October through early January 2014 will showcase the end products of the Ackland Art Museum's community art programs which involve many different local artists from the community. The Ackland's External Affairs Director Amanda Hughes is also an artist and she is particularly involved with the program "Plain air in the galleries". In addition to showing an assortment of Ackland student's work,, this exhibit will also show some of"teacher:" Hughes's work and those of her Ackland students. This slate of exhibitions at the Carrboro Branch Library in 2013 aims to educate the general public about the important role played by local artists both in the economic promotion of the arts and as major leaders in local art initiatives. Since the beginning of the 2008 recession many commericial galleries have receded from the local arts "landscape" and artist led initiatives have assumed the lead in the management of many important local arts spaces. This experience has been empowering for artists. I often do a series of works of the same subject in shifting light, seasons and weather. When painting animals, I usually document their movements in a series of works done on site and in their home environments. I visited the Antarctic Peninsula in December 2007 and in July 2009 worked in the Norwegian Arctic,As a result of these Polar experiences,I produced a large body of work on Polar animals and landscapes for the multimedia exhibition"Ice Counterpoint" at UNC's Fed Ex Global Education Center from January 7 through May 3120 10 and"Artico, Asolo Antartico"at the Asolo Civic Museum, Veneto,Italy in November 2010. In 2013, some of these Polar works will be on exhibit at the National Humanities Center during their human rights conference and at the Whatcomb Museum,Bellingham,WA,in their exhibit"Vanishing Ice." These exhibitions were and are intended to put a face on the earth's endangered Polar regions and to examine the implications of the changes there for the rest of our planet. PROFESSIONAL BIOGRAPHICAL SKETCH Born in Wales and a twenty one year resident of Carrboro,North Carolina,Nerys Levy is deeply rooted in her native country's culture which has influenced her painting. Levy had a first career in race relations, community work and education, working in India,the Caribbean, South Africa and London. She has a PhD in Modern South Asian History from the University of London. Although she painted throughout much of her childhood,Levy began serious studies in 1980 in La Jolla, California,working with various members of the Visual Arts Department of the University of California at San Diego. She also studied at the Pacific Art League in Palo Alto, California. Many of her works are in private collections both in Europe and the United States. As Chairperson of the Carrboro Branch Library Art Committee and a member of the Horace Williams House Art Committee, during the past twenty years Nerys has curated at least seventy exhibitions. She is also a member artist of FRANK Gallery,Chapel Hill. Nerys has also worked with children's groups in both North Carolina and Italy in an attempt to educate them about the earth's endangered Polar Regions. Her Polar work has resulted in various collaborations with other artists and scientists involved with Polar studies. Call the Library at 919-969-3406 for information CARRBORO BRANCH LIBRARY What's Up: Our Fascinating Local Skies April 3rd through June 18th Rocket launching and art viewing: Monday May 14th at 5:30 What's Up: Our Fascinating Local Skies is a unit for 6th grade Science/Technology students,focusing on an awareness of outer space and on possibilities for exploring it. The program rests on two primary hands-on activities: one emphasizing engineering and technology,and the other,aesthetics and imagination. In the first activity, supervised by Technology Lab teacher Redmond Grigg,each student received a kit for constructing a model rocket,complete with solid fuel motor and parachute. The students assembled,painted and launched their rockets over the course of several weeks,while exploring concepts of design,construction, propulsion and aerodynamics. In the second activity,artist Joey Howell, representing the Carrboro Branch Library(over a period of two days)led the class in creating paintings inspired by the Solar System and deep space objects. Using reference photos from the Hubble Space Telescope, the students produced original spacescapes expressing their personal visions of the Cosmos. They learned that the chaotic fluid dynamics of paint and water are closely related to the energetic forces at play in space. There was also time to talk about art and backyard astronomy with interested students. On another day,Library Art Committee Chairperson Nerys Levy,along with Redmond and Joey,joined the class in a discussion on the possibility of space travel,where they might want to go,what special skills and abilities would be required and why it is important for humankind to continue its efforts to explore the Cosmos. The students also had a chance to examine an 8-inch reflecting telescope up close and to learn how a telescopic image is formed. Finally,the students and Joey mounted an exhibition in the Carrboro Branch Library featuring both their original artwork and the previously launched rockets. The class took an active role in conceiving and organizing the display. The sometimes-destructive results of the rocket launches served to illustrate the perilous nature of space flight. The students' efforts resulted in beautiful artwork,for which they deserve to take great pride in showing to the public. The creators of this program,Redmond Grigg,Joey Howell and Nerys Levy,hoped to instill in the students an excitement about the Universe and the possibility of exploring it, and to nurture the next generation of scientists, engineers, astronauts and artists.
