a ORANGE COUNTY ARTS COMMISSION z i K n H G k COUNTY A R 7$ FALL,2012 GRANT AGREEMENT c � \ C31SAt5SfON 0 THIS AGREEMENT, entered into this 14th day of December, 2012, by and between Orange County ("County"), by and through the Orange County Arts Commission ("Arts Commission") and Franklin Street Arts Collective dba FRANK Gallery("Grant Recipient"). WHEREAS, the Arts Commission is a countywide arts agency that ensures the growth of local arts experiences by providing funding and support for diverse high quality programs and projects. WHEREAS, the Arts Commission administers the Spring and Fall Arts Grants Program to provide economic opportunities to Orange County artists and non-profit organizations coordinating arts projects benefiting the citizens of Orange County. WHEREAS, the Spring Arts Grants Program is supported by Arts Commission with funds from the Grassroots Program of the North Carolina Arts Council, an agency of the Department of Cultural Resources and the National Endowment for the Arts. WHEREAS, the Grant Recipient was selected by the Arts Commission to receive the Spring Arts Grant through the procedures duly adopted by the Arts Commission; and WHEREAS, both parties wish to promote and maintain the integrity and clarity of the Grant Recipient's ideas and statements and delineate the Grant Recipient's obligations to the County; NOW, THEREFORE, the County and the Grant Recipient, for the consideration and under the conditions hereinafter set forth, agree as follows: 1. Approved Grant Project. Grant funds are provided under this Agreement for the project ("Project") described in the Grant Recipient's Grant Application, attached hereto and incorporated herein as Exhibit A. 2. Grant Award. Grant funds in an amount not to exceed one thousand five hundred dollars ($1,500) have been awarded by the Arts Commission to the Grant Recipient for the approved Project. These funds must be matched at least dollar-for-dollar with cash from the Grant Recipient's funds not derived from either Orange County appropriations or the North Carolina Arts Council. 3. Contingency. This grant is contingent on North Carolina Arts Council Grassroots Program funding to the Arts Commission. Final decisions on Grassroots Program funds to the North Carolina Arts Council are subject to approval by the North Carolina General Assembly. 4. Responsibilities of the Grant Recipient 1 Revised May 2012 A. Implementation. The Project implementation shall take place between January 1, 2013 and December 31, 2013. The Project shall be implemented in the manner described in Exhibit A. Time is of the essence in the implementation of the Project. B. Modifications to project. Grant Recipient shall present major changes to the original proposal, including but not limited to changes in design, implementation schedule and increase in Project budget by more than 10%, in writing to the Arts Commission for approval. Arts Commission shall approve or disapprove Grant Recipient's request for modifications within seven (7) days of receipt thereof. Consent to project modifications shall not be unreasonably withheld. Arts Commission's decisions shall be in writing. In the event the Arts Commission fails to approve or disapprove the requested modifications within the time stated herein,the modifications shall be deemed approved. C. Non—assignment. The grant cannot be assigned or transferred to a different project or artist without prior written approval of the Arts Commission. D. Records. Grant Recipient must maintain records and other evidence pertaining to costs incurred and revenues acquired during the Project implementation. Grant Recipient shall maintain financial records pertaining to the Project for three (3) years from the date of this Agreement, in case of audit. E. Use of Funds. Grant Recipient shall not use the grant funds to repay outstanding taxes or other debts of any nature. The grants shall be utilized solely for the purpose of implementing the Project and Project related expenses. F. Final Report. Grant Recipient shall submit to the Arts Commission a Final Report on January 14 , 2014 . The Final Report shall be in the format required by the North Carolina Arts Council. Failure to submit the Final Report or late submission of the Final Report, for any reason, shall be grounds for denial and/or cancellation of grant funds for the Project and future grant proposals. 5. Responsibilities of the Arts Commission A. Payment. The Arts Commission shall release the grant funds in the amount of $1,500 to the Grant Recipient. 6. Publicity A. Acknowled ement. Credit must be given to the Orange County Arts Commission using the Arts Commission logo and if State funds are received to the North Carolina Grassroots Program in brochures, news releases, programs, and all other printed and online publications. Copies of such printed materials must accompany the evaluation report. When no printed information is used, verbal credit shall be given. In addition, all print and promotional material must include the following credit line (check all that apply): 2 Revised May 2012 i. "This program is supported by the Orange County Arts Commission with funds from the Grassroots Program of the North Carolina Arts Council, a state agency. " B. The Grant Recipient must enter all events, exhibits and performances open to the public and related to this grant award on the ExploreChapelHHURTS.com website and display ExploreChape1Hi114,RTS.com publicity materials (postcards, brochures, etc.) prominently and consistently at their venue or performance space. In addition, the Grant Recipient must add a link to the ExploreChape1Hi11ARTS.com (ExploreChapelHillARTS.com logo preferred) to their main webpage. The Grant Recipient shall contact the Orange County Arts Commission for replacement ExploreChape1HillARTS.com publicity materials. 7. Indemnity. The Grant Recipient agrees to indemnify and hold harmless the County, the Arts Commission and the North Carolina Arts Council and their officers and employees from any and all claims or actual injury, damage or loss to a person, or real or personal property that results from or is in any way connected to the use of the grant funds. 8. Independent Contractor. The Grant Recipient is an independent contractor and not an employee, agent or other representative of the County and/or the Arts Commission. Nothing contained in this Agreement shall be construed to create the relationship of principal and agent, or employer and employee, between Grant Recipient and Arts Commission or Orange County Government. Grant Recipient understands and agrees that he/she is not authorized to incur any expenses or any liability whatsoever on behalf of the County or the Arts Commission and has no authority, expressed or implied, to obligate or make representations on behalf of the County or the Arts Commission. In addition, Grant Recipient agrees to maintain his or her own worker's compensation insurance for himself/herself and his or her employees for the duration of the art work's installation. 9. Termination A. In the event of any of the circumstances set forth below(hereinafter referred to as "default"), the Arts Commission may immediately terminate this Agreement: (i) Any fraudulent representation in any verification required to obtain payment under this Agreement or other dishonesty on a material matter relating to the performance of services under this Agreement. (ii) Nonperformance, incomplete service or performance, or failure to satisfactorily perform any part of the Project or to comply with any provision of this Agreement, as determined by the Arts Commission in its sole discretion. 3 Revised May 2012 (iii) Failure to adhere to the terms of applicable county, state or federal laws, regulations, or stated public policy. B. In the event of default by the Grant Recipient, the Arts Commission has the discretion to elect to terminate this Agreement, in whole or in part and/or require the Grant Recipient to repay the grant funds within seven (7) from written notice of default or allow the grant recipient the opportunity to cure the default. This clause shall not be interpreted to limit the County's or the Arts Commission's remedies in law or in equity. 10. Miscellaneous. A. Entire Agreement. This Agreement and the attachments contain the final and entire understanding of the parties with respect to the subject matter of this Agreement. All modifications and amendments to this Agreement shall be in writing. This Agreement shall be binding upon the parties, their heirs, successors and assigns. B. Governing Law. This Agreement shall be interpreted in accordance with the laws of the State of North Carolina and the Orange County. The mission of the Franklin Street Arts Collective is to support the arts community of Chapel Hill and the region,strengthen community appreciation of the arts through educational outreach,and promote the Town of Chapel Hill and North Carolina as a major Arts Destination. See supplementary page on Background. Grant Request for FRANKJnFocus, Focus on Outreach Through Expressive Art Projects In conjunction with our Community Outreach mission,we are requesting funding from the Arts Commission to enhance our growing Educational Arts Outreach programs.FRANK is committed to providing opportunities for educational arts programming for a diversity of populations including children and teens,and those with special needs. For 2013,FRANK will be partnering with several programs through our "Focus on Outreach Through Expressive Art Projects" community arts efforts.We are now expanding our outreach efforts of FRANK:inFocus,our successful photography festival,to include visual and performing arts,focusing on programs for teens and children.We will continue to use photography as well as creative writing,music,painting,collage,and drawing. For our second year,we are bringing teens to our gallery through a pre-college class at the Elon Academy entitled,"Self-Expression through Photography and Creative Writing," specifically designed for first generation college-bound,predominantly minority students.(See sample photos with DVD and online at http://www.btyroler.com/FRANKandEA/ ) Students will receive a private tour of the gallery and have their work critiqued by FRANK artists.Additional funding was received from Elon University and the Heim Foundation,to support an exhibit of their work,and FRANK has reserved the Community Wall Gallery for April with an opening reception and presentation by the teens on April 27,2013. "Brushes with Life: Art,Artists,&Mental Illness" is a creative arts program for people in treatment for mental illness at the UNC Center for Excellence in Community Mental Health. Patients display their work in the Brushes with Life Gallery,located on the third floor of the NC Neurosciences Hospital.FRANK partners with Brushes with Life consultant Art therapist Bridget Pemberton-Smith,current president of the North Carolina Art Therapy Association,for seminars and art presentations at FRANK's Community Wall gallery.Bridget is also working to bring teens from the iCancer project to FRANK for a similar experience.Founded by a recreational therapist at N.C.Children's Hospital,the expressive photography program helps teenagers battling cancer document their experiences through photographic portrait-making and storytelling. 2 ProUosed Uses of Grant Funds FRANK is requesting funding from the Arts Commission to specifically fund exhibitions for our Community Wall Gallery.This includes mounting photographs and wall text;printing of show cards;and administrative support for invitations, mailing,and continued networking with programs for children and teens. FRANK artist members Nerys Levy and Barbara Tyroler will volunteer their time with the teen programs implemented in conjunction with the exhibitions. Levy will give tours of the gallery and may provide painting workshops, while professional photographer Tyroler will document the activities, gifting photographs to the participants. She will lead the students in a public presentation describing their work and the benefits of using photography to broaden the understanding of their culture and community. We envision these projects as an introductory pilot session to determine the needs and desires of the community for ongoing relationships with organizations that support children and teens in need. If successful, we hope to include other FRANK artists and community members to engage in multidisciplinary approaches to working with children and teens through the visual and performing arts, and to broaden our audience to enjoy our community salons and art exhibits. Many of our artists are nationally recognized and contribute a wide range of artistic vision and skills. Themed Exhibitions designed by the members (6 per year) focus attention to specific ideas and techniques and reach out to regional and major national guests artists. Our Featured Artist Spotlight Exhibitions showcase the work of member artists once every 2 years. Community Exhibitions showcase work from Orange County artists. Twice a year, our Community Gallery partners with a diverse population of organizations and individuals to provide a month long exhibition and forum for exchange of ideas through our Arts Outreach Program. Programs, Outreach, and Education,the Non-Profit Arm of FRANK In keeping with our educational mission to extend appreciation of the arts through the non-profit arm of our gallery,FRANK offers workshops, salons, and innovative and inclusive community outreach activities for sharing of ideas and inspiration through forming partnerships between a diverse population of artists and our community. Artist Salons Thursday evening Artist Salons bring together our artists, our community resources,and the public to provide opportunities for educational enrichment with a diversity of presenters and participants. Our own member artists and consigners share their work and methods. Guest artists read original poetry,perform readings of plays,entertain and experiment with new music, and foster community and dialogue. These salon nights have been well received with 20-60 participants. During the FRANK:inFocus festival,we hosted 9 Salons at FRANK between September-Nov 1,averaging alone 50 per salon. We co-hosted 7 off-site forums including the Town of Chapel Hill Wallace Deck,the Carrboro Art Center,and numerous universities, galleries, and museums,throughout the Triangle. 4 Communitv Wall Through our community outreach program, the Community Wall Gallery showcases a diversity of artists and community non-profit health and educational oriented programs. We host exhibits with seniors from the Chapel Hill Senior Center;children from McDougle Middle School and the Kidzu museum;and the Stories Through Murals Project, Dominican painters using art to build bridges between nations. In conjunction with the FRANK: inFocus festival, we hosted multimedia experimental video and sound installations from the UNC MFA graduate students and plan an exhibition with Elon Academy pre-college high minority students. Spgcial Events and Workshops With membership and grant support, FRANK offers art critique, workshops,and guest presentations on topics ranging from health and wellness to special learning styles and new technological developments in communication and science. For young children,families, and seniors: Member artists work with Kidzu,a Chapel Hill interactive children's museum, to bring programs to youngsters up to age 8 at both Kidzu and FRANK locations. In conjunction with the FRANK:inFocus festival,member artist and educator Barbara Tyroler taught a parent education workshop at Kidzu Museum on How to photograph your Child,emphasizing meaning and memory associated with family photographs. We have sponsored activities with Carolina Meadows, Carol Woods,and various retirement and creative aging centers in the Triangle. We plan to host a series of workshops with Duke's Osher Lifelong Learning Institute,a continuing education program, bringing seniors to the gallery to meet our artists. For teens: The Sacrificial Poets,an outstanding local youth group created a physical representation of their poetic works on our Community Wall in collaboration with FRANK fiber artist, Peg Gignoux. They have returned twice to perform their poetry. In collaboration with FRANK photographer artist,Barbara Tyroler,at-risk high achieving teens from a pre-college community programs, the Elon Academy, took a field trip to meet the gallery director and artists and to have their photography critiqued by FRANK members. They will return in spring 2013 for an exhibition and tour. For health care patients: The Community Art Wall at FRANK has hosted work from patients at the psychiatric, oncology and hematology units of UNC Health Care System as well as those in the pediatric ward at the Lineberger Comprehensive Cancer Center. We have project proposals underway to include Wrap Your Head Around It coordinated by fiber artist,Peg Gignoux in partnership with the Cornucopia Cancer Support Center to create hand-dyed scarves that feature original poetry exploring the Heroic Journey of cancer patients, survivors and their caregivers. During the past year we have presented Brushes with Life,a community health organizations to show works created by artists with mental illness. We plan to partner with the iCancer program,an expressive therapy through photography project for teens,at the UNC Hospitals. During the FRANK:inFocus festival we hosted a graduate student from UNC School of Public Health to describe her experiences in Malawi photographing and documenting mothers and daughters in a fistula clinic. 5 For the community: Twice a month FRANK hosts local artists and community members who present their art, music,and their life's work to the community.The programs have included: Deep Dish Theater, Mallarme Chamber Players and KidZNotes. In addition,artists have demonstrated traditional pottery techniques,black-and-white and infrared photography,encaustic painting, eco farming, dance,bookmaking as art, bee keeping,wallpaper and tile design and drawing. mahaloJazz participated in the FRANK:inFocus outdoor slide show and will return with a Downtown Arts Project grant for a photography/video/musical improvisation sound and light performance. With grant support from OCAC,FRANK offered its first series of educational workshops this past year including drawing,photography,and singing. We have since expanded these offerings through a series of educational forums through the FRANK:inFocus festival where we offered over 20 free events to the community free of charge.Topics ranged from collecting photography as art to journalistic practices in documentation for publications. We brought speakers from a variety of organizations such as the photography curator of the NC Museum of Art,The Light Factory in Charlotte,the past co-president of the MidAtlantic American Society of Media Photographers, Director of the Lewis Hine Foundation at the Center for Documentary Studies, and owner founder publisher of Daylight magazine, based in Hillsborough, NC. Through this endeavor,we were able to build and strengthen our relationships with area schools, galleries,museums,art organizations, and community centers. His paintings, prints and sculpture are in private and corporate collections nationally. Gordon is a founding member of the Orange County Artists Guild, Orange County, North Carolina. He served as co-chair from 2003 to 2005, and was the Artist Liaison until 2009. He has participated in Open Studio Tours since 1980 and has been involved with the Orange County Open Studio Tour since it began in 1995. He has served on the Orange County Arts Commission Board of Directors since 2000. LEVY 161, Swansea Lane, Chapel Hill, N.C. 27516 Phone-Cell: 919-417-3081 Home: 919-932-1533 Email: rilevy @mindspring.com Website: www.nerysievy.com ARTIST'S STATEMENT Working on site using mixed water-based media on paper, I try to portray the forms and forces of nature: Polar landscapes and wildlife, Chinese urban and riverine landscapes,Alamance, Orange and Chatham county locations,North Carolina's forests,Alpine masses and glaciers, cloud formations, animals (especially dogs), European gardens and old architectural forms altered by time. I often do a series of works of the same subject in shifting light, seasons and weather. When painting animals, I usually document their movements in a series of works done on site and in their home environments. I visited the Antarctic Peninsula in December 2007 and in July 2009 worked in the Norwegian Arctic, As a result of these Polar experiences, I produced a large body of work on Polar animals and landscapes for the multimedia exhibition"Ice Counterpoint" at UNC's Fed Ex Global Education Center from January 7 through May 3120 10 and"Artico, Asolo Antartico"at the Asolo Civic Museum, Veneto, Italy in November 2010. In 2013, some of these Polar works will be on exhibit at the National Humanities Center during their human rights conference and at the Whatcomb Museum,Bellingham, WA, in their exhibit"Vanishing Ice." These exhibitions were and are intended to put a face on the earth's endangered Polar regions and to examine the implications of the changes there for the rest of our planet. PROFESSIONAL BIOGRAPHICAL SKETCH Born in Wales and a twenty one year resident of Carrboro,North Carolina,Nerys Levy is deeply rooted in her native country's culture which has influenced her painting. Levy had a first career in race relations, community work and education, working in India, the Caribbean, South Africa and London. She has a PhD in Modern South Asian History from the University of London. Although she painted throughout much of her childhood,Levy began serious studies in 1980 in La Jolla, California, working with various members of the Visual Arts Department of the University of California at San Diego. She also studied at the Pacific Art League in Palo Alto, California. Many of her works are in private collections both in Europe and the United States. As Chairperson of the Carrboro Branch Library Art Committee and a member of the Horace Williams House Art Committee, during the past twenty years Nerys has curated at least seventy exhibitions. She is also a member artist of FRANK Gallery, Chapel Hill. Nerys has also worked with children's groups in both North Carolina and Italy in an attempt to educate them about the earth's endangered Polar Regions. Her Polar work has resulted in various collaborations with other artists and scientists involved with Polar studies. These include Brooks de Wetter Smith-UNC Music Department(flutist,videographer and photographer); Terry Misesko, (musician and composer)NC Symphony; Jose Rial, geophysicist,UNC;Rose Cory, UNC Environmental Studies; James Peacock,UNC Anthropology and Florence Peacock, singer.
