Orange County Schools— Clarence Grier, (919) 245-2453 Lottery Proceeds Application PURPOSE: To approve an application to the North Carolina Department of Public Instruction (NCDPI) to release funds from the NC Education Lottery account related to FY 2012-13 debt service payments for Orange County Schools, and to approve Budget Amendment #4-A (amended School Capital Project Ordinances) contingent on the State's approval of the application. BACKGROUND: Both School Systems have previously presented approved resolutions from their respective Boards requesting that the County modify its Capital Funding Policy by applying accumulated lottery funds for debt service payments and permitting current year withdrawals immediately after the State's quarterly lottery fund allocations. This expedites both the application process and the receipt of funds for the school systems. Currently, the accumulated available lottery funds for Orange County Schools (OCS) is $237,735. The attached application requests the State to release lottery funds of $230,000 to cover debt service for the Orange County Schools system. Bonds) Location: Type of Facility: North Carolina General Statutes, Chapter 18C, provides that a portion of the proceeds of the North Carolina State Lottery Fund be transferred to the Public School Building Capital Fund in accordance with G.S. 115C-546.2. Further, G.S. 115C-546.2(d) has been amended to include the following: (3) No county shall have to provide matching funds... (4)A county may use monies in this Fund to pay for school construction projects in local school administrative units and to retire indebtedness incurred for school construction projects. (5) A county may not use monies in this Fund to pay for school technology needs. As used in this section, "Public School Buildings"shall include only facilities for individual schools that are used for instructional and related purposes, and does not include central administration, maintenance, or other facilities. Authorization and Issuance of Up to $20,000,000 General Obliaation Refundina Bonds The Board adopted a resolution, which is incorporated by reference, authorizing the issuance of general obligation refunding bonds in the maximum amount of$20,000,000 to refinance existing County bonds. L Proposed Land Donation by Dennis and Linda Brooks The Board accepted the donation of a 1.07-acre parcel in Cheeks Township from Dennis and Linda Brooks for open space and recreation purposes and authorized DEAPR staff to work with Dennis and Linda Brooks and the County Attorney to prepare a deed for the transfer of the subject property to Orange County. k. Terradotta, LLC Lease Renewal—501 W. Franklin Street; Suites 105 and 106 The Board renewed a lease with Terradotta, LLC for Suites 105 for$10,728 per year and Suite 106 for $6,432 per year at 501 West Franklin Street through December 2, 2013 and authorized the Chair to sign. 1. Buckhorn Mebane Utilities Phase 2 Project Easements The Board authorized the Chair to sign easement documents on behalf of the Board; authorized the payment of negotiated easement value to individual property owners; and authorized the County Attorney's office to proceed with legal acquisition of utility easements with court filings, as necessary. M. Housing Bond Program — Rusch Hollow The Board awarded housing bond funds in the amount of$144,304 to Habitat for Humanity for the construction of a rental duplex in the Rusch Hollow subdivision. n. Senior Care of Orange County, Inc.—Revised BY-Laws and Lease Agreement This item was removed and placed at the end of the consent agenda for separate consideration. 0. Amending the County Manager's Employment Contract The Board approved the amendment of the County Manager's employment contract to allow for an amended hire date and a travel allowance. 6. Public Hearinas a. Smoke Free Public Places The Board conducted a public hearing to receive comments from the public regarding smoke free public places and considered approval, by Ordinance, of the Orange County Board of Health's Smoke Free Public Places Rule adopted by the Board of Health on October 24, 2012 and authorizing the Chair to sign.
