BACKGROUND: In January 2001, the Board approved a Federal Emergency Management Agency (FEMA)-approved hazard mitigation grant program (HMGP) agreement that would provide Federal and State funding for the acquisition and demolition of two flood damaged homes in the Heritage Hills subdivision. The damage stemmed from Hurricane Floyd and its aftereffects in September 1999. The Board also approved an agreement with PBS&J, a Raleigh consulting firm with expertise in FEMA program implementation, to administer and implement the program, which provides funds to pay the two homeowners for relinquishing their property. The structures on those properties would then be removed from the floodway (preferably through deconstruction, rather than demolition, if possible) and the grounds restored to a natural state, with the County retaining title to the lots. During the past six months, PBS&J has been making solid progress in working with the homeowners and the State to complete the voluntary acquisition of these properties. They have also handled the paperwork associated with a later application for repair and renovation grant funds for a home in Carrboro. Assuming the Heritage Hills homeowners decide to accept the buyout offers, they will also be eligible to receive certain other grant funds to help relocate them into comparable housing. In January, the Board authorized the County Manager to process and sign all documents related to implementation of the HMGP and all associated grant programs. Certain documents will require two County signatures to authorize disbursement of funds to eligible grant recipients. Accordingly, staff recommends that the Board approve the attached resolution, which would authorize the Assistant County Manager and the Finance Officer to sign grant program documents and/or financial instruments in addition to or in lieu of the County Manager. 2 FINANCIAL IMPACT: There is no significant financial impact associated with the approval of the attached resolution. Federal and State grant funds will cover all costs associated with the potential acquisition of flood damaged properties, relocation of families, any repairs and renovations, and the administrative services provided by PBS&J. No County funds are involved. RECOMMENDATION(S): The Manager recommends that the Board approve the attached resolution. 3 ORANGE COUNTY BOARD OF COMMISSIONERS A RESOLUTION AUTHORIZING DESIGNATED AGENTS TO ACT ON BEHALF OF ORANGE COUNTY TO IMPLEMENT VARIOUS FEDERAL AND STATE HURRICANE RELIEF GRANT PROGRAMS WHEREAS, on January 18, 2001, the Orange County Board of Commissioners approved an application for federal and state Hazard Mitigation Grant Program (HMGP) funds and authorized the County Manager to execute any other agreements or documents pursuant to the full implementation of the HMGP and related grant programs, and WHEREAS, certain residents of Orange County have since been determined to be eligible for additional federal and state grant funds that must be administered by the County as the "Recipient/Subgrantee", and WHEREAS, it has become evident that the timely and efficient implementation of the HMGP and other Hurricane Floyd-related grant funding programs will be enhanced by the appointment of additional designated agents, NOW, THEREFORE, BE IT RESOLVED THAT the Orange County Board of Commissioners does hereby appoint • John Link, County Manager • Roderick Visser, Assistant County Manager • Kenneth Chavious, Finance Officer as its designated agents to carry out all necessary administrative and financial tasks as may be required by the North Carolina Department of Crime Control and Public Safety and or the Federal Emergency Management Agency (FEMA) to ensure that eligible Orange County residents receive the grant funded benefits applied for by the County and approved by FEMA and/or the State; and BE IT FURTHER RESOLVED that the designated agents are hereby authorized from program inception to conclusion to take actions including, but not limited to: preparing, signing, and/or submitting applications for grant funding, activity reports, cost reports, requests for disbursement of funds, program agreements, other financial instruments, agreements with Board of Commissioner-approved subcontractors, and the like; and that this authorization applies to all Hurricane Floyd-related grant funding programs, including but not limited to the Hazard Mitigation Grant Program (HMGP), State Acquisition and Relocation Funds (SARF), Crisis Housing Assistance Funds (CHAF), and the like.
