HomeMy WebLinkAboutRES-2001-119 Resolution approving Fox Hill Farm Central Preliminary Plat RESOLUTION OF THE ORANGE COUNTY BOARD OF COUNTY COMMISSIONERS Date: December 11, 2001 Name of Subdivision: Fox Hill Farm-Central Owner/Applicant: Bob Zumwalt, agent for Randolph D. Fox The Board of County Commissioners hereby approves Fox Hill Farm-Central subdivision preliminary plat, dated September 20, 2001 and containing 91 lots, subject to the fulfillment of requirements specified herein. Farm Gate Drive, Windflower Place, Lee Fox Lane, Fox Hill Farm Drive, Cedar Stone Way, Still Meadow Lane, Starfire Place and Springfield Place shall be irrevocably dedicated to the general public and be constructed to standards of the North Carolina Department of Transportation. The approval of this resolution authorizes and directs the Orange County Manager to accept for Orange County and on behalf of the public generally, the offer of dedication of Farm Gate Drive, Windflower Place, Lee Fox Lane, Fox Hill Farm Drive, Cedar Stone Way, Still Meadow Lane, Starfire Place and Springfield Place. This acceptance by Orange County of the dedication to the general public of Farm Gate Drive, Windflower Place, Lee Fox Lane, Fox Hill Farm Drive, Cedar Stone Way, Still Meadow Lane, Starfire Place and Springfield Place shall be without maintenance responsibility. These roads shall be maintained by the owner/applicant until such time as they are accepted for maintenance by the North Carolina Department of Transportation or some other governmental body. Before the Final Plat of Fox Hill Farm-Central can be recorded: A. Sewage Disposal 1. Each residential lot shall contain an adequate area for septic disposal, and repair area, approved by the Orange County Division of Environmental Health. 2. The septic system location may restrict the size and location of improvements. This disclosure shall be included in a document describing development restrictions to be recorded concurrently with the Final Plat. The document shall also disclose that information regarding the tentative location of septic systems is available from the Orange County Health Department, Division of Environmental Health. B. Roads and Access 1. Farm Gate Drive, Windflower Place, Lee Fox Lane, Fox Hill Farm Drive, Cedar Stone Way, Still Meadow Lane, Starfire Place and Springfield Place shall be constructed to standards of the North Carolina Department of Transportation, within a 50 foot right-of-way with 5 foot utility easements on each side, and the r - 5 construction shall be inspected and approved by NCDOT. OR A letter of credit, escrow agreement, or bond shall be submitted to secure construction of Farm Gate Drive, Windflower Place, Lee Fox Lane, Fox Hill Farm Drive, Cedar Stone Way, Still Meadow Lane, Starfire Place and Springfield Place to the standards of the North Carolina Department of Transportation. An estimate of the construction cost must be prepared by a certified/licensed engineer or grading contractor and submitted to the Planning and Inspections Department. The financial guarantee must reflect 110% of that estimate and be issued by an accredited financial institution licensed to do business in North Carolina. The document describing development restrictions to be recorded with the Final Plat shall state that the financial guarantee will not be released until the road construction has been inspected and approved by NCDOT. 2. All lots shall receive access from the internal subdivision roads. No driveways shall be permitted within 50'of a street intersection. Lots 126-128 and lots 142- 145 shall implement combined driveways. A non-vehicular access easement shall be recorded along Fox Hill Farm Drive from the Baldwin Road intersection to the western lot lines of lot 194 and 195 with the exception of 50' for a driveway on lot 157 and a 30-foot entrance for a potential recycling facility. 3. An erosion control plan for construction of the roads shall be submitted by the applicant to the Orange County Erosion Control Division for review and approval prior to any disturbance on the site. 4. Approved street name signs shall be erected at all intersections prior to recordation of the final plat. 5. Prior to any construction or alteration of any existing access within the right-of- way of New Sharon Church Road or Baldwin Road, the developer/owner shall secure a driveway permit from the NCDOT District Office. Submit a copy of the NCDOT- approved permit and letter to the Planning Department at the same time as the request for Planning Department signatures on the Final Plat. 6. Sight triangles (10'x 70' ) shall be shown on the Final Plat at each intersection. 7. A note shall be placed on the final plat which indicates the proposed northern By-pass, which is part of the adopted Hillsborough Thoroughfare Plan, may be located near the northern property line of this development. The precise alignment was not determined as of the recording of this plat. 8. A center left turn lane on New Sharon Church Road at the Farm Gate Drive Intersection shall be constructed to NCDOT standards prior to Planning Department signatures on the Final Plat for Phase 3. 9. Fox Hill Farm Drive from Farm Gate Drive to Baldwin Road shall be 6 constructed to NCDOT standards prior to Planning Department signatures on the Final Plat for Phase 3. 10. Dedicate 5' additional right-of-way along New Sharon Church Road and Baldwin Road to meet collector road right-of-way standards as identified in the Comprehensive Plan and required in Section IV-B-3-c-1 of the Subdivision Regulations. 11. Build or bond a right turn lane acceptable to NCDOT, based on NCDOT answer to the BOCC request (30' radius and 50-foot taper) regarding Baldwin Road turn lane, at the southern Fox Hill Farm Drive entrance prior to recordation of Phase 3 final plat. If bonding is the option chosen by the developer, the turn lane must be completed prior to issuance of occupancy permits for any structures in Phase 3.(See attached letter) C. Land Use Buffers and Landscaping 1. Landscaping shall be installed or preserved as indicated on the approved landscape plan, and must be inspected and approved by the Planning and Inspections Department. Landscaping shall be placed behind the sight triangles at intersections. OR Guaranteed financially through a letter of credit, escrow agreement, or bond submitted to secure required landscape installation and preservation. An estimate of the cost for required preservation, plantings and their installation must be provided. The financial guarantee shall reflect 110 percent of the estimate and be issued by an accredited financial institution licensed to do business in North Carolina. Provisions for protection of existing trees as shown on the approved landscape plan shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. No clear cutting on individual lots per section IV-B-8-c of the Orange County Subdivision Regulations. 2. A Type A Land Use Buffer shall be provided along New Sharon Church Road within the Homeowners Association open space and along Baldwin Road as shown on the Preliminary Plan. The buffer shall be 30 feet in width on New Sharon Church Road and contain at least 50% evergreen vegetation, forming semi-opaque intermittent visual obstructions from the ground to a height of at least thirty (30) feet. On Baldwin Road the buffer shall be a minimum 30 feet in width and shall be composed of deciduous and/or evergreen vegetation, forming semi-opaque intermittent visual obstructions from the ground to a height of at least thirty (30) feet. Said buffer shall be so noted on the plat, and described in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. The buffers shall be maintained by the Homeowners Association. 7 D. Drainage 1. Locate drainage easements on the final plat as required following review and approval of the Erosion Control Plan. 2. Drainage culverts shall be sized and located as required by NCDOT and a North Carolina licensed Professional Engineer. 3. Impervious surface data, as pursuant to Article 6.23.3c.1 of the Zoning Ordinance shall be included in a document describing development restrictions and requirements to be prepared by Planning Staff and recorded concurrently with the Final Plat. The impervious surface limitations for each lot shall indicate whether the impervious surface includes or excludes one-half(1/2) of the road width in the calculations. E. Parkland 1. Cash in the amount of$41,405.00 shall be paid to Orange County as payment in lieu of parkland dedication prior to recordation of the final plat. 2. The second paragraph of Section IV-13-7-b of the Orange County Subdivision Regulations references the required minimum recreation space ratio in the Orange County Zoning Ordinance, Article 5.1.1, which requires 0.028 square feet of recreation space per land area dedicated to residential use [0.028 * 297.93 = 8.34 acres or 363,379 square feet]. In those cases where the required minimum recreation space results in a larger amount than the public recreation space requirement of 1/57 acre per lot, the difference shall be established as private recreation space for the use of the residents of the development (363,379 - 69,543 = 293,836 square feet (6.74 acres). The developer has planned 101.47 acres of open space (33%) to be maintained by the Homeowners Association, which satisfies the County requirements for private recreation use. F. Miscellaneous 1. The Final Plat shall contain a title block and vicinity map in accordance with Section V-D-2 and V-D-3 of the Orange County Subdivision Regulations. 2. Drainage easements shall be provided as required by D.1. above. 3. A dry hydrant shall be installed in the pond located in Phase 4. The pond shall meet the specific requirements as required by Emergency Management. This would identify a useable water source for fire suppression. The dry hydrant shall be constructed during the construction of Phase 3 with an all weather surface provided to the pond until Fox Hill Farm Drive and Starfire Place are constructed. 4. The open space shall be conveyed into the Homeowner's Association as each phase of the subdivision is recorded. 5. A 100-foot building setback shall be provided around the perimeter of the subdivision. A 150-foot building setback easement on lots 164,165, and 166 8 shall be provided along Baldwin Road as indicated on the Preliminary Plan. 6 . A 20-foot wide pedestrian access easement shall be located in lot 191 along the northern property line next to lot 190 from the open space area to Fox Hill Farm Drive. 7. A recycling facility may be established on this property if an agreement is reached among the owner, the HOA and Orange County consistent with Orange County's Solid Waste operating policies. The open space area, located south of and adjacent to Lot 157 and north of Fox Hill Farm Drive in Phase 3, shall be reserved on the final plat and designated as a potential recycling facility. If an agreement is reached, the reserved area shall be conveyed to the HOA or Orange County. Maintenance of any property conveyed to the HOA or Orange County for a Fox Hill Farm community recycling center will be the responsibility of the HOA or Orange County as agreed to by Orange County and the HOA. The declaration of covenants shall be revised to provide for the recycling center and its maintenance. G. Certifications 1. A Certificate of Survey and Accuracy signed by a Professional Land Surveyor shall be notarized on the face of the Final Plat. 2. A Certificate of Declaration and Maintenance in the form provided in Section V- D-6-b of the Orange County Subdivision Regulations signed by the landowner / developer shall be on the face of the plat and included in a document describing development restrictions to be recorded concurrently with the Final Plat. 3. The North Carolina Department of Transportation shall certify that Farm Gate Drive, Windflower Place, Lee Fox Lane, Fox Hill Farm Drive, Cedar Stone Way, Still Meadow Lane, Starfire Place and Springfield Place have been constructed to State standards or that construction plans have been approved prior to Planning Department signatures on final plat. 4. A Certificate of Approval signed by the Orange County Planning and Inspections Department. NOW THEREFORE BE IT RESOLVED by the Board of Orange County Commissioners that the Preliminary Plan for Fox Hill Farm Central Subdivision is approved in accordance with the above mentioned conditions and attached Preliminary Plat dated September 20, 2001. I have discussed this with the District Office in Graham. I agree with the staff that this site does not warrant a full right turn lane design. However, the right turn taper design submitted with your letter is a viable design at this location and will be incorporated Into the final approval for this subdivision.
