HomeMy WebLinkAboutNS RES-2001-081a Resolution to approve an Ordinance for a Special Use Permit, Class A for Olive Branch Inn Bed and Breakfast for use S54 Historic Sites Non-residential/Mixed Use © a 9CL 37 • RESOLUTION OF THE ORANGE COUNTY BOARD OF COUNTY COMMISSIONERS TO APPROVE AN ORDINANCE FOR A SPECIAL USE PERMIT, CLASS A FOR OLIVE BRANCH INN BED & BREAKFAST FOR USE S54 HISTORIC SITES NON-RESIDENTIAL/MIXED USE (As prepared by the Planning Department) Date: August 21, 2001 Applicant/Owner: Elizabeth P. Davidson The Orange County Board of County Commissioners hereby approves an application submitted by Elizabeth P. Davidson for a Class A Special Use Permit, to allow use category S54 Historic Sites Non-Residential Mixed Use (Bed and Breakfast establishment)as delineated on the site plan dated March 23, 2001, applicable to the following property and subject to the following conditions: Property located at 7015 NC 57, specifically described as Little River Township, Orange County Tax Map 15, Lot 8., being further identified in the Orange County Land Records Office by Parcel Identification Number, 9898-44-5102 and containing 47.17 acres more or less. The property is identified by the following legal description: BEGINNING at an iron pin in the center line of N.C. Highway 57 and running thence along thq line of Stephen T. James property South 89 deg. 11 min. 29 sec. East 286.36' feet to an iron and comer with James; thence continuing with James South 11 deg. 50 min. 54 sec. West 1,162.49'feet to an iron and comer with Margaret Dow; thence with Dow South 89 deg. 07 min. 36 sec. East 1,456.65' feet to an iron; thence North 00 deg. 00 min. 37 sec. East 1,456.22'feet to an iron at a fence comer, thence North 88 deg. 18 min. 17 sec. West 653.40'feet to an iron and comer with Christine McKee; thence continuing with McKee North 43 deg. 00 min. 01 sec. West 233.45'feet to a stone; thence continuing North 43 deg. 00 min. 01 sec. West 228:29'feet to a nail on the Northern side of N.C. Highway 57 and comer with Lois W. Blalock; thence with Blalock South 47 deg. 20 min. 36 sec. West 75.81'feet to a nail on the Northern side of N.C. Highway 57; thence South 25 deg. 14 min. 18 sec. West 185.85'feet to a nail in the center line of said N.C. Highway 57; thence South 43 deg. 02 min. 30 sec. West 588.07' feet to the place and point of beginning, containing 47.17 acres. The Special Use Permit is approved with the following eight (8) conditions. 1. Roads, parking areas, walkways, utilities, and landscaping shall be maintained as shown on the approved plans. All such facilities shall further be maintained and operated in a safe • manner. 38 2. The final site plan and narrative of the project are to be incorporated herein and made a part of this Special Use Permit. Copies of the final site plan (dated March 23, 2001)and narrative are to remain on file with the Orange County Planning and Inspections Department. 3. The Bed and Breakfast shall be operated according to the site plan and written narrative supplied by the applicant and in compliance with the above conditions. 4. The Fire Marshal and shall inspect and approve the facility to ensure that proper fire detection devices are in place and operational prior to commencing operation (after the Special Use Permit is recorded). 5. The applicant shall obtain a NCDOT Driveway Permit prior to commencing operation. 6. The sign, if illuminated shall use solar powered, ground lighting. Landscaping shall be installed around the base of the sign. 7. The applicant shall dedicate the property within the right-of-way and the small portion on the eastern side of the right-of-way to NCDOT or Orange County prior to commencing operation. 8. The Special Use Permit shall be valid for a period of six(6)years, at which time it shall be subject to renewal. This Special Use Permit, Class A shall become effective upon approval. NOW, THEREFORE BE IT RESOLVED, by the Board of Orange County Commissioners, that the Class A Special Use Permit for the Olive Branch Inn Bed & Breakfast is approved in accordance with the above mentioned conditions and attached Site Plan dated March 23, 2001.
