SUPPLEMENTAL HURRICANE FLOYD PROPERTY ACQUISITION
AND RELOCATION GRANT AGREEMENT
THIS SUPPLEMENTAL HURRICANE FLOYD PROPERTY ACQUISITION AND
RELOCATION GRANT AGREEMENT is entered into by and between the State of North
Carolina,Department of Crime Control and Public Safety,Division of Emergency Management,
Raleigh,North Carolina(hereinafter referred to as the AGENCY/GRANTEE), and Orange
County(hereinafter referred to as the RECIPIENT/SUBGRANTEE).
NVITNESSETH
That WHEREAS,on February 6,2001 the parties entered into a Hurricane Floyd
Property Acquisition and Relocation Grant Agreement wherein AGENCY/GRANTEE as
grantee provided funds from the Federal Emergency Management Agency(FEMA) and the
North Carolina Legislatur to RECIPIENT/SUBGRANTEE for Hurricane Floyd Property
Acquisition and Relocation project HFPAR-4292-0067;
And WHEREAS, the parties wish to modify the provisions of the prior Hurricane
Floyd Property Acquisition and Relocation Grant Agreement by this supplemental
agreement.
Therefore, in consideration of the payments that have already been made on the
original Hurricane Floyd Property Acquisition and Relocation Grant Agreement and in
further consideration of the promises and agreements that follow, the AGENCY/
GRANTEE and the RECIPIENT/SUBGRANTEE do mutually agree that the prior
Hurricane Floyd Property Acquisition and Relocation Grant Agreement of the parties is
changed in the following respects only:
(5) PERIOD OF AGREEMENT
This Agreement becomes effective Aug-ast 18, 2001. The termination date is
February 18, 2002 unless terminated earlier in accordance wAh the provisions of
paragraphs (6), (8), (11), (13) or(17).
It is expressly agreed by the parties that this Supplemental 3urricane Floyd
Property Acquisition and Relocation Grant Agreement is supplemental to the Hurricane
Floyd Property Acquisition and Relocation Grant Agreement executed on February 6,2001
attached and incorporated by reference herein, and all terms,conditions, and provisions of
the original Hurricane Floyd Property Acquisition and Relocation Grant Agreement,
Supplemental HFPAR Grant Agreement 1 Orange County
unless specifically modified by this supplemental agreement,are to apply to this
Supplemental Hurricane Floyd Property Acquisition and Relocation Grant Agreement and
are made a part of this agreement as though expressly included.
IN WITNESS WHEREOF,the AGENCY and the RECIPIENT have each executed this Agreement,this the
18th day of August,2001.
