RESOLUTION
OF THE
ORANGE COUNTY BOARD OF COMMISSIONERS
Whereas,the Orange County Board of Commissioners is charged with protecting the
health, safety, and welfare of all Orange County residents; and
Whereas,the Orange County Board of Commissioners desires to preserve currently
available affordable housing options for residents of Orange County; and
Whereas,failing septic systems that discharge sewage to the ground constitute a
significant public health risk for residents living in these conditions; and
Whereas,failing septic systems may lead to groundwater contamination; and
Whereas,the mobile home spaces in the L&W Mobile Home Park constitute forty-one
affordable housing spaces; and
Whereas,the Environmental Health Division of the Orange County Health Department
has determined that the septic systems of the L&W Mobile Home Park are not
repairable using conventional waste water technologies; and
Whereas,residents in fourteen of the forty-one mobile homes in the L&W Mobile
Home Park are living with failing septic systems; and
Whereas,the owner of the L&W Mobile Home Park desires to remedy this public
health concern for the residents of the L&W Mobile Home Park be seeking connection
to the Durham sewer system; and
Whereas,the owner of the L&W Mobile Home Park has expressed willingness to fully
fund the construction of the required force main and pump station; and
Whereas,the Orange County Board of Commissioners recognize that connecting the
L& W Mobile Home Park to the sewer system of the City of Durham has potential
comprehensive planning implications and in adopting this resolution anticipates a
dialogue with the City of Durham with a desired outcome of an interlocal agreement
between Orange County and the City of Durham related to land use regulations,public
water and sewer services and annexation boundaries;
Therefore Be It Resolved that the Orange County Board of Commissioners does hereby
agree that the City of Durham may acquire interests in land necessary for the extension of
Durham City Sewer Facilities for service to L&W Mobile Home Park, located in the
eastern portion of Eno Township,Orange County and identified as Orange County Tax
Parcel 5.25..91.
