HomeMy WebLinkAbout2012-439 EMS - South Orange Rescue Squad operations agreement OPERATIONS AGREEMENT FOR SOUTH ORANGE RESCUE SQUAD ®"O"O'se C04, r� WE a7 zz �Ith Cato Aug 1 , 2012 to July 31, 2013 This document is the Operations Agreement between Orange County ("County") and the South Orange Rescue Squad, Inc., a North Carolina Non-Profit Corporation("SORS")as provided in the South Orange Rescue Squad Franchise Ordinance ("Franchise Ordinance"), granting a non-exclusive Franchise ("hereafter Franchise") by Ordinance to SORS to operate Emergency Medical Services and Rescue Services in Orange County,North Carolina. WITNESSETH WHEREAS, Franchise Ordinance authorized SORS to operate Emergency Medical and Rescue Services;and WHEREAS, the Franchise Ordinance provides that the subcategories under which SORS can operate be identified in an "Operations Agreement" to be entered into by SORS and the County within 90 days after acceptance of the Franchise permit; and WHERAS, the Operations Agreement provides both administrative and operational guideline supported by Standard Operational Guidelines (SOGs), and along with the Franchise Ordinance, authorizes SORS to operate as an Emergency Medical and Rescue Services Franchise in Orange County under the authority of the Board of County Commissioners and at the direction of the Orange County Emergency Services Director; and WHEREAS, the Operations Agreement shall delineate responsibilities and expectations of both the County and SORS in order to ensure safe,effective and consistent operations; NOW THEREFORE, for the purposes and subject to the terms and conditions hereinafter set forth,the County and SORS do hereby agree to this Operations Agreement as follows: 1. Tenn: The Term of this Operations Agreement shall be August 1, 2012 through July 3 1, 2013 and shall be reviewed on an annual basis on or about May I't until the expiration of the 2. Services: This Operation Agreement authorizes SORS,to provide the following services: a. Emergency Services i. BLS Transport Services 1. Special Event and Ambulance Services 2. Surge Emergency Medical Services and Ambulance Services ii. EMS Non-Transport b. Technical Rescue Services i. High Angle ii. Swiftwater Rescue iii. Confined Space Rescue 3. Administrative Services. a. The Director of Emergency Services and his designees shall manage this guideline and will cause upgrades and changes when deemed necessary. This operating guideline and subsequent updates are necessary to ensure the safety and welfare of all personnel, efficient delivery of services and compliance with all requirements as established. Page 2 of 6 b. The Chief of South Orange shall serve as the administrative contact point for SORS. i. Following a change of command the name of the replacement shall be provided in writing to the Director of Emergency Services within twenty- four hours. ii. A notice of personnel change within the command officer ranks, including the Chair of the Board of Directors shall be communicated in writing to the Emergency Services Director within twenty-four hours following the change of personnel. c. The Orange County Emergency Services Director shall serve as the administrative contact point for the County with the EMS Operations Manager serving as the backup to the Director. i. A notice of personnel change within the command officer ranks shall be communicated in writing to the administrative contact point within twenty- four hours following the change of personnel. d. Personnel. No personnel will be released for field operations without approval of the Emergency Services Director or his designee. i. Monthly a roster of new candidates will be transmitted to the director accompanied with background information, training verification, driving record verification and background check submitted on the forms supplied by Orange County Emergency Services("OCES"). ii. Following review, the director will verify a roster of approved personnel to the Chief of SORS and OCES EMS Operations Manager to be added to the credentialed database of practitioners. iii. All squad members shall comply with the County's Credentialing and Compliance Policy administered by the OCES EMS Operations Manager under the direction of the County Medical Director. iv. SORS will comply with the Orange County Infection Control Plan. v. While operating emergency vehicles SORS shall conduct post-accident drug and alcohol screening. vi. SORS will provide a list of drivers semi-annually. OCES will conduct a driver's license background check and will provide SORS with the results. e. EMS Continuing Education training towards NC OEMS recertification. i. Rosters will be transmitted to the OC EMS Training Officer no more than 48 hours following delivery of the class. ii. Must be provided by instructors approved by OCES EMS. Page 3 of 6 J iii. Guest instructors may deliver training upon approval of the OCES EMS or Fire Training Officer. f. Scheduling. A schedule of time served by squad members shall be recorded and submitted to the OCES EMS Operations Manager quarterly. The submission shall reflect all hours in the commission of providing patient care. The submissions shall reflect all special events, deployments, callouts; emergency and/or non-emergency events provided. g. Data Collection and Reporting. County-specified data collection systems shall be purchased by the squad and utilize the data resources as prescribed by the County for the acquisition, transmission and reporting of patient care reports and other EMS data associated with BLS Transport and EMT Non-Transport. h. Communication. Only radio, paging, communication and/or data transmission equipment which complies with the County's communications system plan and requirements including the specification, use and maintenance of mobile, portable and accessory radio equipment shall be purchased or used by SORS. i. Confidentiality of Patient Information. All members of the squad shall protect all medical information obtained and used in the provision of Emergency Medical Services, in compliance with local, state, and federal confidentiality provisions. j. Standard operating guideline (SOG) updates for this document will be submitted to the Emergency Services Director for review and approval. k. Rescue Services. The Emergency Services Director will assist SORS in developing or updating guidelines to comply with all minimum requirements of the North Carolina Association of Rescue Squads and EMS for swift water, confined space, and high angle rescue. 1. The Director of Emergency Services or his designee shall determine the level of service for all special events. Notification of all special event requests shall be transmitted to the OCES EMS Operations Manager no later than seven days prior to the event. i. The OCES EMS Operations Manager or designee will review the request and all documentation to determine the level of care and service to be provided. If the OCES EMS special events designee determines the service should be ALS, an OCES EMS paramedic will be scheduled. ii. The Chief of SORS shall submit to the EMS Operations Manager all invoices for reimbursement of approved costs, related to special events, for BLS transport and EMT Non-Transport coverage requested by the County within two weeks of receipt of service delivery. Invoices submitted for reimbursement shall be pre-approved. Page 4 of 6 4. Operations. a. SORS members shall utilize the National Incident Management System (NIMS) during all training, exercising, and all other operations. OCES supervisory/command personnel shall assume command of operations following arrival and a briefing from the IC of SORS. b. When operating under the auspices and/or supervision of the OCES, SORS personnel shall conduct themselves in a manner, which complies with the policies of the County, which addresses harassment, discrimination, personal conduct, drug free work place, and employment of relatives. c. All SORS members will operate under the supervision of the senior Orange County command officer. d. SORS shall submit the successful completion of ICS 100, 200, 700 and 800 from a training institution recognized by the North Carolina Division of Emergency Management or may submit the FEMA certificates of completion. e. OCES retains full authority for the care and treatment of all patients provide by members of SORS. f. SORS shall provide a County-approved Emergency Medical Technician-Basic to staff an ambulance in the current modified DuPont schedule configuration. The County will work with SORS if it is necessary to adjust the schedule. 5. Governing Law. This Operations Agreement and the duties, responsibilities, obligations and rights of respective parties hereunder shall be governed by the laws of the State of North Carolina. 6. Extent of Agreement. This Agreement represents the entire and integrated agreement between the County and the SORS and supersedes all prior negotiations, representations or agreements, either written or oral. This Agreement may be amended only by written instrument signed by both parties. 7. Severability. If any provision of this Agreement is held as a matter of law to be unenforceable, the remainder of this Agreement shall be valid and binding upon the Parties. 8. Notice.
