Proposed Amendment to Article IV, Section 28 of the Orange County Personnel Ordinance Action Agenda Item No. 2 PUBLIC HEARING: (YIN) No INFORMATION CONTACT: Sharon Goode Laisure, Interim Human Resources Director, 245 -2553 Diane Shepherd, Benefits Manager, 245- 2558 • PURPOSE: To receive information and provide feedback to staff on employee pay and benefits for FY 2012 -13. • BACKGROUND: Staff has provided information relating to FY 2012 -13 employee pay and benefits in Attachments 1, 2 and 3, and in Appendix A of the Manager's Recommended Budget. The information provided includes background information on employee pay and benefits over recent years and information on specific pay and benefits plan elements. Key components of the recommended employee pay and benefits plan include: Recommendation Appendix A Pages A Cost of Living Adjustment (COLA) of 2% for all permanent 261 employees hired on or before July 1, 2012 An Employee Performance Award in the amount of $500 or $1,000, effective with WPPR Review Dates from July 1, 2012 to 263 June 30, 2013 Funding for an increase in health insurance costs of up to 265 23.0% over current premiums, effective January 1, 2013 Living Wage increase from $10.81 to $10.97 per hour (affects 270 approximately 100 temporary employees) Implement recommendations of the County's FY 2012 -13 internal Classification and Pay Study (affects approximately 35 273 -280 employees) Continue the six -month hiring delay 290 Continue the voluntary furlough program 301 Continue the $27.50 per pay period County contribution to non - law enforcement employees' supplemental retirement accounts. Continue the mandated 5% Law Enforcement Officer 303 contribution to the 401 (k). Address Increased Costs for Retiree Health Benefits • Change the eligibility for employees hired on or after July 1, 2012 305 • Set aside $3 million in reserve fund An essential part of maintaining the County workforce is its employee pay and benefits plan. In FY 2008 -09, the Board of County Commissioners (Board) approved the most recent increase in salaries, which included a 2.25% cost of living increase and a 1.0% or 2.0% in -range salary increase based on work performance. Since then, employee pay and benefits recommendations have been heavily influenced by the downturn in the economy and focused on maintaining the County's permanent workforce without increasing property taxes. The County Manager's (Manager) recommendations for funding employee pay and benefits in the FY 2012 -13 Recommended Budget are driven by the desire to maintain strong health insurance benefits in the face of ever - increasing health insurance costs, to provide additional compensation, and to address future retiree health benefits for permanent employees hired on or after July 1, 2012. Classification and Pay Study In FY 2011 -12, staff reviewed 97 classifications affecting 266 employees, and conducted an is external survey to compare the County's classification and salary structure to the external market. Overall, this year's review showed that employees are generally classified correctly and the County's salaries and salary ranges are competitive with the survey market. Staff will continue to take a proactive approach to reviewing both classifications and compensation. Employee Health Insurance Plan The most recent claims data available shows a slight drop in Loss Ratio (Medical Claims divided by Premiums Paid) for the first three months of 2012 compared to the first three months in 2011. Benefits consultant, Mark III Employee Benefits, has projected an increase in premiums of 23% ($171,609) based on data available, assuming no changes to the design of the benefits. Attachment 1 includes the details. The Board will approve a funding level for the health insurance renewal in the FY 2012 -13 Annual Operating Budget and will consider and approve final plan design and premium structure in Fall 2012. Retiree Health Benefits As discussed at the work session of April 24, the County's liability for future retiree health benefits has climbed to $62.8 million. In response to this projection, the Manager recommends modifying the eligibility requirements for employees hired on or after July 1, 2012 and contributing $3 million to a reserve fund to fully fund the current expense for FY 2012 -13. Attachment 2 is a survey by the UNC School of Government showing the benefits each North Carolina County provides for its employees and retirees, as of January 2012. U Proposed Changes to Personnel Ordinance •Revisions to the Personnel Ordinance are required to implement any changes to retiree health benefits. Attachment 3 is the proposed Amendment to Article IV, Section 28 which would affect new employees hired on or after July 1, 2012, by increasing the years of Orange County service required for retiree health insurance for employees hired on or after July 1, 2012 and requiring those eligible for Medicare to enroll in Medicare and receive Medicare benefits. FINANCIAL IMPACT: Appendix A of the Manager's Recommended Budget includes information about the estimated costs of various pay and benefits options. The cost to the employee for group health insurance is determined each year. Employees also have the option, at additional expense, to cover the employee's spouse, dependent child(ren), domestic partner as defined in this Ordinance poky, and /or family. (a) Effective Date. Coverage is effective on the first day of the month following the date of employment. (b) Retiree Health Insurance. The County provides retiree health insurance and contributes toward the cost of this for eligible employees. (1) Employees Eligible. a. A Permanent Employee Eligibility employed on or before June 30. 2012 is eligible for retiree health insurance if he or she retires from Orange County and meets one of the following criteria: 1. Has at least ten years of total Orange County Service as a permanent employee. 2. Is age 65 or older and has at least five years of total Orange County Service as a permanent employee. 3. Is retiring on a Disability Retirement and has at least five years of total Orange County Service as a permanent employee. • b. A Permanent Employee employed on or after July 1. 2012 is eligible for retiree health insurance if he or she retires from Orange County and meets one of the following criteria: 1. Has at least twenty consecutive years of Orange County Service as a permanent employee. 2. Is age 65 or older and has at least ten consecutive years of Orange County Service as a permanent employee. 3. Is retiring on a Disability Retirement and has at least ten consecutive years of Orange County Service as a permanent employee. (2) Eligibility Period to Elect Participation in Retiree Health Insurance. To participate in retiree health insurance, the eligible retiree must be retiring directly from Orange County and request such participation within 30 calendar days of the last date of employment. (3) Retiree Health Insurance Plans Available a. For an eligible retiree under age 65.7 4 The retiree is covered under one of the County's group health insurance plans. The retiree remains on the County group health insurance plan in which enrolled at retirement. During any subsequent annual enrollment period, the retiree may change to another County health insurance plan as well as add or drop dependents. • b. If the retiree waives coverage, the County provides no cash payment in lieu of such coverage. (5) Payment of Premiums for Which the Retiree Is Responsible. The retiree pays Orange County any required premiums monthly. With appropriate notice, the County terminates coverage when premiums are more than 30 days past due. The health insurance provider bills the retiree directly for any Medicare supplement coverage for a dependent. (6) Dependent Under Age 65 at Death of Eligible Retiree. Upon the death of the • retiree enrolled in the County retiree health insurance, the County offers a dependent on group health insurance continuation of coverage under the Consolidated Omnibus Budget Reconciliation Act (COBRA). The dependent is eligible for such coverage for up to 36 months (or until attaining age 65) provided the dependent pays the full cost of this coverage. (7) Eligible Retiree Returning to Work in NC Local Government. If the retiree returns to work with another North Carolina Local Government employer in a position which offers group health insurance coverage (whether the employee elects it or not), Orange County cancels the retiree's health insurance coverage through Orange County and such coverage may not be reinstated. (c) COBRA Coverage. Under the Consolidated Omnibus Reconciliation Act (COBRA), Orange County continues health care coverage to persons who would otherwise lose coverage under a health care plan due to specific events provided the employee, covered spouse, domestic partner a 4' - • pol+-.y, and /or dependent child agrees to pay, and pays, the cost of this coverage. (1) When coverage ceases due to termination or reduction in hours of employment, the employee, covered spouse, domestic partner, and /or dependent child is entitled to up to 18 months of coverage. (2) If the employee, covered spouse, domestic partner, or dependent child is • determined disabled under Social Security at the time of termination or reduction in hours, he or she is entitled to purchase coverage for up to 29 months. 14 (3) The spouse, domestic partner, or dependent child of an employee is entitled to up to 36 months of coverage if any of the following occurs: a. Death of the covered employee • b. Divorce or legal separation of the covered employee from the employee's spouse or termination of a domestic partner relationship c.
