PURPOSE: To approve the award of a contract that provides Household Hazardous Waste
(HHV~ collection, processing, and disposal services for the residents of Orange County and
Conditionally Exempt Small Quantity Generators (CESQG) within the County.
BACKGROUND: The HHW collection program was established in 1994 as a cooperative
program between local governments to collect hazardous waste from residents of Chatham,
Durham, Orange, and Wake counties. In the spring of 2002, the various local governments
decided that each local government would contract individually with the service provider of their
choosing for HHW services.
In June of 2002, the BOCC approved a contract with ECOFLO, Inc. for the provision of HHW
and CESQG services. Since that time ECOFLO has been operating the facility. This program
allows for Orange County residents to have access to a drop-off facility six days per week to
properly dispose of household hazardous wastes. The program also extends services to small
businesses, non-profits, and other public agencies within Orange County generating less than
100 Kg of Hazardous Waste per month (Conditionally Exempt Small Quantity Generators,
CESQGs) for disposal of commercial hazardous waste.
Proposals were received as a result of a request for proposals (RFP) issued in March 2012. A
detailed RFP created by Orange County allowed vendors to propose HHW collection,
processing, and disposal for Orange County residents at the Eubanks Road and Walnut Grove
Convenience Center facilities and CESQGs at only the Eubanks Road facility. Four vendors
submitted proposals - Tradebe, MXI Environmental Services, ECOFLO, Inc, and Clean Harbors
Environmental Services. Each of the four proposals was evaluated by staff based on the
following criteria:
• Understanding of and familiarity with services sought by County.
• Project personnel, personnel experience, and use of subcontractors.
• Proposer's experience and operation record, including and past experience with
providing similar services to other jurisdictions.
• Proposer's technical expertise, knowledge, and understanding of applicable laws, rules,
and regulations.
• Proposer's project approach.
• Facilities to be used to process/manage collected waste materials.
• Cost of providing services (flat per pound rate) cost of materials if applicable.
• Financial capacity for handling services, including insurance coverage, and proposer's
ability to protect County from liability associated with operating the HHW and CESQG.
• References, including accurate listing of contract information for contacts.
After closely evaluating each proposal, Clean Harbors Environmental Services was deemed as
submitting the most responsive proposal. The proposal stated interest in extending the
collection service to the Walnut Grove Convenience Center and conveyed the importance of
safety and following Federal, State, and Local regulations. The proposal also gave a detailed
explanation of the project approach and the importance of a smooth transition befinreen
vendors. Clean Harbors also gave a detailed description of its current collection and processing
practices assuring all hazardous waste would be handled responsibly. The proposal of $.56 per
pound for the processing of the material is four cents less than the current contract and the
least costly proposal of the four proposals.
Clean Harbors has been performing Household Hazardous Waste collections since 1985 and is
located in Reidsville, North Carolina. Its close proximity will allow its staff to respond quickly to
any emergencies and will also allow the company to provide replacement site attendants for
both locations fairly quickly in the event a site attendant does not show up for work. Clean
Harbors operates collection events throughout North Carolina and provides hazardous waste
management for businesses throughout the Triangle which will allow it to be flexible for
collection at both of County locations.
For FY 2012-2013 the HHW program is projected to divert as much as 130 tons of hazardous
material from the County's waste stream. This proposed agreement engages Clean Harbors for
five years with an option for finro (2) two-year extensions.
FINANCIAL IMPACT: The total projected cost of this agreement for FY 2012-2013 is $204,000.
This amount is included in the proposed Solid Waste Management Departmental Budget. The
compensation and payment provisions maintain a fixed price of $0.56 per pound of residential
and conditionally exempt small quantity generator commercial hazardous waste and one full
time site attendant at both the Eubanks Road Facility and the Walnut Grove Convenience
Center.
RECOMMENDATION(S): The Manager recommends that the Board approve the Household
Hazardous Waste Agreement with Clean Harbors Environmental Services and authorize the
Chair to sign the Agreement.
