PURPOSE: To consider the legal advertisement for items to be presented at the joint Board of
County Commissioners/Planning Board Quarterly Public Hearing scheduled for May 29, 2012.
BACKGROUND: The Board of County Commissioners reviews proposals to be considered at
public hearing for consistency with general County policy and presentation format. The following
items are scheduled for the May 29, 2012 Quarterly Public Hearing:
Applications:
(See maps in Attachment 2 for locations)
1. Zoning Atlas Amendment and Class A Special Use Permit modification to rezone a
parcel of property approved as part of the Heartwood at Blackwood Mountain Planned
Development application (Dickinson application).
2. Zoning Atlas Amendment to rezone portions of finro parcels located on US 70 (East of St.
Mary's Road) from NC-2 and R-1 to only NC-2 (Woods application).
3. Zoning Atlas Amendment to rezone portions of finro parcels located on US 70 (East of St.
Mary's Road) from NC-2 and R-1 to only NC-2 (Merritt application).
4. Class A Special Use Permit for a five megawatt solar array/public utility facility to be
located off of White Cross Road. (Strata Solar and the John Bradshaw Family Limited
Partnership application).
Countv Initiated:
1. Comprehensive Plan Future Land Use Map and Zoning Atlas Amendments: Amend the
Comprehensive Plan Future Land Use Map to change the land use classification of
approximately 493.5 acres in the vicinity of the Interstate 85/US Highway 70 interchange
(in the vicinity of the Eno Economic Development District near the eastern county line)
and to change the zoning district of approximately 351.5 acres of property in the same
area. (This item was continued to the May Quarterly Public Hearing at the February 27,
2012 quarterly public hearing). Amendment areas will likely be reduced in areas di~cult
to serve with future public utilities. An additional public outreach meeting was held on
Wednesday, April 25, 2012.
2. Zoning Atlas Amendment to apply the Special Flood Hazard Overlay District to portions
of 10 parcels affected by the Orange - Alamance County line adjustment. (See maps in
Attachment 2).
3. Unified Development Ordinance (UDO) Text Amendment to revise various Dimensional
and Ratio Standards in commercial and industrial zoning districts if the district is applied
to property located in Commercial Transition Activity Nodes or Commercial-Industrial
Transition Activity Nodes, as depicted on the Future Land Use Map contained in the
Comprehensive Plan.
The legal advertisement in Attachment 1 provides additional information regarding these items.
The BOCC approved the Amendment Outline Forms for County-initiated item #1 at its
November 1, 2011 meeting. The Amendment Outline Form for County-initiated items #2 and
#3 were approved at the March 13, 2012 BOCC meeting.
FINANCIAL IMPACT: Other than advertising costs, which are included in the FY 2011-12
Budget, there are no direct financial impacts associated with the approval of this item.
RECOMMENDATION(S): The Manager recommends the Board approve the proposed May
29, 2012 Quarterly Public Hearing legal advertisement.

NOTICE OF JOINT PUBLIC HEARING
ORANGE COUNTY BOARD OF COMMISSIONERS
ORANGE COUNTY PLANNING BOARD
A joint public hearing will be held at the Department of Social Services, Hillsborough
Commons, 113 Mayo St., Hillsborough, North Carolina, on Tuesday, May 29, 2012 at
7:00 PM for the purpose of giving all interested citizens an opportunity to speak for or
against the following items:
1. Application for a Zoning Atlas Amendment and a Class A Special Use Permit
modification to rezone a parcel of property approved as part of the Heartwood
at Blackwood Mountain Planned Development application: In accordance with
the provisions of Section 2.7 Specia/ Use Permits and Section 2.8 Zoning Atlas and
Unified Development Ordinance Amendments of the Orange County Unified
Development Ordinance (UDO), Spence Dickinson has submitted an application
seeking to modify an existing Class A Special Use Permit governing the
development of the Heartwood at Blackwood Mountain Planned Development by
removing a parcel from the project and rezoning it:
FROM: Planned Development Housing Rural Residential (PD-H-R1) and Rural
Buffer (RB)
TO: Rural Buffer (RB)
The parcel in question is approximately 4 acres in area off of Pathway Court, a Class
A private road, with a Parcel Identification Number (PIN) of 9871-54-9182 and
further identified as Lot 31 R on a plat recorded within Plat Book 90 Page 181 of the
Orange County Registrar of Deeds. The property is currently split zoned, with
approximately 2 acres zoned PD-H-R1 and the remaining zoned RB.
According to the application, Mr. Dickinson is requesting the modification to address
septic and development issues on an adjacent property. If approved, this lot will
become part of the Creative Learning Center property and contain the septic system,
and required repair area, for the existing summer/day camp.
The property subject to this petition is located within the Rural Buffer land use
category as denoted on the Future Land Use Map of the Comprehensive Plan and
the Rural Designated Area as denoted on the Growth Management System Map.
Purpose: To review the item and receive public comment on the application.
2. Application for a Zoning Atlas Amendment: In accordance with the provisions of
Section 2.8 Zoning Atlas and Uni~ed Development Ordinance Amendments of the
Orange County Unified Development Ordinance (UDO), Mr. and Mrs. Ronald and
Phyllis Woods have submitted an application seeking to rezone finro parcels of
property located on US 70 East:

FROM: Rural Residential (R-1) and Neighborhood Commercial (NC-2)
TO: Neighborhood Commercial (NC-2)
The parcels in question are currently split zoned and are further described as
follows:
• Parcel A- a 26,769 square foot parcel with a Parcel Identification Number
(PIN) of 9874=78-1414. Approximately 8,540 square feet of this property is
currently zoned R-1.
• Parcel B- a 47,851 square foot parcel with a Parcel Identification Number
(PIN) of 9874-68-9326. Approximately 16,540 square feet of this property is
current zoned R-1.
According to the application, Mr. and Mrs. Woods are requesting the rezoning to
eliminate the existing split zoning situation and ensure that the properties are
compliant with applicable regulations including, but not limited to, landscaping and
buffering requirements, setbacks, parking, and ensuring required septic and repair
areas intended to support non-residential operations are appropriately zoned.
The properties subject to this petition are located within the Commercial Transition
Activity Node as denoted on the Future Land Use Map of the Comprehensive Plan
and the Urban Designated Area as denoted on the Growth Management System
Map.

Barbara Merritt have submitted an application seeking to rezone finro parcels of
property located on US 70 East:

The parcels in question are currently split zoned and are further described as
follows:
• Parcel A- a 60,063 square foot parcel with a Parcel Identification Number
(PIN) of 9874-68-9620. Approximately 32,277 square feet of this property is
currently zoned R-1.
• Parcel B- a 31,716 square foot parcel with a Parcel Identification Number
(PIN) of 9874-68-7542. Approximately 4,005 square feet of this property is
currently zoned R-1.
According to the application, Mr. and Mrs. Merritt are requesting the rezoning to
eliminate the existing split zoning situation and ensure that the properties are

compliant with applicable regulations including, but not limited to, landscaping and

4. Application for a Class A Special Use Permit: In accordance with the provisions
of Section 2.7 Special Use Permits and Section 5.9.3 of the Orange County Unified
Development Ordinance (UDO), Strata Solar and the John Bradshaw Family Limited
Partnership have submitted a Class A Special Use Permit application seeking to
develop a solar array/public utility station on a parcel of property off of White Cross
Road.
Strata Solar intends to lease a 46 acre portion of an existing 122 acre parcel of
property, with a Parcel Identification Number (PIN) of 9748-34-9639, owned by the
John Bradshaw Family Limited Partnership. According to the application the
property will be subdivided through the exempt subdivision process to separate the
proposed solar array from an existing mobile home park already located on the
property.
The project will involve the development of a 5 megawatt facility involving the
erection of individual solar arrays.
The property subject to this petition is located within the Agricultural Residential land
use category as denoted on the Future Land Use Map of the Comprehensive Plan
and the Rural Designated Area as denoted on the Growth Management System
Map.
Purpose: To review the item and receive public comment on the application.
5. Comprehensive Plan Future Land Use Map and Zoning Atlas Amendments: In
accordance with the provisions of Section 2.3 Comprehensive Plan Amendments
and Section 2.8 Zoning At/as and Unified Deve%pment Ordinance Amendments of
the Orange County Unified Development Ordinance (UDO), the Planning Director
has initiated amendments to the Comprehensive Plan Future Land Use Map and to
the Zoning Atlas. These proposed amendments affect properties in the vicinity of
the Eno Economic Development District (an area near the Interstate 85/US Highway
70 interchange in eastern Orange County). This item was continued to the May
29, 2012 quarterly public hearing from the February 27, 2012 quarterly public

Purpose: To continue review of the item and receipt of public comment on the
proposed amendments.
6. Zoning Atlas Amendment: In accordance with the provisions of Section 2.8
Zoning Atlas and Unified Deve%pment Ordinance Amendments of the Orange
County Unified Development Ordinance (UDO), the Planning Director has initiated
an amendment to the Zoning Atlas. The following Parcel Identification Numbers
(PINs), comprising approximately 174.25 acres, are proposed to be changed from
AR (Agricultural Residential) to AR (Agricultural Residential) with the Special Flood
Hazard Area Zoning Overlay District on a portion of the properties.

Purpose: To review the item and receive public comment on the proposed
amendment.
7. Unified Development Ordinance (UDO) Text Amendments: In accordance with
the provisions of Section 2.8 Zoning Atlas and Unified Development Ordinance
Amendments of the Unified Development Ordinance, the Planning Director has
initiated an amendment to the text of the Unified Development Ordinance (UDO).
Text amendments are proposed to Section 3.4 General Commercial Districts and
Section 3.5 /ndustrial Districts. Various Dimensional and Ratio Standards are
proposed to be changed for properties located with Commercial Transition Activity
Nodes and Commercial-Industrial Transition Activity Nodes, as designated on the
Future Land Use Map of the Comprehensive Plan. The purpose of the amendments
is to allow for a greater intensity of development in areas of the county to be served
by public water and sewer systems.
Purpose: To review the item and receive public comment on the proposed
amendment.
Substantial changes in items presented at the public hearing may be made following the
receipt of comments made at the public hearing. Accommodations for individuals with
physical disabilities can be provided if the request is made to the Planning Director at
least 48 hours prior to the Public Hearing by calling the one of the phone numbers
below. The full text of the public hearing items may be obtained no later than May 18,
2012 at the County website www.co.oranqe.nc.us at the Meetinq Agendas link.
