Project Ordinance
PURPOSE: To approve budget ordinance amendments and capital and grant project
ordinances for fiscal year 2002-03.
BACKGROUND:
Department of Social Services (DSS)
1. Over the last few years, Orange County has received Temporary Assistance for Needy
Families (TANF) Housing funds to assist clients with obtaining affordable rental housing.
One obstacle that many applicants face is being able to afford to make an upfront security
deposit that property owners require. The Department of Social Services has been able to
use the TANF Housing funds to pay the security deposit for its eligible clients, and upon a
client's satisfactory completion of the contractual obligation, the property owner refunds the
deposit.
To date, property owners have reimbursed $4,446 in deposits to DSS. This budget
amendment provides for the receipt of these reimbursements and establishes a fund that
enables Orange County to re-invest in enabling eligible low-income clients to obtain
affordable, safe housing. (See Attachment 1, column #1)
2. DSS recently received notification that Orange County is eligible to receive additional
Energy Administration funds totaling $3,302 from the State. The additional funds bring the
current budget for this program to $19,918 for the current fiscal year and offsets costs of
staff who administer the energy assistance related program, Crisis Intervention. This budget

amendment provides for the receipt of the additional funds from the State. (See Attachment
1, column #2).
Heritage Hills House Relocations
3. During Hurricane Floyd in September 1999, two homes located in Heritage Hills subdivision
sustained flood damage. With the assistance of federal Hazard Mitigation Grant funds, the
County purchased the properties from the homeowners. In accordance with the grant
agreement, the County is obligated to remove the houses and restore the two properties to a
natural state.
On September 17, 2002, the Board of Commissioners approved a plan to relocate one of
the houses to Little River Park to be used as a caretaker residence and the other one to the
Pine Knolls community to be reused as affordable housing. Estimated costs to relocate the
two houses is $180,000 with funding coming from the Hazardous Mitigation Grant,
Recreation and Parks Subdivision Payment in Lieu Funds, 2001 Affordable Housing bonds,
and a contribution from Durham County (for the relocation of the house to the Little River
Park). The table below outlines the anticipated costs of the relocations:

The attached Affordable Housing Capital Project Ordinance (Attachment 2) reflects receipt
of funds from the Hazardous Mitigation Grant and 2001 Affordable Housing Bonds, and
appropriates these funds for the relocation of one of the Heritage Hills houses to the Pine
Knolls Community. The attached Lands Legacy Capital Project Ordinance (Attachment 3)
reflects receipt of funds from the Hazardous Mitigation Grant, a transfer from the Subdivision
Payment-in-Lieu funds, and a contribution from Durham County, and appropriates these
funds for the relocation of the other Heritage Hills house to the Little River Park Property.
Hazard Mitigation Grant
4. The County has received additional Hazard Mitigation grant funds totaling $113,957 from the
N.C. Department of Crime Control and Public Safety. These funds enabled the County to
assist the owners of the Heritage Hills properties (referenced in the above budget

amendment) to relocate to new housing. This budget amendment provides for the receipt of
these additional State grant funds. (See Attachment 4, Hazard Mitigation Grant Project
Ordinance)
Orange Public Transportation (OPT)
5. Orange Public Transportation (OPT) has secured funding from the N. C. Department of
Transportation (NCDOT) to cover initial set-up costs and on-going lease and utility costs for
a new modular office building. The installation of the new facility would enable the OPT
program to relocate from the Whitted Human Services Center to the County's Public Works
site located on Highway 86 north of Hillsborough. The relocation would be done in
conjunction with the upcoming renovations planned for the Whitted Center and offers a site
more conducive to OPT's transportation component.
NCDOT has agreed to provide ninety percent of the costs associated with one-time set up
costs, such as site preparation and utility connections, of the new unit. The total amount of
setting up the new unit is in the neighborhood of $32,161 with the State paying $28,945 of
that amount and the County providing $3,216.
In addition, NCDOT has agreed to reimburse the County ninety percent of the monthly
expenses associated with the monthly lease of the modular ($575 per month) and monthly
costs for electricity and water usage. With the unit anticipated to be in place December 1,
2002, there would be seven months of lease and utility expenses for a projected total cost of
$6,492. In accordance with the agreement from NCDOT, the State would cover $5,843 of
the total with Orange County picking up $649.
The required County match is included in the current year budget. Funding for future years
would be reflected in OPT's upcoming budgets. (See Attachment 1, column #5 and
Attachment 5, OPT Modular Building Capital Project Ordinance)
FINANCIAL IMPACT: Financial impacts are included in the background information above.
RECOMMENDATION(S): The Manager recommends that the Board of County
Commissioners approves the attached budget ordinance amendments, and capital and grant
project ordinances.

Affordable Housing Program
Capital Project Ordinance
Be it ordained by the Orange County Board of County Commissioners that pursuant to Section
13.2 of Chapter 159 of the General Statutes of North Carolina, the following capital project is
hereby adopted.
Section 1.The project authorized provides funds to fund housing activities in the following
categories: land acquisition; housing development; and homeownership. The
project is financed by proceeds from the 1997 voter approved bond referendum and
from Housing Trust funds.
Section 2.The officers of the County are hereby directed to proceed with the project within the
budget contained herein.

Resource Lands Conservation (Lands Legacy) Project
Capital Project Ordinance
Be it ordained by the Orange County Board of County Commissioners that pursuant to Section 13.2 of
Chapter 159 of the General Statutes of North Carolina, the following capital project is hereby adopted.
Section 1. The project authorized is for the purchase of land for natural resource and farmland
preservation. Financing for the project includes proceeds from the County's portion of the
one-half cent sales taxes, grants from the Clean Water Management Trust, proceeds from the
1997 and 2001 voter approved bonds, and transfers from the General (property tax),
School/Park Capital Reserve and Subdivision Payment-In-Lieu Funds.
Section 2. The officers of the County are hereby directed to proceed with the project within the budget
contained herein.

Hazard Mitigation Grant
Grant Project Ordinance
Be it ordained by the Orange County Board of County Commissioners that pursuant to
Section 13.2 of Chapter 159 of the General Statutes of North Carolina, the following grant
project is hereby adopted.
Section 1. The project authorized is the Hazard Mitigation Grant as awarded to Orange
County by the North Carolina Department of Crime Control and Public Safety.
This grant provides funding to assist two homeowners whose properties
sustained substantial damage during Hurricane Floyd and related to heavy
rainfalls during September 1999.
Section 2. Under the terms of the agreement, Orange County will administer the grant as
fiscal agent. The officers of the County are hereby directed to proceed with the
grant project within the grant document, the rules and regulations of the North
Carolina Department of Crime Control and Public Safety.
Section 3. The following revenue is anticipated to be available to complete this project:

Section 4. There is no required County match for this grant.
Section 5. The following amount is appropriated for this project:

grantor agency required by the grant agreement and federal and state
regulations.
Section 7. Funds may be advanced from the general fund for the purpose of making
payments due. Reimbursement requests should be made to the grantor agency
in an orderly and timely manner.
Section 8. Copies of this grant project ordinance shall be made available to the finance
officer for direction in carrying out this project.
Section 9. There are no positions authorized through this grant project ordinance
Section 10. This project ordinance is in effect until June 30, 2003.

Orange Public Transportation (OPT) Modular Building
Capital Project Ordinance
Be it ordained by the Orange County Board of County Commissioners that pursuant to Section
13.2 of Chapter 159 of the General Statutes of North Carolina, the following capital project is
hereby adopted.
Section 1.The project authorized provides funds for one-time set-up costs for a new modular
office building for Orange Public Transportation (OPT). The modular building will
be located at the County's Public Works site. The project will be financed with
proceeds from State funds from the NC Department of Transportation (NCDOT),
and from a transfer from the General Fund.
Section 2.The officers of the County are hereby directed to proceed with the project within the
budget contained herein.
Section 3.The following revenue is anticipated to complete this project:
