PURPOSE: To approve budget ordinance and capital project ordinance amendments for fiscal year
2002-03.
BACKGROUND:
Department of Social Services
1. The Department of Social Services has received notification from the State of additional Crisis
Intervention funds totaling $41,202 to be used for crisis related living needs (such as utility bill
assistance) by citizens who are "medically at risk". These additional funds bring the current
budget for this program to $133,217 for FY 2002-03. This budget amendment provides for the
receipt of these State funds. (See Attachment 1, column #1)
2. The Department has also received notification from the State of additional Energy Administration
funds totaling $3,434 to be used to offset the costs of staff administering the Crisis Intervention
Program. These additional funds bring the current budget for this program to $16,616 for FY
2002-03. This budget amendment provides for the receipt of these State funds. (See
Attachment 1, column #2).
Environment and Resource Conservation Department ~
3. The Federal Farm Security and Rural Investment Act of 2002 included an appropriation of $50
million to purchase agricultural conservation easements throughout the United States. Of the
$50 million appropriation, North Carolina was awarded $2.2 million to be distributed to interested
local governments throughout the state. The State recently notified Orange County that based
on the County's ongoing interest in preventing the conversion of agricultural lands to non-
agricultural uses, the County.would receive $784,155, or about 36 percent of the total available
State funds.
In accordance with the grant agreement, Orange County must provide a match of $784,155 over
a three-year period. On September 3, 2002, the Board of Commissioners approved a six-year
plan to issue bonds and alternative financing for various County related projects. The plan
included $3 million in alternative financing for conservation easements with $1 million of the total
being included in the upcoming December 2002 issuance of alternative financing. The attached
Conservation Easement Capital Project Qrdinance allows for receipt of the federal grant funds.
Once the December 2002 issuance is completed, staff will bring forward an amended capital
project ortlinance for the Board's approval. (See attached Conservation Easement Capital
Project Ordinance) ~
Richard E. Whitted and Northern Human Services Center Capital Projects
4. In Spring 2002, the Board of County Commissioners issued two-thirds n.et debt reduction bonds
in the amount of $2.845 million to cover a portion of the costs associated with planned
renovations at the Richard E. Whitted and Northern Human Services Centers. On September
17, 2002, the Commissioners approved a plan to allocate the proceeds from these bond funds to

The attached Whitted Human Services Center and Northern Human Services Center Capital
Project Ordinances appropriates the two-thirds net debt funds. (See attached Whitted Human
Services Center and Northern Human Services Center Capital Project Ordinances).
FINANCIAL IMPACT: Financial impacts are included in the background information above.
RECOMMENDATION (S): The Manager recommends that the Board of County Commissioners
approve the attached budget ordinance and capital project ordinance amendments.

Conservation Easement
Capital Project Ordinance
Be it ordained by the Orange County Board of County Commissioners that pursuant to Section
13.2 of Chapter 159 of the General Statutes of North Carolina, the following capital project is
hereby adopted. ~
Section 1.The project authorized provides funds for the acquisition of agricultural
conservation easements to help preserve County farmland with a priority placed on
farms with a strong conservation track record in water supply watersheds.
Financing for the project includes proceeds from alternative financing methods,
such as private placement loans or. certificates of participation (COPs), and federal
grant funds from the USDA Natural Resource Conservation Service. In accordance
with the grant agreement, the County must provide a dollar for dollar match of the
federal grant funds over a three-year period, ending September 30, 2005.
Section 2.The officers of the County are hereby directed to proceed with the project within the
budget contained herein.
Section 3.The following revenue is anticipated to complete this project:

Capital Project Ordinance
Be it ordained by the Orange County Board of County Commissioners that pursuant to Section
13.2 of Chapter 159 of the General Statutes of North Carolina, the following capital project is
hereby adopted.
Section 1.The project authorized provides funds for major renovation work at the Whitted
Human Services Genter in Hillsborough to include HVAC and general interior
renovations. Financing for the project includes proceeds from the two-thirds net
debt reduction bonds issued in Spring 2000.
Section 2.The officers of the County are hereby directed to proceed with the project within the
budget contained herein.
Section 3.The following revenue is anticipated to complete this project:

Section 1.The project authorized provides funds for major renovations, including roof repair
and septic and HVAC systems upgrades, at the Northern Human Services Center.
Financing for the project includes proceeds from the County's portion of the one-
half cent sales taxes and the two-thirds net debt reduction bonds issued in May
2000.
Section 2.The officers of the County are hereby directed to proceed with the project within the
budget contained herein. ,

the language now would not be wise and that all representatives have agreed to this. He said that if you amend the ~~
language then it will have to go back to the other boards.
Commissioner Gordon asked Geoff Gledhill what it says in the agreement about reimbursement. Geoff
Gledhill did not recall what it says. He said that it is clear that when the property is put to a use other than solid
waste, then it triggers the requirement for reimbursement. There is a lot of flexibility in how it is done.
Chair Jacobs said that this is a resolution that was adopted by the Greene Tract Work Group in June and
there is no resolution to adopt for this Board.
Rod Visser said that this is only a presentation to bring the Board up to speed on what the Greene Tract
Work Group has been doing. They were just looking for comments and questions from the County Commissioners.
Chair Jacobs pointed out that it was 10:20 p.m. He said that the Board accepts the basic tenets of what
the group came up with and we are asking for more information on what the legal agreement was previously
regarding repayment and what steps the managers might recommend in the future regarding how and when the
reimbursements would kick in.
Commissioner Brown said that there were excellent materials for the work group and that these should go
out with this resolution.
Chair Jacobs asked about the study of the sewer possibilities and if they address the Neville tract. The
staff will come back with an answer to this.
Chair Jacobs suggested doing the consent agenda and then items 9a and 9d.

8. ITEMS FOR DECISION - CONSENT AGENDA
A motion was made by Commissioner Halkiotis, seconded by Commissioner Carey to approve those items on
the consent agenda as stated below:
a. Minutes
The Board approved minutes from the following meetings: April 22, 2002 budget/cip work session; April
30, 2002-work session; May 6, 2002-joint meeting with Hillsborough; May 13, 2002 (6:OOpm) - work session; May
13, 2002 (7:30pm)-budget work session; June 6, 2002 (6:OOpm)-joint meeting with the Planning Board; June 20,
2002- budget work session; June 24, 2002-budget work session; June 27, 2002-regular meeting; and August 20,
2002 - regular meeting.
b. Chanqe in BOCC Reqular Meetinq Schedule
The Board changed its regular meeting schedule to change the beginning time of the October 21, 2002
Work Session to 5:30 p.m.; to move the Board Retreat from December 7, 2002 to January 25, 2003 beginning at
9:OOam.
c. Motor Vehicle Proqertv Tax Refunds
The Board adopted a refund resolution, which is incorporated herein by reference, related to 36
requests for motor vehicle property tax refunds.
d. Budqet Amendment #4
The Board approved budget ordinance and capital project ordinance amendments for Conservation
Easement, Whitted Human Services Center, and Northern Human Services Center for fiscal year 2002-03
e. Agreement Renewal Between UNC Hospitals and Oranqe Countv for the Senior Wellness
ProQram.
The Board approved and authorized the Chair to sign an agreement renewal to receive $50,000 from
the University of North Carolina (UNC) Hospitals for their co-sponsorship of the Department of Aging's Senior
Wellness Program from July 1, 2002 through June 30, 2003.
f. Contract Award - Piqqv Back of Bid for 2. 100 Roll Cart Containers
The Board awarded and authorized the Chair to sign a contract for the purchase of 2,100 roll cart
containers from Toter Incorporated of Statesville, North Carolina.
~ Resolution Appointinq Evelvn Cecil As Actina Deputv Clerk
The Board officially appointed Evelyn Cecil as acting Deputy County Clerk so that various functions and
duties can be performed in the absence of the Clerk to the Board while the Deputy's Clerk's position is vacant.
h. Petition for Addition of Subdivision Roads to the State Maintenance Proaram.
The Board approved requests to add Rhine Road, Taproot Lane, Piney Bluff Court, Loblolly Court,
Piney Hollow Court, Pine Needle Court, and Pine Cone Lane to the State Maintained Secondary Road System.
i. Ashwick Subdivision - Amendment to Resolution
This item was removed and placed at the end of the consent agenda for separate consideration.
