PURPOSE: To make a recommendation to the North Carolina Department of
Transportation (NCDOT) concerning petitions to add subdivision road(s) in Fox Hill Farm -
Central Subdivision (Farm Gate Drive and Lee Fox Lane) and Tanglewood Acres (E.
Benton Drive) to the State Maintained Secondary Road System.
BACKGROUND: This request includes 3(three) petitions for road additions to the State
Maintained Secondary Road System. The road(s) are as follows:
1. Fox Hill Farm - Central Subdivision (Farm Gate Drive) - Attachment 1a
The requested road addition is about 0.10 miles long. No houses have entrances to the
road submitted for addition; however, the road serves as a collector for Windflower Place
and Lee Fox Lane. Farm Gate Drive is located about 0.80 miles north of the intersection of
St. Mary's Road and Lawrence Road.
Fox Hill Farm - Central Subdivision was approved by the Board of Commissioners on
December 11, 2001. On May 17, 2011, the Board of Commissioners approved a Revision
to the Resolution of Approval to address the mitigation of environmental conditions
discovered on a portion of the open space. The approval of this revision did not alter the
nature, scope, or location of the approved roadway and does not impact the request for
Farm Gate D.rive to be accepted by NCDOT for maintenance purposes.
NCDOT has investigated these requests and has submitted petitions to the BOCC for its
recommendation (Attachment 1 b).
2. Fox Hill Farm - Central Subdivision (Lee Fox Lane) - Attachment 2a
The requested road addition is about 0.15 miles long. Five (5) houses have entrances to
the road submitted for addition. Lee Fox Lane is located about 1 mile north of the
intersection of St. Mary's Road and Lawrence Road.

Fox Hill Farm - Central Subdivision was approved by the Board of Commissioners on
December 11, 2001. On May 17, 2011, the Board of Commissioners approved a Revision

nature, scope, or location of the approved roadway and does not impact the request for Lee
Fox Lane to be accepted by NCDOT for maintenance purposes.
NCDOT has investigated these requests and has submitted petitions to the BOCC for its
recommendation (Attachment 2b).
3. Tanqlewood Acres Subdivision (E. Benton Drive) - Attachment 3a
The requested road addition is about 0.13 miles long. Three houses have entrances to the
road submitted for addition. Additionally, buses accessing A.L. Stanback Middle School
use the road to enter/exit the school property. E. Benton Drive is located about 0.6 miles
north of the intersection of NC 86 and New Hope Church Road.
Planning staff's research indicates that Tanglewood Acres was created prior to the
adoption of subdivision regulations in the Chapel Hill Township. The lots on E. Benton
Drive do not include the road right of way because all lots were created by deeds that
reference the intent for the adjacent road to be maintained by the state at a future time.
Per this intent, the road right of way is not currently owned by any of the property owners
with entrances along E. Benton Drive.
The NCDOT documentation on page 2 of form SR-1 does reference that the subdivision
was platted after October 1, 1975. However, this refers to a recombination platting and not
the original subdivision approval. NCDOT has recently investigated these requests and
has submitted petitions to the BOCC for its recommendation (Attachment 3b).
Conclusion
The above-referenced applications meet the criteria endorsed by the BOCC for
recommending acceptance of a public road into the State Maintained System for roads
approved through the governing jurisdiction's major subdivision process.
In accordance with North Carolina General Statute §136-62*, the Board is required to make
a recommendation regarding the petitions to the North Carolina Board of Transportation
(NCBOT) before NCDOT can consider the petitions.
FINANCIAL IMPACT: There is no direct financial impact to the County associated with this
item. NCDOT will incur additional maintenance responsibilities and costs.
RECOMMENDATION(S): The Manager recommends the Board:
A. Forward the Petitions for Addition to the State Maintained System to the North
Carolina Department of Transportation for subdivision roads in:
' North Carolina General Statute §136-62 directs that "The citizens of the State shall have the right to
present petitions to the board of county commissioners, and through the board to the Department of
Transportation, concerning additions to the system and improvement of roads. The board of county
commissioners shall receive such petitions, forwarding them on to the Board of Transportation with their
recommendations."

RE~UiREMENTS FQR ADDITION
If this road meets the requirements necessary for addition, we agree to grant fhe Department
of Transportation a right-of-way of the necessary widfh to construct the road to the minimum
construction standards of the NCDOT. The right-of-way will extend the entire length of the
road that is requested to be added to the state maintained system and wili inctude the
necessary areas outside of the right-~or-way fo~ cut and fitl slapes and drainage. Also, we
agree to dedicate additional right-of-way at intersections for sight distance and design
purposes and execute said right-of-way agreement forms that will be submitted to us by
representatives of the NCDOT. The right-of-way sF-a!I be aleared at no expense to the
NCDOT, which includes the ~emoval of utilities, fences, other obstructions, etc.
Gener~l Statute 136-102.8 (see page 29 for Statute) states that any subdivision recorded an or
after October 1~ 1975, mtast be built in accordance with NCDOT standards in order to be
eligible fo~ addition to the State Raad System. .
