PURPOSE: To re-convene the February 27, 2012 Quarterly Public Hearing and adopt the
proposed Master Telecommunication Plan Map (hereafter the `Plan') modifications.

BACKGROUND: This Plan Modification was presented at the February 27, 2012 Quarterly ,
Public Hearing. The Plan Map will modify the initial Plan, which the BOCC approved on May ,
17, 2012 by adding four new tower sites (Sites P-9, P-10, P-12, and P15, with yellow circles as
denoted within Attachment 2).
During the February 27, 2012 Quarterly Public Hearing, the following comments were made:
• A listing of existing tower sites with an estimate of capacity for additional collocations at
each existing tower site would place the Plan Map in a better perspective.
STAFF COMMENT: Please refer to Attachment 3 for the requested information. The
map provides the location of existing, and proposed, Plan tower sites as well as various
other existing telecommunication tower sites throughout the County. Attachment 4
contains a list of existing tower sites with known collocations. It should be noted that:
1. Tower numbers may not be sequential because of demolition or approved
towers were not built and the permits have expired.
2. Staff has been working toward an inventory of tower collocations with
latitude and longitude and base elevation data. Data are reflective of

information tower or broadband service providers submitted at the time of
permit approval. Several towers have no collocation data.
3. Staff does not have the technical background to estimate the capacity for
additional collocations. This analysis would involve detailed knowledge of
the structural capacity of the tower to support additional loadings and the
need for additional broadband service within the immediate vicinity. The
number of known collocations is provided in Attachment 3.

STAFF COMMENT: When the initial Plan Map was adopted, Resolution 2011-052 was
enacted prescribing a process for tower locations on County properties. An
environmental assessment and a balloon test are required.
Section 5.10.8(B) Standards for Special Use Permits list a number of submittal
requirements, including a site plan, a landscape and tree preservation plan, and if
required, a visual impact assessment, and a balloon test with proper public notification.
Proposed tower sites seeking only administrative approval must also submit a site plan
and a landscape and tree preservation plan. Tower developers are encouraged to locate
on a site where existing tree canopies can function as a natural visual barrier. Portions
of property with floodplains and steep slopes will not be permitted as tower construction
sites.
• What about the County Park property on the west side of Millhouse Road? How was the
property obtained?
STAFF COMMENT: The County Park property consists of finro parcels totaling some 79
acres of land. Befinreen the two parcels is a recorded access easement of an unspecified
width, which follows an existing farm road back to a 10.01-acre private parcel (PIN
9871607301). A cell tower is located on the property. According to photographic records
the tower was built before 1998. A stream separates the tower site from the County
Park. The tower site is surrounded by County land to the north and east, County Landfill
property to the south, and Duke Forest property to the west. Attachment 7 details the
tower site in the vicinity of the Julia Blackwood Park property.
FINANCIAL IMPACT: Other than the published legal advertisement, which was paid for with
fiscal year 2011/2012 budget funds, there is no financial impact at this time other than staff
time. Eventually, ground lease revenues may be received from towers located on County
properties.
RECOMMENDATIONS: The Manager recommends that the Board:
1. Receive this abstract;
2. Accept any additional public comments;
3. Close the public hearing; and
4. Approve the Plan modification as detailed within Attachment 2.

' As has been stated previously to the BOCC, portions of the County are either not
served, or are underserved, by telecommunication services. This has become an
impediment to essential County communications for several departments (i.e.
' Emergency Management, Sheriff, Information Technologies, Building Inspections, ;
Health Department, etc.), is a detriment to economic development, and has

' negatively impacted local residents. :
! Section 5.10.2 of the UDO enables Orange County to develop and adopt a Master '
�' Telecommunications Plan Map (hereafter `Plan') in an effort to address these '
deficiencies.
; The purpose of the Plan is to display properties where owners have expressed ���','
! interest in allowing wireless telecommunication facilities to be constructed. The
' BOCC first reviewed the Plan at its February 29, 2011 Joint Quarterly Public Hearing ;
and adopted it subsequently. „
According to Sub-section 5.10.2(D)(2) of the UDO, additions or modifications to the '
Plan are reviewed annually, as warranted, by the BOCC at the February Quarterly ;
' Public Hearing. Applications to add to withdraw from or otherwise modify the Plan
' are required to be filed with the Planning Director prior to December 1St of each year. '
' The need for public safety, wireless broadband, and information technology
' connectivity continues to be in high demand.
Adoption, or subsequent modification, of the Plan does not include approval of a
' specific cell tower development project. Rather, the Plan in conjunction with the
guidelines found in Section 5.10.6 of the UDO provides an administrative mechanism ;
' to encourage cell tower providers to work as partners to improve broadband and '
'; emergency service in the rural portions of the County.
; Telecommunication support structures are still required to adhere to the various
' development standards detailed within Section 5.10.8 of the UDO. This includes :
' adherence to the following requirements: ;
a. Development of a site plan denoting the location of the proposed tower, '
', setback distances, fall zone requirements, etc, ;
b. A landscape plan denoting the planting of require foliage for the tower,
c. Draft bond agreements for the project, '
d. Data concerning possible environmental impact, and
e. All other required documentation detailed within the UDO. ',
Further, all telecommunication support structures located on County property are '
required to adhere to initial notification and testing requirements, including the '
' holding of a properly advertised balloon test, the completion of an Environmental '
; Assessment, and the holding of a neighborhood information meeting to inform local
': residents of the pending application.

' The Plan essentially serves as a marketing tool to allow the County to provide some :
' direction on where available properties, suitable for the development of wireless support
' structures, are located. Available properties include those where existing property
! owners have expressed formal, written, interest in allowing for the development of a
' wireless support structure.

It should be remembered that the proposed modification of the Plan does not create an .
; automatic exemption for the various denoted properties from the review and approval
, processes as prescribed by the UDO with respect to the development of wireless support ;
structures. Based on reports, certain areas show coverage weaknesses and other areas
with coverage often have capacity issues.

' Expenditures for this project will be paid using Departmental funds budgeted for the
specific activity. Expenditures include the legal advertisement of the public hearing.
Existing Planning staff included in the Departmental staffing budget will accomplish
the work required to process this amendment. '

Building tower facilities, with public communication technologies, on County or other

ORANGE COUNTY BOARD OF COMMISSIONERS
ORANGE COUNTY PLANNING BOARD
A joint public hearing will be held at the Department of Social Services, Hillsborough
Commons, 113 Mayo St., Hillsborough, North Carolina, on Monday, February 27, 2012
at 7:00 PM for the purpose of giving all interested citizens an opportunity to speak for or
against the following items:
A. PUBLIC HEARING ITEMS
10. Unified Development Ordinance (UDO) Text Amendment: In accordance with
the provisions of Section 2.8 Zoning Atlas and Unified Development Ordinance
Amendments of the Unified Developrnent Ordinance.(UDO), the Planning Director has
initiated a text amendment to Section 2.24.5 (B) of the UDO to modify existing language
establishing the riglits of local citizens to appeal legislative decisions by the County.
Current regulations require appeals from legislative decisions be filed in Superior Court
within 30 days from the date of decision. Recent changes in State law have increased
the filing deadline. Planning staff is proposing to modify existing regulations to make
them consistent with State law.
Purpose: To review the item and receive citizen comment on the proposed text
amendments.

Item C.10. Telecommunication Plan Map-To review government-initiated amendments to
modify the adopted Master Telecommunications Plan Map (MTP) by adding 4 additional sites.
Glenn Bowles showed the Telecommunication Plan Map modifications. At the February
2011 Quarterly Public Hearing, the boards reviewed the initial MTP map and then in May the
BOCC approved the initial map. This is a modification of that map. The map that was approved
last year was all the red and green areas (red being existing towers and green being proposed).
The light green circle around each area is a two-mile buffer. There are four additional sites —
two of which are County-owned sites (Blackwood Farms and the park across the street from the ,
Chapel Hill Service Center). Site B-12 is owned by OWASA and is also the American Stone
Quarry property. The Scott property is in the northwest part of the County. He asked the �
County Commissioners to accept this map. I
Commissioner Jacobs made reference to Site P-10, the Blackwood property and said ',
that there was a discussion about a ten-acre parcel that was going to have a cell tower, and he
thinks that the County ended up buying that site. He wants to make sure that this is the same I
site he is thinking about. I
Craig Benedict said that he is not familiar with whether this is that site or not. He will
research this.
Commissioner Hemminger said that the County did purchase the ten acres.
Commissioner Jacobs said that he is interested in being involved in site placement of
towers on each site.
Commissioner Yuhasz said that he would like to see a map of all private towers and also
an inventory of which of those sites have available space.
A motion was made by Commissioner Hemminger, seconded by Commissioner Yuhasz
to close the public hearing and forward any comments to the March 22"d meeting.

Chair Pelissier asked that the public hearing be adjourned until March 22"d instead of
closing it.
