Notification Materials PURPOSE: To hold a public hearing on a County initiated amendment to the 2030 Comprehensive Plan Land Use Element Map affecting approximately 47 -acres near Efland and Brookhollow Road, along the south side of McGowan Creek. The areas are currently classified as Agricultural Residential and proposed for 10 -Year Transition. BACKGROUND: The form in Attachment 1 contains additional information and analysis regarding this County initiated Comprehensive Plan Land Use Element Map amendment in the Efland area. The map in Attachment 2 shows the location of the parcel, the current classification, and proposed 10 -Year Transition area. No development project is proposed at this time. One of the fundamental planning tools used to achieve the stated goals and objectives of the Comprehensive Plan Land Use Element is the design and application of a Land Use Plan and Map. The Land Use Plan and Map reflect Orange County's vision for future land uses and is implemented primarily through the application of zoning. No rezoning is proposed at this time. Notification Procedural Requirements In accordance with Section 2.3.6 of the Unified Development Ordinance, the public hearing for this item was advertised consistent with the requirements of the Ordinance. Legal ads were placed in two newspapers of general circulation in the County for two (2) successive weeks; notices were mailed to affected property owners and property owners within 500 -feet of affected properties; and signs were posted in the affected area. Attachment 3 includes the following: • Affected property owner notification letter (1 property owner) • Notification postcards (5.5" x 8.5 ") for property owners within 500 -feet of affected properties (22 total property owners) 190 FINANCIAL IMPACT: See Sections C.3 of Attachment 1. RECOMMENDATION: The Planning Director recommends the Board: 1. Receive the proposal to amend the Comprehensive Plan Land Use Element Map. 2. Conduct the Public Hearing and accept public, BOCC, and Planning Board comment on the proposed amendments. 3. Refer the matter to the Planning Board with a request that a recommendation be returned to the County Board of Commissioners in time for the February 7, 2011 BOCC regular meeting. 4. Adjourn the public hearing until February 7, 2011 in order to receive and accept the Planning Board's recommendation and any submitted written comments. RATIONALE 1. Purpose /Mission In accordance withthe provisions of Section 2.3 Comprehensive Plan Amendments of the Unified Development Ordinance, the Planning Director has initiated. an amendment to the Land Use Element Map located within Chapter 5: Land Use Element of the Comprehensive Plan. The purpose of the amendment is to establish consistency between the County's Land Use Plan and Water and Sewer Management Planning and Boundary Agreement (WASMPBA), as well as engineering design work that is presently taking 192 place. The proposed Land Use Element Map amendment is approximately 47 -acres near Efland and Brookhollow Road, along the south side of McGowan Creek from Agricultural Residential to 10 -Year Transition. 2. Analysis As required under Section 2.3.9 of the Orange County Unified Development Ordinance, the Planning Director is required to: 'cause an analysis to be made of the application and, based upon that analysis, prepare a recommendation for consideration by the Planning Board and the Board of County Commissioners'. In analyzing this proposal, the following information is offered: 1. Staff has been authorized by the Board of County Commissioners to pursue small area plan implementation with a focus on economic development priorities. This proposed Land Use Element Map amendment conforms to the intent of the adopted Efland- Mebane Small Area Plan which recommends evaluation of the Upper Eno Watershed Critical Area and amendments to the Water and Sewer Management, Planning and Boundary Agreement (WASMPBA). 2. This amendment is consistent with land use and housing objectives of the Comprehensive Plan. 3. The request for the amendment has been deemed complete in accordance with the requirements of Section 2.3.8 of the Unified Development Ordinance. 4. The properties subject to this amendment are currently located within the Agricultural Residential land use category as denoted on the Land Use Element Map of the Comprehensive Plan and proposed for 10 -Year Transition classification. 5. This amendment is consistent with the Water and Sewer Management, Planning and Boundary Agreement (WASMPBA) and sewer engineering/design that is taking place to serve the broader Efland area. 3. Comprehensive Plan Linkaae (i.e. Principles, Goals and Obiectives Land Use Overarching Goal: Coordination of the amount, location, pattern and designation of future land uses, with availability of County services and facilities sufficient to meet the needs of Orange County's population and economy consistent with other Comprehensive Plan element goals and objectives. Objective LU -3.6: Establish consistency between the Land Use Plan and the Water and Sewer Management Planning and Boundary Agreement and Map. Objective LU- 3.8:Develop a process for implementing small area plan recommendations through the revision of County policies and regulations. Housing Overarching Goal: Opportunity for all citizens of Orange County to rent or purchase safe, decent, accessible, and affordable housing. This notification is occurring in accordance with the provisions of Section 2.3 Comprehensive Plan Amendments of the Unified Development Ordinance. Land Use Element Map amendments are necessary for consistency with the Water and Sewer Management Planning and Boundary Agreement (WASMPBA) and engineering design for public sewer in the Efland area. This amendment is also consistent with recommendations included in the Efland- Mebane Small Area Plan. The proposed Land Use Element Map amendment is approximately 47 -acres near Efland and Brookhollow Road, along the south side of McGowan Creek from Agricultural Residential to 10 -Year Transition (See Map). Your property is proposed to be included in the 10 -Year Transition land use category. This action, if approved by the Board of County Commissioners, would create future rezoning potential from a low- density residential district to higher - density residential districts. This action does not affect the present use of your property and its zoning. The Orange County Board of Commissioners and Planning Board will hold a Joint Public Hearing on the proposed changes on Monday, November 21, 2011 at 7:00 p.m. at the Department of Social Services located at 113 Mayo Street (Hillsborough Commons Shopping Center) in Hillsborough, North Carolina. Interested persons are invited to address the boards with their comments regarding the proposed amendments at this Joint Public Hearing.
