KNOW ALL BY THESE PRESENT
INTERLOCAL AGREEMENT
BETWEEN THE TOWN OF CHAPEL HILL, NC AND COUNTY OF ORANGE, NC
2011 BYRNE JUSTICE ASSISTANCE GRANT (JAG) PROGRAM AWARD
This Agreement is made and entered into this~°I day of~~~, 2011, by and
between The COUNTY of Orange, acting by and through its governing body, the
Orange County Board of Commissioners, hereinafter referred to as COUNTY, and the
TOWN of Chapel Hill, acting by and through its governing body, the Town Council,
hereinafter referred to as TOWN, both of Orange County, State of North Carolina,
witnesseth:
WHEREAS, this Agreement is made under the authority of Sections 153A-14 and 160A-
17.-1 of the North Carolina General Statutes;. and
WHEREAS, each governing body, in performing governmental functions or in paying for
the performance of governmental functions hereunder, shall make that performance or
those payments from current revenues legally available to that party; and
WHEREAS, each governing body finds that the performance of this Agreement is in the
best interest of both parties, that the undertaking will benefit the public, and that the
division of costs fairly compensates the performing party for the services or functions
under this agreement; and
WHEREAS, the COUNTY desires to serve as the fiscal agent and will file a single joint
application to apply for the awarding of the FY 2010 JAG funds in the amount of
$15,122.00; and
WHEREAS, the COUNTY requests that the TOWN provide the COUNTY $6,048.00
from the JAG award; and
WHEREAS, the TOWN and COUNTY believe it to be in their best interest to reallocate
the remaining JAG funds.
NOW THEREFORE, both parties agree as follows:
Section 1.
The TOWN agrees to provide the COUNTY Six Thousand, Forty-Eight and No/100
Dollars ($6,048.00) of JAG funds.
Section 2.
The COUNTY agrees to provide the TOWN their reallocated funding amount of Nine
Thousand, Seventy-Three and 20/100 Dollars ($9,073.20),
Section 3.
The COUNTY, acting as fiscal agent, will submit quarterly financial reports on or about
the following dates: 4/30, 7/30, 10/30, and 1/30. The COUNTY will also submit an annual
performance report on or about 11/30. The TOWN agrees to assist the COUNTY in
completing the aforementioned reports by providing the COUNTY information, to include
any and all necessary data, regarding the TOWN'S program initiatives related to this
grant award.
Section 4.
The COUNTY, acting as fiscal agent, will not request funding to cover administrative
costs.
Section 5.
Nothing in the performance of this Agreement, shall impose any liability for claims brought
against the COUNTY, other than claims for which liability may be imposed by the State
Tort Claims Act.
Section 6.
Nothing in the performance of this Agreement shall impose any liability for claims brought
against the TOWN other than claims for which liability may be imposed by the State Tort
Claims Act..
Section 7.
Each party to this agreement will be responsible for its own actions in providing services
under this agreement and shall not be liable for any civil liability that may arise from the
furnishing of the services by the other party.
Section 8.
The parties to this Agreement do not intend for any third party to obtain a right by virtue of
this Agreement.
Section 9.
By entering into this Agreement, the parties do not intend to create any obligations
express or implied other than those set out herein; further, this Agreement shall not create
any rights in any party not a signatory hereto.
This Interlocal Agreement shall be effective on July 1, 2011 and expire upon the 31 st day
of July, 2013.
