HomeMy WebLinkAboutORD-2011-037 Unified Development Ordinance Text Amendment – Article 10 (Definitions)7- d Ordinance #: 2011-37 AN ORDINANCE AMENDING THE UNIFIED DEVELOPMENT ORDINANCE OF ORANGE COUNTY WHEREAS, on June 21, 2011 the Board of County Commissioners adopted an amendment to the Orange County 2030 Comprehensive Plan that, in part, amended the definition of "Commercial-Industrial Transition Activity Node", and WHEREAS, a similar term is used in Article 10 (Definitions) of the Orange County Unified Development Ordinance, and WHEREAS, it is prudent to keep terms used in companion documents consistent with one another, and WHEREAS, the Orange County Planning Director is authorized to initiate text amendments, and WHEREAS, the County has held the required public hearing and has found the proposed text amendment is consistent with the adopted Comprehensive Plan. BE IT ORDAINED by the Board of Commissioners of Orange County that the Unified Development Ordinance (UDO) of Orange County is hereby amended as follows: Section 1. The definition of "Commercial-Industrial Transition Activity Node Lan" as found in Article 10 of the UDO be amended as shown below. Proposed deletions are in strike-through text and proposed additions are in underlined text. Unified Development Ordinance Text Amendment Article 10 (Definitions) The Board received the Planning Board recommendation, closed the public hearing and considered a decision on a Planning Director initiated text amendment to Article 10 of the Unified Development Ordinance regarding the definition of "Commercial-Industrial Transition Activity Node Land." Planner Perdita Holtz said that this is a housecleaning item to revise the definition of "Commercial Industrial Transition Activity Node Land." This is so the definition will be consistent with the same definition in the Comprehensive Plan. The item was heard at the August 22"d Quarterly Public Hearing, and since then the Planning Board has recommended unanimously to approve the amendment. PUBUC COMMENT None. A motion was made by Commissioner McKee, seconded by Commissioner Hemminger to close the public hearing. VOTE: UNANIMOUS A motion was made by Commissioner Foushee, seconded by Commissioner Hemminger to approve the Ordinance amendment as recommended by the Planning Board detailed within Attachment 5. VOTE: UNANIMOUS e. Unified Development Ordinance Text Amendment - Section 2 5 3 Site Plan Specifications The Board received the Planning Board recommendation, closed the public hearing and considered a decision on a Planning Director initiated Unified Development Ordinance text amendment requiring site plans to demonstrate compliance with County adopted access management and connectivity plans. Michael Harvey said that there were no comments made at the Quarterly Public Hearing on this item. The Planning Board recommended unanimously that the Board of County Commissioners approve this item. He said that the County Attorney will be recommending the addition of a word in Attachment 5. This is Item U of Section 1. The County Attorney has suggested that the paragraph should read, "Compliance with County adopted access management, transportation, and/or connectivity plans and denote the location of future roadway(s) and access easements, whether public or private, to ensure and encourage future connectivity." PUBLIC COMMENT None. A motion was made by Commissioner Hemminger, seconded by Commissioner McKee to close the public hearing. VOTE: UNANIMOUS A motion was made by Commissioner McKee, seconded by Commissioner Hemminger to approve the Ordinance amendment as recommended by the Planning Board detailed within Attachment 5, with the change in wording as suggested by the County Attorney and shown above. VOTE: UNANIMOUS
